Monserrate Hernandez, Gilbert Santiago

Police say a woman knew her 21-year-old son was having sex with a 14-year-old girl, who had a child by him in October, and let the relationship continue.

Monserrate Hernandez, 44, of Tobyhanna, is charged with endangering a child’s welfare while her son, Gilbert Santiago, 21, of Tobyhanna, is charged with statutory sexual assault.

Police on Sept. 17 responded with Monroe County Children And Youth Services to investigate a child abuse complaint at the residence and took protective custody of the 14-year-old and another child.

Hernandez is the girl’s legal guardian and her son was 19 at the time of the sexual relationship, police said. The report does not specify if the girl was 14 at the time or is 14 now.

The mother and son were arrested Tuesday, arraigned and are out of jail on unsecured bail. Both will appear in Tobyhanna District Court for a preliminary hearing at a future date.

After reading this I shudder to think of all the problems that are in our foster care system. What made this mother think that this was okay? Did she not stop to think that maybe 14 was just a little young? What if it had been her daughter? Sons are not exempt from the safe sex and responsibility talk. Not to mention that they are NOT EXEMPT FROM THE DAMN LAW!!!! What in the hell makes these people these people think that these acts are okay? I would say that the law needs to be taught in school, but usually a parent instilling values & morals goes a long way towards teaching a child what is right and wrong and prevents them from breaking the law. We are living in an amoral world.
