CINCINNATI (FOX19) -- A man charged with killing a 2-year-old had his pre-trial hearing Thursday morning.
Anthony Pierson, 32, faces the death penalty for the murder of his girlfriend's son, James Livesay. Judge Norbert Nadel set a trial date for March 18, 2013, with a hearing on pretrial motions set for July 25. Pierson remains in the Justice Center, where he is being held without bond.
Pierson is charged with one count of Aggravated Murder with a death penalty specification, 1 count of Murder (Special Felony), and 1 count of Felonious Assault (Felony 2). If convicted of all charges he will face the death penalty.
Pierson, the boyfriend of James' mother Pamela Burton, was watching her son while she was at school. When she returned to the home in the mobile home park at 7501 School Road in Sycamore Township, she found James unresponsive and called 911. The boy was taken to Bethesda Hospital in Montgomery where he was pronounced dead.
The coroner ruled that the boy died of blunt force trauma. She also reported his injuries included multiple bruises in multiple parts of the body, and multiple injuries to the abdomen, including damage to both internal organs and large blood vessels. James Livesay also had blunt force injuries to his genitals.
Deters said "the injuries and pain that this baby suffered were horrific. How anyone could kick and stomp a 2-year-old child in this fashion is impossible to comprehend. It's ironic that the justice system will now provide this defendant with the due process that he never gave James."
James Livesay's siblings, who are 4, 5, and 7, are now being cared for by a relative.
