AUSTIN, Texas (KXAN) -- Police on Monday filed charges against a man for shooting his 1-year-old daughter in the ankle last week.
Police said Paul Estevan Rodriguez, 18, shot his daughter after a dispute with the child's mother Tuesday.
Police said the girl is recovering after undergoing minor surgery to remove the bullet.
An affidavit said the girl's parents got into an accident near Rogge and Wellington Lanes Tuesday. Police said the mother, Andrea Milligan, had spotted Rodriguez and started following his car. Rodriguez then slammed on the brakes, and the two got into the accident.
"Paul got out of the vehicle with a gun, and as the victim's car was next to Paul's, he fired one shot," said police Detective Jason Staniszewski.
Witnesses said Rodriguez then got out at the intersection and shot into the backseat where his 1-year-old daughter was riding after hearing warnings from Milligan.
Officers said the father and mother had a history of arguments.
"The mother did say, 'Don't shoot in the car, your daughter's in the backseat,'" Staniszewski said.
The affidavit said Rodriguez then got back into his car and drove away.
"Once the mother realized the baby had been shot, they were trying to get to the hospital, while they were driving, they ran into a police officer," Staniszewski said.
Police said they do not know why Rodriguez and Milligan were arguing, but the father's new girlfriend had been sitting in the front seat of the car.
Police are looking for Rodriguez and have a $50,000 bond waiting for him.
