FORT IRWIN, CA – Police have accused 24-year-old Rose Marie Smith with the death of her 4-year-old stepson.
Police were called to a home on June 7 on a report of an unresponsive child.
First responders would find 4-year-old Benjamin Schmittle unresponsive after allegedly having a seizure.
He was rushed to the hospital but because of the severity of his injuries, the boy was airlifted to Loma Linda University Medical Center suffering from a brain aneurysm.
Benjamin would die the next day.
Investigators were informed the injuries Benjamin suffered did not appear to be accidental.
After interviewing family members, investigators arrested Rose Marie Schmittle.
She is facing charges of murder and assault on a child causing death and being held without bail at the West Valley Detention Center.
According to his family, Benjamin lived with his father and stepmother at the time of the incident. He would have turned five years old in July.
