    Timothy Masters Story



    In February 1987, people in Fort Collins, Colo., were on edge after a woman, Peggy Hettrick, was found murdered and sexually mutilated.

    Police almost immediately zeroed in on a local teenager named Tim Masters, even though there was no physical evidence to tie him to the crime. But investigators kept revisiting the case, and years after the murder arrested Tim, tried him, and won a conviction.

    But as correspondent Susan Spencer reports, this case is anything but open and shut. Is Tim really a crazed killer, as the lead investigator insists, or is he just a victim of circumstance?

    Tim went to prison in 1999, and for much of that time, lived in a cramped, dreary cell, sentenced to life for a grisly murder he swears he did not commit.

    "I'd be laying in my bunk... and it still astounded me that I was there. I couldn't believe it," he said.

    His latest court hearing didn't seem real either, because after years of hearings and petitions and unsuccessful appeals, a judge at last was about to make a ruling that could set him free.

    If he does walk free, he'll have a small army of unlikely supporters to thank - not just his gigantic extended family, but also lawyers and even former cops, all of them claiming they've been sure for years that Tim didn't do it.

    Tim Masters, 37, has walked in the shadow of this murder since he was 15 years old. On the morning of Feb. 11, 1987, the half-naked body of a 37-year-old woman named Peggy Hettrick was found in a field in Fort Collins, Colo. - a stone's throw from Tim's house.

    There were a lot of people who felt Tim was a viable suspect, including , in 1987, veteran cop Linda Wheeler.

    "I think it was like 7:13 in the morning. The body has just been discovered... The body was very clean to look at; there was no blood on the body," Wheeler explained.

    The passerby who spotted the body first mistook it for a mannequin.

    There was a deep stab wound to Peggy's upper back. "You could see a bloody drag trail in the furrows," Officer Jim Broderick recalled. "It was pretty apparent that the victim was dragged out to the final resting point..."

    When Officer Broderick arrived at the scene, he was struck by footprints along that trail, leading back to a pool of blood by the curb and he was struck by the body itself.

    "The positioning of the body is something to pay attention to," said Broderick.

    Peggy's pants were pulled down to her knees, her shirt pushed up to her chin. Part of one of her breasts had been removed.

    It was, in fact, a sexual homicide," he continued.

    The prospect of a madman sexually mutilating his victims created near panic and Broderick and the Fort Collins police went into overdrive.

    Among the early "persons of interest" was Peggy's one-time boyfriend, Matt Zoellner. He was questioned for hours, even took a polygraph, and was then released.

    Police meanwhile were canvassing every house near the crime scene, talking with businessmen, housewives and even with prominent eye surgeon Dr. Richard Hammond. Years later, Hammond would figure in this case, but back then, he was just another neighbor who had seen nothing suspicious.

    But Linda Wheeler was sure someone must have seen something. She says the first house she went to was the Masters home, where Clyde and his 15-year-old son, Tim, lived. Tim had few friends, but no history of trouble.

    His mother had died four years earlier, when he was only 11.

    Usually, Tim cut straight through the field to catch the school bus, but his father told police that on that morning, he'd seen his son hesitate. "And had veered to the left as he was walking through the field, and had stopped for a few moments," Wheeler explained. "It became very obvious to me that his son must have seen the body."

    Tim's footprints were in the field, but he hadn't reported a thing. A few hours later, police appeared at Tim's high school and yanked him out of class for questioning, as Broderick recalled in an interview in 2000.

    "His explanation for not reporting it was that he thought it was just a mannequin and that somebody was playing a trick," said Broderick. "I didn't believe it was real...a 15-year-old kid," Tim said. "But all morning long, as I'm at school I'm thinking about it, 'What if it was really a body?'"

    The passerby who called in the crime also thought he'd seen a mannequin, but police weren't buying that story from Tim. Broderick searched the Masters' trailer, and hit pay dirt. "And there on his dresser he's got seven knives, six, seven survival knives, all sequentially displayed," he said.

    And one of them, Broderick assumed, could be the murder weapon. With Tim's father's permission, Broderick and a team of cops interrogated the 15-year-old for more than 10 hours without a lawyer.

    Tim insisted that he didn't know what had happened and that he was innocent. Police also gave him a lie detector test. The official report of the test results is lost today, but Broderick says Tim failed.

    "He definitely needed to be looked at, yes. Definitely he did, and it was very easy for everybody a kind of pack mentality to start focusing on him," said Wheeler.

    And leading the pack was Jim Broderick, who was about to find evidence that, for him, erased all doubt -- Tim had killed Peggy Hettrick.

    Lead Detective in Tim Masters Case Indicted for Perjury


    Tim Masters was wrongfully convicted of first degree murder in 1999 and sentenced to life in prison. The murder occurred when he was 15. He was charged in 1998. He was freed in 2008, after serving 10 years in prison, when DNA evidence was tested that excluded him and pointed to another suspect.

    Today, the grand jury in Larimer County Colorado indicted the lead detective on his case, James Broderick, on eight counts of perjury. The Indictment is here. Broderick focused on Masters since 1987 when he first interviewed him, and never changed his mind. Prosecutors initially cleared him of misconduct (the current prosecutor said he was guilty of malfeasance, not misfeasance) but new evidence came to light suggesting Broderick lied about his involvement in the investigation, both in affidavits and on the witness stand.

    DNA finally showed Masters was not guilty. At trial, there was no physical evidence linking Masters to the crime, and other evidence was withheld or destroyed. The prosecutors used a so-called expert's psychological profile to convict him. The City of Fort Collins settled Tim's lawsuit for $5.9 million. Larimer County settled for $4.1 million. [More...]

    Glad for this young man, I really hope he can use his new found freedom for good.

    ETA: after reading the second article, Tim Masters received a total of $10 million from two lawsuits a million for each year he served in prison, The Detective, Broderick should be sentenced to paying all that money back for pretty much railroading this boy.

    That's horrible felt so bad jus watching the clips from interrogation :( real sad but though he'll never get those years back atleast hes made it through it and hopefully can enjoy the rest of his life.

    Oh and the behavior expert was a joke. How can violent pictures the kid drew be 100% proof that he committed a crime. Because one kind of looked like a vagina opening with a knife through it (though I thought it looked like a knife ripping through material that was zippered more than it looked like a vagina. The expert was on the show I watched and he was positive Masters had done it based on crude drawings in a notebook. Ridiculous. T

    I always end up sitting with my mouth hanging open in disbelief when I read an update on this kid. It's like the WM3. The cops were dead-set that the 3 kids they arrested were the killers of those little boys, and they were going to nail them, come hell or high water. It's really painful to watch how stupid some so-called "professionals" can be at times.

    She is blind-folded so that she won't be swayed by status and appearances but only weigh the evidence put into her scales. I quite like her that way........

    I know its supposed to signify she doesnt look at class, race, sex and all the other things but also it seems to me ALL the evidence should be weighed, not just portions of it. When you are only presenting portions of the evidence, it leaves the blindfold on and you can sway it to your side as was done in this case and that is not true justice.

    This is terribly sad. I always get chills reading on cases like this. This poor kid lost his mother at 11 then goes on to lose his freedom. Can only imagine his torment and feeling of helplessness. I hope he goes on to lead a good life, do but I wonder how he will adapt. His father pretty much handed him over to the detectives without representation....doubt he's going to feel all warm and fuzzy about him. Curious if the father visited Tim while he was incarcerated.
    Anyhow, I hope they catch the real killer and wish only good things for Timothy.

    Two other friends offered tantalizing clues that were apparently about the same man, although neither of them knew his name.One friend told investigators that "Peggy had mentioned a twenty-four-year-old male who she didn't want to see anymore," a detective wrote. "Apparently he had been calling her and had stopped by the apartment on the 30th of January and she told him at that time that she didn't want to see him anymore. She didn't know the subject's name and I have not been able to find out more information on that person."


    Another acquaintance said that while she didn't know Hettrick well, she "had expressed some amount of concern over someone she had been recently dating."
    And Timothy Matthews, a good friend of Hettrick's, also told investigators about the mystery man. Matthews and Hettrick were not romantically involved, according to police records, but he said that after staying out late he sometimes "bunked out" at her apartment rather than drive home.


    In his first interview with investigators five days after Hettrick's murder, he described an incident several weeks earlier that began when the two of them went to the Laughing Dog Saloon. While they were there, Matthews told detectives he met a young man who showed up at Hettrick's apartment later that night. Hettrick didn't want to let him in and asked Matthews to "lock the door so she didn't have to talk to him."
    The descriptions offered by the friends of Hettrick's who had seen the man varied in some details but also contained several common threads.
    He was in his 20s. He was between 5 foot 10 and 6 foot and had a husky build. He had hair that was "slightly on the long side" or "longish" — hair that was either blond, reddish blond or brown.

    I seen a story about Tim Masters a long time ago. The asshole cop still that he did nothing wrong, and he takes the credit for Time getting released. If I remember right, the cop had a secret file with tons of exculpatory evidence in it that he had hidden, he claimed the files were his own personal files, work product and therefore not subject to the rules of evidence. I think it had stuff in it like shoe print casts, really important evidence. Stuff that would have shown Tim was innocent of the crime, this guy documented everything! So now he says since he saved all this evidence, he is the one who saved Tim. What and asshole, if he would have made it available to begin with he would have never been found guilty to begin with.

    This cop is a total dick and I hope he has to pay big time. He reminds me of the one cop who had those little kids lie about being molested by all those church people, just so he could say he busted a child molesting ring. Threatened the kids and shit to get them to say what he wanted. Kids finally told on him, he still to this day denies it and says the adults are guilty SMH.
    I love my mom because she loves me and she is a great mom she loves me so much she bought me a psp that stands for playstation portable.
