Both women sat in the front row at funeral service in California, along with a third woman who is the mother of one of his children

The two wives of a fallen soldier sat in the front row at his today funeral after it came to light following his death that he was married to both of them at the same time.

But the relationship between the two women has turned ugly after the soldier's first wife received the folded flag for Army Specialist Moises J Gonzalez - and the second accused her of coming forward just 'for the benefits'.
The 29-year-old soldier was killed in a road accident in Afghanistan on April 25. He leaves three sons - one by each of his wives and a third by another woman


He married Darlene Garcia in 2003 in Los Angeles and the couple had a son. In 2010, he married Ruth Bayona of Bakersfield, California, in Las Vegas with whom he also went on to have a son, Moises Jr.

Ms Bayona said that her Gonzalez had told her about his first marriage, but claimed that they had gotten a divorce.

Today, Ms Bayona, who said she wasn't even notified by the Army about her husband's death, angrily said Ms Garcia should not have received the folded flag honouring Gonzalez.

She told KGET-TV: 'This woman hasn't been in his life for years and the only reason she's coming out right now is because of the benefits.'
'I was with him during thick and thin for three years and he's not here to say anything to explain himself. I should get the flag, not her.'

The wives sat together in the front pew at Saint Matthias Catholic Church in Huntington Park yesterday.
They exchanged no more than a glance and did not try to comfort each other but sat at opposite ends of the row, tending to their sons.

Garcia was too overcome with emotion following the funeral, but Bayona told Channel 17: 'I'm sad, but I know in my heart that's not him. I feel like he's still in Afghanistan, that's how I feel.'


She told the station that she only realised that she was not her husband's only wife from another soldier, when she went to claim his body.
At the Inglewood cemetery, Sgt Gonzalez was buried near his grandparents.

Bayona sat with her late husband's father Carlos Gonzalez, who told the TV station that his son was a 'good boy', while Darlene Garcia sat separately.

The soldier's folded flag was presented to his first wife, who will also receive his Army benefits.

That's exactly what it is. Wife number 1 is the legal wife. The government doesn't recognize the 2nd marriage as legal.

So bascially it breaks down like this:

SGLI- The $500,000 insurance will go to whomever he named as the beneficiary (or beneficiaries) That is the max benefit but he could have opted for less of a payout but most guys take out the max. With this it doesn't matter who is the legal wife (wonder who he left it too?)

Unless he had a will the 1st wife get's all the assets and bank accounts that are in his name only (if the new wife has her name on them then she gets to keep them)

Death Gratutiy-$100,000 will be split among his heirs I believe. It may just go to wife number 1. I know when a man has different kids by different women with no wife the money is automatically split. However if you are married to the mother of your children she gets the entire benefit (I wonder how they do it when he is married and has kids from another marriage)

All 3 children will get health and dental until age 18 (as long as there is a b/c with his name on it as the father)
All 3 children will SBP benefits.
All 3 chidren will get part of his Social Security benefit.
All 3 get the VA benefit for college

Now what the #1 gets that wife #2 does not.
She can file Mother with child benefits and recieve SS benefits for herself. This will make it a 4 way split opposed to a 3 way split. She will get the money for her and her son and the others only for the children. Therefore there is less money for the other kids.

She also gets DIC benefits for her and her child. I'm do not believe children get DIC payments just the SPB. The way mine works is I get DIC for me (I had to forfeit SPB) and it includes my children as a factor into the payout. My children only recieve the SPB payment.

Also the 1st wife as long as she does not remarry gets to keep her health care and dental for 3 years. After that she has the option to pay for it (medical is less then $300 a year) She also gets to keep her base privledges. Oh yeah and she can take advantage of the Veteran's benefits to go to school/college if she choses.

So basically this guy is an idiot if he intended for wife #2 to be taken care of. He failed her in not getting the proper divorce and updating his records with the Army in order to make her next of kin. I wonder if she even had medical from him since obviously wife #1 is listed as next of kin since she was notified not wife #2. See when you go to add a new spouse to anything they need your divorce records to make the changes. If I were her I would think that itself is a little odd wouldn't you, not having health coverage like other wives do? If she did have health insurance somebody found a way to scam the system. Maybe wife number 2 just didn't have a clue.

She just immediately comes off as a bitch simply becoz of the fact that she thought he was divorced but when it comes out that it's bullshit she immediately attacks the first wife like its her fault. That's pretty standard with the military. They want documentation. In order for him to put his new wife on as his next of kin or to enroll her in health care he would have HAD to have shown them the divorce papers. So I'm assuming she didn't get benefits when he was alive. Either she knew he wasn't divorce or she is just really dumb. I mean did she ever wonder things like why do other spouses get medical for their wives? Why don't I have a military ID like the other wives do? How long were they "married"? I mean none of it seemed odd to her?

I'm thinking he didn't update a thing after marrying #2. So she is ass hurt that wife #1 gets the big benefits like you know a half million dollars.

Exactly! It's his fault if he lied to her! Not his first wife. She didn't go marry someone else illegally. I like how the new wife says she only came out for the benefits. Ummm she didn't ask for the benefits I assure you. She probably didn't even know the full extent of the benefits (shit I didn't know until my husband died) and the fact is the Army through her CACO officer probably brought them to her. The first wife didn't have to seek anything out. They give it to you. Yes wife number 1 has to file with SS to get benefits for her and their child but still that's standard. The 1st wife isn't doing anything that is not within the normal. Even if wife #1was to refuse a benefit like the death gratutity wife numbe 2 still would not get it. It would be divided among the 3 children. Even if wife number 1 doesn't file for mother in care benefits wife number two still cannot claim them.

Exactly! A friend of mine her ex husband was a dirty rotten dog. They were stationed in MI on recruiter duty and got a divorce while here (well she moved home during the divorce but it was pretty much done at that time) anyways; this fuck stick didn't bother to update his records at all. Then a few months later when he went back to their home state as well he claimed family move benefits to get more money for the move. He then got base housing for his "family" that lived somewhere else. Oh did I mention he brought his 19 or 20 year old fiance with him. So they are living high on the money he got for having his family.

So when he decides to marry this girl he realizes he has a problem cause the divorce papers didn't match when he was taking benefits. His solution, doctor his divorce papers. He ended up getting busted. He is no longer in the miltary (he had a lot of issues with fraud and the like) and now he has to pay all that money back. The military don't play. They are not going to pay what they don't owe and if they find out you got some you didn't earn, they take that shit right back.

What a total dick. I don't want to point fingers and judge the wives and mistress in all of this, even though I have thoughts and feelings on it. I do want to lay the fault and blame squarely where it belongs, and that is on Gonzalez. He turned this shit into a 3 rings circus, left 3 kids that will forever be marked by their father's death as not that of a hero (which it should be) but as a bigamist fuck-up. If he wanted 2 wives or 10, I don't care. If he wanted 15 mistresses on top of that, I don't give a shit. They are all big girls and can figure it out or not. I would think he is a total asshole for that but to bring 3 children into this world without really a thought to what kind of life he would or could provide them, especially given what his job was, makes him scum. Honestly, I only feel for his children in all of this. He should have always been a hero to them and instead this is the legacy he left them and what he will be remembered for.
