Baby Doing Better: Father Charged With Cruelty And With Attacking KMPH News Crew

KMPH News Anchor Nicole Garcia and photographer, Matt Romero, were attacked by a man accused of child endangerment while covering a story at Bass Lake Monday.
Now 33-year-old Marc McMurrian is under arrest. He faces child endangerment and misdemeanor battery charges for the attack.
The first time the crew approached the man, they did not know he was involved with the incident, and he denied being involved.
Later, as the crew was shooting video in the parking lot, the man began yelling and using profanity, then approached the camera.
Madera County Sheriff's deputies say it all began early Monday afternoon, when he left his 8 ½ month old boy alone in a van as he carried supplies to a picnic area.
While he was gone, deputies say the baby crawled out a broken window and landed head first on the ground.
A Good Samaritan found him and called 911.
He was flown to the hospital, where our crew expected his parents would be.
Instead, the father was still at Bass Lake, just hours after the fall.
Investigators identified McMurrian of North Fork as the person to blame.
After the confrontation with KMPH, McMurrian left the picnic area with his family, without hurting our news crew or anyone else.
But McMurrian does have a history of hurting children.
Jail records show he was arrested on three counts of child abuse last year and spent more than two months in jail before he was released.
They say the baby boy is expected to be all right.
KMPH contacted CPS about why McMurrian was still allowed to care for his son after being arrested on felony child abuse charges.

McMurrian is at the Madera County Jail. His bail is set at $10,000.

A North Fork father is in jail for child neglect- the day after his baby son fell out of a car, head-first.
Marc McMurrain is also facing a battery charge for attacking our news crew.
This caps off a long list of violent convictions and child abuse charges to his name.
A convicted violent felon, court documents show McMurrain has a long rap sheet dating back to 2000 when he was convicted of burglary and served prison time.
In 2002 he was convicted of having meth.
In 2009 he was charged with three counts of felony child abuse.
Last year he was charged with three more counts of felony child abuse and Tuesday, he was arrested for one count of child neglect and battery.
In addition to the baby boy who fell on his head at Bass Lake, court documents show McMurrain has at least two other kids.
KMPH asked the director of Madera County Department of Social Services about the case, asking the question, "Why isn't that enough to remove these children from their father's care?"
Director Kelly Woodard replied, "Well first of all, I can't comment about the case. But in any situation, law enforcement will make a decision on whether the children are at risk, we are right there with them in that process. So history is a factor when making that determination."
As for the mother in the case, court records show Jennifer Moore was arrested on suspicion of three counts of child abuse in 2009 - for an incident she and McMurrain are both being held responsible for.

As for the baby boy that survived Monday's fall out of a car window at Bass Lake, he's going to be okay and is in the custody of Child Protective Services.
