CPS, what a freaking JOKE. A worker showed up at my door one day saying she received a call about my sink being full of dishes and fly strips hanging up around the house. Can you IMAGINE?? I told her I have 4 kids, 3 under the age of 3 and sometimes there is just not enough time in the day. To her credit, I'm pretty sure she thought that the call was BS when she got it, but had to come out anyway.

As she was leaving I actually thanked her for following up on the call she got because so often calls are overlooked or unheeded and things like THIS story happen.

Yet it pisses me the hell off that I would get knocks on my door because I'm trying to keep flies out of my damn house and this bitch gets away with torture for 15 years!

CPS has their hands tied at times too. Yes, this worker did show up to see you actually taking care of your kids, not many parents who have 3 kids under the age of 3 take care of them because of the stress they can be put under at times. I congratulate you for doing an excellant job!!! The ones who are abusing know exactly how to con the workers into believing that they are taking care of kids when in fact they are abusing them horribly. CPS look for what stands out and this woman knew how to hide the abuse as in many cases acrossed the nation.

I have seen innocent famlies put through hell just because one thing stands out pointing at abuse when in fact the kid fell against something causing a bruise that is in plain sight. I have also seen kids with so many injuries that were hidden untill you removed a shirt of a child. As in most workers, you have good and bad. Don't forget the one who came to your home was a good worker looking to protect your kids if they needed protecting.

Yes, that is exactly why I thanked her. I know it is a thankless job, and I think she was quite relived that I was understanding rather than bitter or angry over her visit. Well the anger came AFTER her visit lol. But I am glad she is one that was on her toes. She even came to my house after hours as it was on her way home. That's dedication, and I will be sure to call HER if I ever witness abuse.

But of course as luck would have it, the very next day, one twin fell down the stairs resulting in a nice lump and was in a REALLY crabby mood for the day, which caused her to pop the other twin in the eye resulting in a REALLY nice shiner. I have to admit I was kinda impressed as well as mortified. Try explaining THAT to a worker after all they hear every day lol.

Blame spreads around, it seems, for the brutal death of 15-year-old Jazzmin Davis, of Antioch, in 2008 and the torture authorities say she and her twin brother suffered for years at the hands of their aunt and foster mom, Shemeeka Davis.

San Francisco officials have agreed in principle to pay $4 million to Jazzmin's brother to settle a lawsuit against the city's child welfare agency and social worker Ann Marie Smith, accused of turning a blind eye to abuse at the house on Killdeer Drive in Antioch.

The Antioch Unified School District also is poised to pay as part of the same lawsuit, although Superintendent Don Gill said a judge has yet to finalize a settlement and declined to reveal an amount. Lawyers for Jazzmin's brother accuse school employees of ignoring clear signs of abuse and failing to report her habitual truancy -- the result of her captivity in a bedroom where authorities say Shemeeka Davis burned, battered and starved the twins to skin and bones, scars and bruises.

In May, the court-appointed advocate for the foster twins, Tali Soltz, agreed to settle with Jazzmin's brother for $100,000, court records show.

Meanwhile, a March 14 trial date approaches for Davis, 40, who faces five felony charges and a possible life sentence, accused of abusing and torturing the twins and killing Jazzmin.

An Antioch foster mother charged with killing her 15-year-old niece upon torturing the girl and her twin brother for years pleaded not guilty by reason of insanity Friday.

Shemeeka Davis, 40, will be evaluated by two court-appointed doctors to determine whether she was insane in the years before Jazzmin Davis died Sept. 2, 2008, from malnutrition exacerbated by long-term physical abuse.

"She is not guilty by reason of insanity, there's no question," said deputy public defender Betty Barker, who added that Davis is taking psychotropic medications. "It's clear from the evidence she was insane. You don't even really need a doctor to say that."

Davis is scheduled to go to trial in May on charges of murder in Jazzmin's death, and child abuse and torture of both Jazzmin and her brother. The twins' paternal aunt, Davis took custody of the siblings days after their birth and was their foster mother under the supervision of San Francisco Human Services Agency. Based on a social worker's recommendation, Davis won permanent guardianship six days before Jazzmin died.

To be found legally insane, it must be proven that Davis suffers from a mental disease or defect that contributed to her either not understanding the nature or quality of her acts, or not knowing what she was doing was morally or legally wrong, prosecutor Satish Jallepalli said.

On Friday, Davis entered what is called a "dual plea," both not guilty and not guilty by reason of insanity. She will be tried by jury if either doctor determines she was sane at the time of her crimes, or if both doctors say she was insane and prosecutors objects to those findings.

If she is found insane by either a jury or judge, she will be committed to a state mental hospital for a term up to life, but as little as 180 days if the hospital determines she has regained her sanity.

On the day she died, she was 5 feet seven inches tall and only weighed only 78 pounds, Jallepalli said. The coroner found that she died from a combination of physical abuse and malnutrition.

But the abuse also had a psychological component. Jallepalli said Davis allegedly convinced the children, who knew they were foster children, that nobody else would love them. That belief prevented them from telling anyone about the abuse, Jallepalli said.

Barker said nothing would excuse what Davis did to Jazzmin and her brother, but the circumstances that led to Jazzmin's death were a complex web of severe mental illness, dysfunctional family dynamics and failed social services systems.

Davis herself was born to a drug-addicted mother who abused her and her brother -- the twins' father -- deprived them of food and locked them out in the cold while she turned their home into a heroine den, Barker said.

Davis and her brother were taken from their mother and sent to live with their grandmother when Davis was 5 years old, but their grandmother was also abusive, Barker said.

She was 21 and had two children when she took on the care of Jazzmin and her brother, who had numerous health and behavioral problems as a result of being born addicted to crack.

When the twins were 7 years old, Davis gave birth to a daughter with a heart defect and needed surgery.

Around that time, a social worker told Davis that she had to tell the twins that they were foster children.

Jazzmin took the news especially hard, Barker said, and began to act out. She even destroyed the baby's clothes and toys.

When Davis asked for help from social services, she was referred to a clinic, where she was assigned an intern to talk to, Barker said.

Meanwhile, Davis had begun to suffer from delusions.

"Shemeeka, in her delusions, believed that Jazzmin was dangerous and evil," Barker said. "She was wrong, but that was her belief."

She said Davis looked at Jazzmin and saw a danger to herself and her daughter, who was 7 years old when Jazzmin died.

"How does a parent get to the point where she looks at a child and sees the devil?" Barker asked.

Barker argued that Davis' mental illness prevented her from seeing that Jazzmin and her brother were suffering and that Jazzmin was literally starving to death. All she could see were her delusions.

"She honestly saw the devil in Jazzmin," Barker said.

Shemeeka Davis sobbed throughout the attorneys' opening statements, beginning when Jallepalli described Jazzmin's twin brother's first question to authorities after hearing of his sister's death: Did his mother know that he still loves her?

"Even with the pain, fear and anguish of having just lost his sister "... his major concern was the love for his mother," Jallepalli said. "She did not deserve that love."

Antioch foster mother sentenced to life in prison for killing niece, torturing nephew

MARTINEZ -- In Jazzmin Davis' final journal entries, written a year before the 15-year-old died in 2008 of long-term child abuse, the Antioch girl focused on her attempts to please the foster mother ultimately convicted of her murder.

"I want so bad to have a better relationship with her," Jazzmin wrote, as read by deputy district attorney Satish Jallepalli on Friday at the sentencing for Shemeeka Davis. "I love her so much."

Shemeeka Davis sobbed heavily throughout the hearing at which she was sentenced to 25 years to life by Judge Susanne Fenstermacher for killing Jazzmin and life in prison with the possibility of parole for torturing Jazzmin's twin brother. She will be eligible for parole at age 69.

The twins spent months locked in a small, bare and dark closet before Jazzmin died Sept. 2, 2008, of malnutrition exacerbated by long-term physical abuse. Jazzmin was 5 feet 7 and weighed 78 pounds when she died naked on the floor; both twins were covered in burns, scars, cuts and bruises.

"I'm very sorry. This was not my intention," said Davis, who has been diagnosed with numerous mental illnesses, including a delusional disorder that her attorney said caused her to believe that Jazzmin was out to harm her 7-year-old daughter.
