According to the criminal complaints, police responded to the home on Jan. 20 at 11 p.m. after
a relative of the mother contacted them and said she was concerned about the woman and the children. Police saw the children sleeping on a sofa through a window.
The children did not wake as police knocked on the door. Police eventually opened the unlocked door in an attempt to make sure the children were fine.
Police made contact with
a 7-year-old girl, and two boys, 12 and 1. The 1-year-old was directly under where the 12-year-old was sleeping on the three cushion couch. They all had numerous blankets on them, but
the home was not heated.
According to the criminal complaint,
the 1-year-old had been lying on a stick of butter and a half eaten apple. Police also saw
several broken eggs near a chair with the carton of eggs also nearby. Rotten food, garbage and cigarette butts were found all over the living room. Dirty dishes and rotting food were found in the kitchen and the kitchen table was covered in debris.
The 12-year-old had dried egg on his head. According to the criminal complaints, he told police that
Hillyer had put it there.
Blisters were found on the feet of the 1 year old.
Police searched for adults in the upstairs of the residence. They found additional food,
a deli bag of meat, in the hallway upstairs along with clothes and other items on the stairs.
Hillyer and the mother were found in a room underneath a blanket.
According to the criminal complaint,
police tried to communicate with the two, but were unable to do so because they were not able to comprehend anything nor cared about the questions being asked of them.
Beaver Dam EMS was called to transport the two to Beaver Dam Community Hospital for medical evaluation.
Police believed the two were under the influence of something other than alcohol.
The children were released to their fathers and they both took the children to BDCH to be evaluated.
Police contacted the children at the hospital. They saw
bruising on the 1-year-old's cheeks as well as additional blisters across his knuckles. According to the criminal complaint, officers were told by the 7-year-old that
‘god' (a name Hillyer called himself) had burned the 1-year-old and threw eggs at the 12-year-old. The girl also showed the officers a
scrape on her abdomen and told officers that she got it when
Hillyer threw her down stairs.
The girl told officers that she
had not eaten in a long time. According to the complaint, she told officers that Hillyer had
forced tobacco in her mouth and that she had spit it out on the floor. She told officers that she was also
burnt on her feet. The complaint says that the 12-year-old told officers
his mother did not protect them from Hillyer and they had not eaten for two days before police arrived.
