Jamail Wagner, 23, has been charged with injury to a child.
Houston police said Wagner was supposed to watch his girlfriend's son and daughter on April 3 until it was time to take him to a day care in the 6900 block of Almeda.
Detectives said the boy kicked the back of a seat when Wagner was taking him to day care. Wagner told the boy to stop and threatened to hit the boy if he did not, investigators said.
The boy kept kicking the seat, and Wagner stopped the car, police said. Wagner turned around and punched the boy in the arm multiple times, police said.
The boy began to cry, so Wagner dropped the girl off at the day care and took the boy home, investigators said. Once the boy stopped crying, Wagner took him to day care, officials said.
Police said the mother told them she got a call from the day care that the boy was vomiting and needed to be picked up. The mother called Wagner and asked him to pick up the boy. Wagner took the boy to see his mother, and she took him to Texas Children's Hospital.
Doctors said the boy has internal and external injuries, including kidney failure, bruising and red marks.
Investigators said the boy told them that Wagner had also punched him in the chest and stepped on his face

According to court documents, the 4-year-old boy told investigators that Jamail Wagner, his mother's live-in boyfriend, punched him in the arm and chest and stepped on his face on April 3. The boy says Wagner assaulted him by his day care, took him home, then returned him to day care.
The boy's mother told police that Wagner was watching the boy until it was time to take him to day care and that the boy was in Wagner's care the day of the assault. The mom says she received a call from day care that the boy was vomiting and had to be picked up.

Wagner says the boy was crying so he took him home first until he stopped crying, then he returned him to the day care, court documents show.
Police say Wagner picked the boy up from day care after the mom received the call about the boy's vomiting, then Wagner took him to his mom, who transported him to the hospital. Doctors who examined the boy say he had scratches and bruising to his face and red marks on his chest and arms. They say he was also suffering from kidney failure and severe abdominal injuries.

Court records show Wagner is out on bond for a drug charge, and he has prior convictions for assault of a family member, evading arrest, drugs, theft and trespass.
