Albuquerque boy, 5, fights for life after being thrown against dresser

A 5-year-old Albuquerque boy who was thrown into a dresser continues to fight for his life.
911 tapes obtained by KOB 4 reveal the man accused of the abuse gave law enforcement different stories about what happened.

A criminal complaint reveals Richard Gutierrez admitted to Albuquerque Police that he threw the boy into bedroom furniture after the boy lied about wetting his pants.

As a result, doctors told police that the boy had lost all brain activity.
But on the 911 audio tape, Gutierrez told 911 dispatchers that the boy fell on his own.

"My son fell off the bed and he's not breathing. I don't know if he hit his head or what," Gutierrez said.
For eight minutes, Gutierrez tries to convince dispatchers that he was not responsible for the boy’s injuries.
"I was in the living room with the baby and he fell off the bed,” Gutierrez told a 911 operator. “I don't know how he fell off the bed but he was by the TV and he was all messed up.”
911 operators tried coaching Gutierrez into giving the boy CPR and chest compressions.

Gutierrez made a first felony appearance in Metropolitan Court today.
Judge Benjamin Chavez held the bond at $125,000.

As of Thursday evening, APD reported that the boy’s health had made no progress and his injuries are still considered life threatening.

A 5-year-old Albuquerque boy has died in the hospital after police said his mother's boyfriend threw him against a bedroom dresser earlier this week.

The Albuquerque Police Department said Isaiah Ithurria, 5, was taken off life support on Saturday at the UNM Hospital.

Richard Gutierrez was arrested Tuesday after he called 911 and said Isaiah fell of the bed and wasn't breathing.

Gutierrez later told officers he threw the boy off the bed after he lied about wetting his pants.

Since that incident, Isiaiah was in the hospital with traumatic brain injuries, but in the end, his trauma was too much to overcome.

Gutierrez is likely to face additional charges, but those have not been set at this time.

Man indicted in abuse death of stepson

ALBUQUERQUE (KRQE) - The Albuquerque man accused of throwing his 5-year-old stepson into a dresser and killing the boy because the child wet himself has officially been indicted for murder.

And new details show the boy's death may only be the end of a history of terrible abuse suffered at his the hands of hi stepdad, Richard Gutierrez.
Police said the boy had other injuries that show he was abused before he was killed and that the abuse was also sexual.
In early May the boy, Isaiah, had been home with his stepdad when police received a call from Gutierrez.

"My son fell off the bed and isn't breathing, I don't know if he hit his head or what," he told the the dispatcher after calling 911.

But detectives say that is not what happened.

They said Gutierrez later admitted he threw his son against a dresser at the home after he got mad because Isaiah wet his pants.

Gutierrez tried to describe the boy's injuries on that 911 call.

"He's gasping for air; he is not breathing," he said.

But in the end it was too late. Isaiah was brain dead and died a few days later.

Gutierrez is now is not only charged with child abuse, but also murder.

A new six-count indictment also alleges Gutierrez molested the boy sexually.
Medical examiners found injuries to Isaiah's genitals.
They do not know if those injuries were inflicted upon him the day he was thrown into the dresser, but police said the injuries are more consistent with abuse than sexual assault.

The penalty for the child abuse resulting in death and the murder charge are the same. Both could mean life in prison for Gutierrez.

@Whisper, I have vivid memories of being a tot, too vivid if you ask me.I can even tell you play by play when I fell off my porch and busted my head, that required stitches. Oh yes, my memories are my worst enemy.

I never wet my bed as a tot, never. As soon as my parents split up and I was being molested, age 4 to be exact, I started wetting my bed. Kids don't just out of the blue wet themselves, it's a reaction to something traumatic going on.
