Steuben County, Indiana (Indiana’s NewsCenter) – The man wanted for failing to register as a sex offender is arrested in northwestern Steuben County Wednesday. His wife remains at large.

Ted Joe Benhower, 53, was taken into custody by the US Marshals Service at 2 pm, without incident. He was then taken to the Steuben County Jail and booked on one count of failure to register as a sex or violent offender, a class D felony. Benhower was being held without bond pending a court appearance.

Benhower’s wife Tricia Lyn Benhower is still wanted for class C felony failure to register as a sex or violent offender. A joint fugitive investigation between the Steuben County Sheriff’s Office and the US Marshals Service Northern District of Indiana is ongoing.

Tricia Benhower is a white female, 5’6” and weighs about 140-pounds. She has shoulder-length curly blonde hair, blue eyes and wears glasses.

I'm wondering what that means exactly.. did the engage in a sexual act and force a minor to watch them, or did a child accidentally walk in on them while they were getting their freak on. Also, why is she marked as a violent sex offender? I'm curious as to what the original story is, behind their both being convicted sex offenders.

Don't get me wrong, I'm not having sympathy for either of them, I'm just curious as to how they wound up in this predicament.

I feel for the child(ren) they've harmed.

She's not. The Indiana registry is classified for sexual OR violent offenders. She was actually sentenced to less time than he was, if I'm reading the record correctly.

I couldn't find info on the case but here's the Indiana code for the violation [35-42-4-5(c)]:

Vicarious sexual gratification; sexual conduct in presence of a minor
Sec. 5.
[...]
(c) A person eighteen (18) years of age or older who knowingly or intentionally:

(1) engages in sexual intercourse;
(2) engages in deviate sexual conduct; or

in the presence of a child less than fourteen (14) years of age with the intent to arouse or satisfy the sexual desires of the child or the older person commits performing sexual conduct in the presence of a minor, a Class D felony.

Ok. Thank you for clearing that up, @Dakota Valkyrie. I always wonder about stuff like that. I mean as a parent, my oldest has walked in on me and hubby a few times, unintentionally and of course it always kills the mood, but I just wonder if it's something that could be construed as illegal. It's not an issue now, as she is grown and doesn't live at home anymore.
