CLEARED BY DNA: Moms BF Tommy Braden Arrested For Raping Her 4yo Daughter

CREEK COUNTY, Okla. - A Sapulpa man is behind bars for allegedly raping the four-year-old daughter of his girlfriend.

Creek County deputies arrested 24-year-old Tommy Braden on Tuesday.

Residents tell 2News they're relieved that the alleged child rapist is in jail. They say they're keeping the little girl in their prayers.

"I couldn't sleep for the whole weekend. I just couldn't sleep. Not knowing who it was, or why it happened," said Rachael, a neighbor.

Neighbors down the street are still in shock.

"It was sickening. I cannot believe.. we've got too many kids around here for something like that to happen," Rachael said.

Deputies say Tommy Braden actually called 911 himself on Friday morning, telling police he thought someone had broken into the house and raped the little girl.

When deputies arrived at the Mobile Manor South trailer park near 161st and Hickory in Sapulpa, they found the child covered in blood from the waist down.

They also found the family dog stabbed and killed. Braden was the only other person there.

An ambulance took the child to the hospital. She's staying with family now, and deputies say she's doing okay.

But they say Braden's story didn't add up.

"Upon further investigation and everything, it became apparent to us that we didn't believe that the story was truthful," said Captain John Davis with the Creek County Sheriff's Office.

Deputies say Braden lives with the girl's mother, but is not her father. The couple has a two-year-old son together.

"Me and my wife just kind of cried, and thought, what if that was our kids," said resident Matthew Irby.

Residents say they're just glad a suspect is locked up.

"It's real sad you know. I'm glad he's gone, I'm glad he's off the streets," Irby said.

Braden will likely be charged with one count of child sexual abuse. It carries a maximum sentence of life in prison.

You know why he tried to make it look that way because he is a fucking idiot who didn't realize that raping a child would leave physical damage to her little lady parts (possible bleeding ect) and he needed a cover for his girlfriend as to why her child had been assulted. He knew her mom would find out and was scared of what would happen to him so he made up this story to cover his tracks. Fucking douche bag.

Well I do think it looks like him. The article says it's his GF but his FB says married but we all know people fudge on facebook all the time. It seems to fit though his pictures of the little girl are obviously old since she looks way younger than 4. They say posted a year ago but I would say she looks around 2 or younger in them. Then the baby is his son with the mother.

Back in the '70s my granny was addicted to police band radio. One night, about 10 a call came in that a taxi driver had found a 12 or 14-year-old girl at the bus stop in a mall parking lot. She'd been beaten and raped. The taxi driver was rushing her to the hospital.

The police caught the guy right away and when they were bringing him in radioed that the hallways to the holding area were to be cleared and they'd be bringing him in the back/side entrance.

We could only assume so there was no one to testify as to his physical condition when he arrived.

A Sapulpa man who was held in jail for 84 days before DNA evidence cleared him in the brutal rape of his then-girlfriend’s 4-year-old daughter plans to sue the Creek County Sheriff’s Office for wrongful arrest.

Tommy Braden’s attorney, Don Smolen, of Tulsa, sent notice earlier this month that they plan to take legal action for wrongful arrest and detention, which they allege was the result of the Sheriff’s Office negligence.

“From day one he’s begging them to do a DNA test,” Smolen said. “They said they weren’t going to do that because it was a waste of taxpayers’ dollars.”

Braden was arrested shortly after the April 6, 2012, rape and was not released until a defense attorney, Lowell Howe, got a judge to approve a DNA test which cleared him on July 3.

The DNA evidence was a match for Patrick Edward Misner, a convicted felon who lived in the same mobile home park at the time.

I thought so about the DNA, that should've been the #1 thing they collected.... But maybe they thought they had it in the bag from the beginning. We hear this same story from perps all the time. "someone broke in and kidnapped them" "someone broke in and killed them". I'm sure they thought he was guilty, as there was no sign of forced entry, and his "story" was supposedly not adding up. I would have assumed, like everyone else, that he's a lying sack of shit. Just goes to show you that things aren't always what they seem.

I'm not sure about suing, because if they found her covered in blood with only him home and they collected his DNA at the earliest possible time and were only awaiting results, then what did they do wrong? We all thought he did it based on what we read, imagine what the cops thought when they saw it. If they jerked him around and didn't send the samples in to be tested then by all means sue away.

They took DNA at the scene but they wouldn't test his DNA against it. They said it was a waste of taxpayers dollars and refused. The defense attny had to go before a judge and get him to agree that a DNA test was necessary. It took 3 months for that to happen.

I have a degree in forensic science, DNA tests from a rape kit are usually back within 2 days. Depending on the state. Oregon (the state this crime occured in) only has 1 crime lab and they use to get tests back very quickly. However a few years ago taxpayers voted against a tax increase which meant budgets were cut, the crime lab only has 1 tech working in it now so tests are taking longer, usually around a week. Some states have a huge back log.

the DNA test, which proved that Braden had not raped the girl.
