A Monongalia County father has been charged with sexually abusing his 4-year-old daughter.

James Paul Payne, 61, of Maidsville, was arrested Thursday on charges of sexual abuse by a parent, first-degree sexual abuse, and incest, according to a state police news release.

On April 4, Sgt. A.W. Scott of the West Virginia State Police Crimes Against Children Unit initiated an investigation into the alleged sexual abuse of a 4-year-old girl in Maidsville. The allegation was that the child's biological father had touched her in a sexual manner.

Interviews with the child and a witness gave Scott probable cause to arrest Payne on Thursday.

Police charged Payne, a registered sex offender, with 3 felony counts for sexual abuse by a relative, incest and 1st degree sexual abuse.

Payne's 4-year-old victim is close to the same age range as his previous offense.

A witness saw the girl exit Payne's bedroom, naked, yelling for her mother.

Payne was convicted in 2005 for first degree sexual abuse of a family member and received four year of probation.

Never assume he is guilty. We all know how children can be led to say certain things in an interview so never assume. People automatically assumes guilt when someone is arrested, especially when it involves a child that they forget common sense reasoning that the accused could be innocent. Typical.

My FIL's new wife has no idea he molested my SIL. That's because charges were never brought against him. Suprisingly nobody has told her yet. The only reason I don't is because I feel it's not my place and don't want to step on my SIL's toes. Heather is right, it's totally your place and duty to inform as many people as possible. You might save a child. If you don't tell and something happens, you are gonna carry that one around a while. just sayin'. Pedos really fuck up family dynamics if you do the right thing.

I think you are right. I will try to pressure my SIL into telling her first. If I can't get her too I should.

Now that I really think about it his wives children don't have children yet but I imagine they will soon due to two of her sons just getting hitched. I would feel aweful if something happened to another child.

I didn't find out until my oldest child was almost 6. My husband didn't find out until I asked him about it and then he asked his mother and sister. When I asked his mother she denied it to me. However when he got them both together the truth came out. I only found out because my BIL's wife at the time said something about it when we went out one night.

So yes you are right. She does deserve to know. Then maybe she can finally understand why my SIL is the way she is towards them. She only see's them when we do a family holidays and that's because my BIL insist on him being around. Hell my BIL let's him babysit his son. His logic is his dad never touched the him or my husband.

It's just a hard place for me because I don't want to upset my SIL but at the same time you guys are right, it is the right thing to do. I'm suprised really that no-one in the family has told her yet. He married her shortly after my husband passed away.
