    Ashli Heil drove wasted and killed her eight month old

    Blood tests show mom 3 times legal limit before crash that killed baby

    CUT AND SHOOT, Texas -
    Accident investigators revealed on Tuesday that a mother's blood alcohol content was three times the legal limit when her SUV crashed and killed her 8-month-old daughter, Local 2 Investigates reported.

    Department of Public Safety troopers said 28-year-old Ashli Heil was driving too fast on a sharp curve on F.M. 1484 in Cut and Shoot when her SUV skidded into a tree and severed a gas line around 6 p.m. Monday.

    The mother was flown to Memorial Hermann Hospital in the Texas Medical Center, where she faced questioning from crash investigators throughout the day Tuesday.

    Those investigators said the hospital blood tests showed a blood-alcohol content (BAC) of .28, while the legal limit for driving in Texas is .08.

    Investigators also said they were able to download data from the computer aboard Heil's SUV, and it showed the vehicle was speeding at 68 mph just before impact.

    State troopers said the child was strapped in a safety seat in the back seat area of the SUV, but it wasn't enough to shield her from such an intense impact.

    Sources close to the investigation told Local 2 Investigates that the mother told state troopers that she had just purchased "Mad Dog 20/20" alcoholic beverages just before the crash.

    Harris County District Court records show Heil has two previous run-ins with the law.

    In July 2004, Houston police arrested her for criminal mischief, leading to a guilty plea and a two-day jail sentence.

    In August 2007, she was arrested for possession with intent to deliver methamphetamine. Court records show she was caught with between 4 grams and 200 grams of meth, which was enough to warrant the drug dealing charge. She pleaded guilty and served four years of probation, which expired in August.

    Memorial Hermann Hospital listed Heil in good condition on Tuesday. Her injuries were described by accident investigators as non-life-threatening.

    I would say something vindictive like "I sure hope those non-life-threatening injuries all occurred to her face" but if she's a methhead she's probably already ruined it by 28.

    What the hell is it with all these women driving and killing their kids, driving them in the water or crashing them so they burn in a godawful fire? Do they just want the kids to die one of the worst ways there is..... slowly suffocating as you know the air just isn't going to be there for the next breath.

    I really hate people sometimes. The bitch had no business getting pregnant in the first place, much less giving birth and walking around like a drunk-ass time bomb waiting to go off and figure out some way to kill her baby. Someone needs to kill her, then rescusitate her and do it all again. SLOWLY and PAINFULLY.

    Stab Stab Stab!!! Stories like this make my blood boil. I have a 10 month old and yes she makes me want to drink. I however have common sense enough to never drink & drive. What a waste of a perfect little person.

    What a sweet looking baby girl, is it just me or does it look like she needs her shirt changed, it looks all wet around the front, she also looks sad but maybe she is tired, Im trying to be nice here.

    Thank you @koochie, Its been so long since i had a teething baby I had forgotten about it. This woman was given chances and didnt learn shit, now she has killed a precious innocent child, these are the kinds of people who wont learn so should be put somewhere where they can no longer be a danger to others because they never kill themselves it seems, its always an innocent person just going about their business...

    A Kingwood mother whose 8-month-old baby died in early April when she lost control of her vehicle while allegedly driving at an unsafe speed and struck a tree is being held in the Montgomery County Jail on a charge of felony murder.

    Ashli Nicole Heil, 28, is being held on a $250,000 bond, according to jail records. She was booked into the jail early Thursday evening.

    Heil faces five years to life in prison under the charge of felony murder, known as the “accidental murder” statute in Texas because it does not require the prosecution to prove that the defendant intended to cause death, according to information provided by Assistant District Attorney Warren Diepraam of the Montgomery County District attorney’s Office.

    The law requires the prosecution to prove that the defendant committed a felony and also committed a clearly dangerous act to human life during the commission of the felony.

    Heil is the first female charged with this particular statute in southeast Texas. Diepraam was the first prosecutor in Texas to successfully prosecute an offender under the statute; he and Assistant District Attorney Tyler Dunman will prosecute the case.

    The DA’s Office alleges that she committed driving while intoxicated with a child passenger, which is a state jail felony, and she operated her vehicle at an unsafe speed and failed to maintain control of her vehicle, causing it to leave the roadway and strike a tree.

    The arrest warrant affidavit against Ashli Heil states that Heil’s speed was about 65 mph seconds prior to the impact with the tree, based on data from the SUV’s critical data recorder. The posted speed limit for the stretch of highway where the accident occurred is 40 mph.

    Emergency medical personnel and other officials on scene noticed that Heil had a strong odor of an alcoholic beverage on her breath at the scene before she was transported to the hospital.

    One medic told Texas Department of Public Safety Trooper Robert Oelsner that Heil was “drunker than a skunk,” the affidavit states.

    Another DPS trooper made contact with Heil at the hospital as she arrived, and Heil told him that she had been drinking, according to the affidavit. She also showed other signs of intoxication such as slurred speech, inability to answer questions and red, bloodshot eyes.

    Heil was not arrested until Wednesday because, Diepraam said, she has undergone several surgeries and treatments for a broken spike she suffered in the crash, and she could not be booked into the jail until her medical condition improved so the jail could accept her without incurring significant costs for treatment.

    That poor baby!-- That crash looks like it was nothing short of an absolutely horrible and gruesome way to go, especially for such a little sweetheart! And all because mommy has no idea what self control is, or enough common sense to find another way home when she felt like getting "sloshed" with an 8 month old in her care!</3 There should be NO "accidental murder" law AT ALL regarding mother's who drive drunk or under the influence of something WITH THEIR GOD DAMN CHILDREN IN THE CAR.. it should be automatically implied whether causing death was the deliberate intention or not, some lingering intent of severely harming the child or worse HAD TO BE THERE SOMEWHERE the second she decided to make that judgement call with her child in the vehicle-- "Accidental murder" my *ss! BOO!!
    I will NEVER understand people who get themselves in these situations, and I sure as hell refuse to feel ANY sympathy for anyone other than the poor innocent baby that lost her life because of this fool! I'm 25 yrs old and in my entire life time (and yes before I had my children, I did most definitely go through a small "drinking phase" like most of the world does)-- but I always KNEW how dangerous driving drunk like that was, not only for myself but to anyone else on the road-- and truthfully the risk involved for mine and everyone else's out there's personal safety, let alone the possible damage that could be done to the vehicle, my insurance going up, and the possibility of possible jail time and a fine-- was more than ENOUGH for me to call someone for a ride, or if worse came to worse, WALK!!-- no matter how hammered and altered my judgement was. I cannot imagine ever thinking doing so WITH ONE OF MY CHILDREN IN THE CAR, would EVER be something I would even attempt. Seriously WTF! Go figure, her stupid *ss lives though, right?? So unfortunate.. </3

    The accidental death charge is a good thing. It means they have a greater chance of convicting her because the prosecution doesn't have to prove intent, if they did have to prove intent there would be a good chance the jury wouldn't convict her. It isn't a lighter sentence, she can still face life in prison.

    I deeply apologize for the dizziness lol like I just explained on another post when I'm typing on message forums and what not I don't take it all that seriously and I really don't try to go out of my way to put things into paragraphs or make things grammatically correct in the slightest, and I tend to swear like a trucker which doesn't help ((but I use *'s so it's all good right?? lol))-- but for future reference when you see the purple wall you can just skip over it and save yourself a headache haha.

    And I'm not stupid-- Although I'm sure I very easily come across that way. But I know that the law is a good thing and means a conviction. I know you'd be shocked, especially with my lazy typing skills on here-- but I actually have my associates degree in Criminal Justice and have done some paralegal work. I wasn't per say bashing the law or the conviction she'll be getting, just stating that I hate the fact they can even word it like that, ESPECIALLY when it's regarding something like this, where they can "say" it was an unintentional act when anyone who is stupid enough to drive inebriated with children in the car, in my eyes anyways, doesn't deserve to inadvertently ignore the fact that "it wasn't intentional"

Harris County Clerk records indicate Ashli Heil has had two prior run-ins with the law: a 2004 criminal mischief arrest followed by a guilty plea and two days in jail, then a 2007 arrest for possession of methamphetamine with intent to deliver, for which she got four years probation that ended in August. Baby Whilow was in a car seat at the time of the crash, but the impact was very severe and was to the rear passenger door where Whilow’s car seat was located.
    I just KNEW baby Whilow took the brunt of the accident. FUCKNHELL. WHY does it happen this way? the innocent one dies so horribly and the pos mother lives. Well at least she'll be living in a 8x10. If you can call that living.

    Then I'm very glad that Diepraam is on this case. Get her good, Diepraam. ''Accidental murder'' sounds like the perfect charge for this bitch. No intent needed, so she has less chance of wiggling out of it. I hope she gets life. And I hope her broken 'spike' pains her greatly the whole time.
