Trial On For Rapist That Forced Woman To Perform Sex Act On Her Infant

A man already serving a lengthy sentence for sexual assault went on trial Wednesday for an alleged 2005 attack on a Wheaton woman and her 5-month-old daughter.

James P. Murphy, 37, formerly of Oak Forest, is charged with more than 20 counts of home invasion, criminal sexual assault and abuse and predatory criminal sex assault of a child.

The alleged victim, who was 26 at the time, took the witness stand Wednesday to describe the Aug. 27, 2005 attack for the DuPage County jury. She said her husband was at an out-of-state wedding when a masked man entered their College Avenue apartment and committed the assault.

The man got away, but police linked Murphy to the Wheaton crime after he was arrested for a similar attack in 2006 in Cook County, a crime for which he was later convicted and sentenced to 30 years in prison.

The masked intruder had his gloved hand over the woman’s mouth when she awoke about 2:20 a.m.

“He said, ‘It’s OK. Don’t worry. Listen to me. I need you to do what I tell you,” she testified Wednesday in a hushed DuPage County courtroom.

She said the man led her to the bathroom inside her Wheaton apartment, where he forced her to undress and then snapped photos as he sexually assaulted her.

Then he turned his attention to her 5-month-old daughter.

Wiping away tears, the woman described how she was ordered to remove the infant’s diaper and perform a sex act on the child as the intruder watched.

“He got up close to see what was going on,” she testified. “He took pictures of me doing that.”

Assistant State’s Attorney Cathy DeLaMar said Murphy was careful to cover his tracks, wearing heavy work gloves and a black ski mask. The victim, then 26, also was forced to wash evidence from her body and her child’s before the intruder fled.

Murphy was arrested in the attack about 10 months later, after being charged with a similar rape in Chicago.

Prosecutors said he went on to make incriminating statements to his girlfriend, and the Wheaton victim immediately recognized his eyes and a dimple in his chin while viewing a police lineup of men in ski masks.

“He brought a camera so he could document every horrific moment as it happened,” DeLaMar said. “But she was taking her own pictures in her mind, memorizing every detail.”

Assistant Public Defender Brian Jacobs contended there was no physical evidence tying his client to the crime, and jurors should not assume he’s guilty because of his other case in Chicago.

“Just because there are similarities between the cases does not mean my client committed every rape in the Chicago area,” he said in opening statements.

Jacobs said evidence would show that Murphy’s statements to his girlfriend were not about the Wheaton case.

I can't believe this even happened.
We tell ourselves to be careful, don't get involved with jerks/abusers/pedos. Keep them from our kids. Be safe, make good choices.

And they're frigging sneaking in & forcing their abuse and perversions ANYWAY!!!!!!

Aarrghh!!!! I'm SO pissed right now. It's so frustrating that you KNOW that you live a life that "should" keep your kids out of harm (minus freak accidents). Yet some asshole perv can take all free will away & make you do the things you've lived your life trying to prevent from happening.

They'd better have more evidence then they've released. One witness is basically nothing in court. Now he's just more educated on how to not get caught.

A former Oak Forest resident who confessed in a letter to acts of “pure evil” was found guilty Friday of the 2005 home invasion and sex assault of a young Wheaton woman and her infant daughter.

A DuPage County jury needed less than two hours to return its verdict against James P. Murphy, 37, who is already serving a 30-year sentence following his conviction for the 2006 rape of a woman in the DePaul University neighborhood.

His arrest in that case and the similarities of that assault to the one in Wheaton made Murphy a suspect in the DuPage case.

Murphy faces up to 120 years in prison, officials said.

While he was jailed as he awaited trial in the Chicago case, Murphy wrote letters to a former girlfriend in which he implicated himself in the Wheaton attack, and he said some of things he did were “pure evil.”

“There can be no question they were the work of the same man,” Assistant DuPage County State’s Attorney Cathy DeLaMar told jurors Friday in her closing argument, which wrapped up three days of testimony.

In the Wheaton attack, Murphy is alleged to have entered the woman’s College Avenue apartment on Aug. 27. 2005, and committed the attack on the woman, who was 26, and her 5-month-old daughter. Although the attacker wore a mask, the woman positively identified Murphy almost a year later from a police line-up of five masked men.

The victim, whose husband was out of town that night, said she could identify Murphy from his eyes and hands, as well as from a chin dimple she saw when her attacker’s mask rode up.

“She’s going to have to live with those eyes the rest of her life,” Assistant State’s Attorney Mike Pawl told jurors.

Man gets 120 years for 2005 sex assault of woman, infant

A man was sentenced to 120 years in prison Monday for a 2005 attack in Wheaton in which he sexually assaulted a young mother and her infant daughter, “an act the devil himself would be loath to commit, ” according to the DuPage judge who handed down the sentence.

Judge Daniel Guerin gave the maximum possible prison term to James P. Murphy, who was found guilty in May of home invasion and a raft of sex charges for the break-in and assault at the woman’s apartment.

Murphy, 37, formerly of Oak Forest, is already serving a 30-year sentence for a rape in the DePaul University neighborhood in Chicago, committed the year after the Wheaton incident. Similarities between the crimes and incriminating letters that Murphy sent to a woman friend from Cook County Jail tied him to the DuPage crime, authorities said.

At his sentencing hearing, several police officers testified to sex crimes Murphy has committed dating back to the early 1990s when he was a teenager. He had been convicted of assaulting a 12-year-old girl at a Moline hotel in 1991, and in 1993, he was arrested for assaulting a student at Naperville Central High School during school hours.

Despite attempts at counseling and the support of family, the judge said, Murphy had spent his life terrorizing, degrading and assaulting women and children.

“That life is over,” Guerin told Murphy. “That you are morally and sexually depraved is crystal clear to the court.”

Murphy’s sentence will be served at 85 percent. His minimum actual sentence is 102 years.
