First it was Kevin Smith. The movie director was supposedly too fat to fly and needed to buy an extra seat. This time, it was a thin person who was kicked off a flight to make extra room for an obese passenger.
Attorney Clint David says there is no law prohibiting prejudice against body type.
There are certain classes that aren't protected. Being skinny or overweight is not one of them. For whatever reason the legislature has not acknowledge weight as a protected class," said David.
The latest incident happened earlier this month on a Southwest flight from Las Vegas to Sacramento. A thin woman bought a full-price standby ticket. It was the last seat on the flight. She sat down then the obese passenger walked on board. After weighing their options, the flight crew asked the thin passenger to leave so the obese passenger could have a second seat. Southwest airlines stresses it was a very difficult situation.
Southwest Airlines spokesperson Paul Flannigan told The 33 News "The passenger in question was a minor who was traveling alone. Normally if the passenger were an adult, she would be required to purchase an extra ticket, but we did not want to leave the 14-year-old stranded."
"I think what they should have done was ask for volunteers to leave the plane," said David.
According to Flannigan, the thin woman was booked on the next flight and given credit towards a future flight.
So how big is too big for a flight? The technically guidelines are available when you buy a ticket, but here is a rule of thumb: if the arm rest does not comfortable lower, you may need to buy a second seat.
I don't know about this. The title of the article was misleading. It said "Skinny" person and not a minor. If this person was obese, wasn't this person supposed to buy an extra ticket?

I actually kind of feel bad for the minor...that has got to be really embarrassing. I mean it is one extreme to be ashamed like that on a plane full of ppl but then to have it made public and criticized for it. I agree w/ David that a volunteer should have been selected to deport the plane. I am sure someone would have, feeling bad for the poor girl, alone, a minor and "obese" and all.

Standby gets bumped, makes sense, standby never knows when they will fly anyhow, Ask for volunteer, talk about bringing an embarrassing situation to climax
I believe the obese person was actually the minor, they didn't want to leave her stranded because she was 14, also the reason they didn't force her to buy a second ticket. So they kicked the skinny adult off instead...

They handled the situation correctly, I believe. The skinny chick was stand-by so I don't feel much sympathy for her being asked to get off the plane. The overweight girl was underage and I am glad Southwest was sympathetic to her plight. I actually want to high-five them for making the right call this time.
