Khayr Cash was only 6 days past 7 months old when he died June 7, 2007, after being beaten to death and suffering eight skull fractures, spinal hemorrhaging and other injuries.
Michael Blakey, 31, has been charged with murder in the death. Now he's facing the death penalty. It's taken a while because Blakey chose to run and hide for over seven months.
The baby's mother, Keturah White, was dating Blakey at the time of her child's death .
Khayr had been fine at daycare when White's roommate, Danielle Washington, picked him up and brought him home. He had an ear infection, was crying and had trouble sleeping, Washington said.
Blakey came over to visit and told Washington that he would tend to the child in the bedroom. She said the crying stopped and about 45 minutes later Blakey left the apartment. Police later determined that he called a friend for a ride.
"Please come and pick me up. Hurry please, I got to get out of here in a hurry. There's trouble here," Blakey reportedly told the friend.
After Blakey left, Washington checked on Khayr several times. When she discovered he wasn’t breathing, she called 911. Khayr died three days later.
A forensic pathologist determined in an autopsy that Khayr's skull was fractured in eight places, likely caused by slamming the baby repeatedly into the concrete floor of the apartment where he lived with his mother.
Blakey was initially contacted by police but provided a fake name and address. When they went looking for him later, he was nowhere to be found. He was arrested during a traffic stop in North Carolina just over seven months later.
Blakey got an extra seven months of freedom. Khayr only got seven months of life.

October prior to Khayr's death, Blakey, who imagined himself a rap and music promoter going by the name Top Cat, was charged in New York City with selling marijuana and resisting arrest.
In April he filed charges against the NYPD detective who arrested him. He alleged Detective Marc Cooper beat him while he was on his knees already under arrest. Cooper was indicted for firing four of the 50 shots at Sean Bell, killing him on the morning of his wedding day.
Cooper's lawyer has denied Blakey's claims - saying it was no surprise people would seek money by filing civil suits against Cooper.
Even if he wins, I don't think he'll need money where he's going.
