Passed-out LSU Fan Gets Teabagged By 'Bama Rivals In New Orleans Restaurant Window

Alabama TV Station Airs Teabagging Video That Features The Son Of The Station’s Sports Director

Mobile, Ala.'s WKRG opened its 10 p.m. newscast with the video of an Alabama fan teabagging an LSU fan at the Bourbon Street Krystal after the BCS title game. What WKRG failed to mention is that one of the stars of the video is none other than Patrick Setterstrom, a recent college grad and son of the station's sports director, Randy Patrick Setterstrom. Indeed, if you watch the video, it's Patrick Setterstrom who first attempts to pull out his package before girlfriend Ellen Cassin (who's conveniently wearing a jersey with her own name on it) stops him.

A number of tipsters identified the couple for us. We tried to contact Patrick Setterstrom and Ellen Cassin for their sides of the story, and because we get the sense they know the individual who eventually does assault the LSU fan. Both Patrick and Ellen deleted their Facebooks immediately after I contacted them. I've also gotten no response from emails or phone calls to WKRG's Randy Patrick Setterstrom, who during his own report later in last night's newscast made no mention of the video. We'd love to know his reaction to seeing his son in the shot—or if he even noticed.

If Patrick and Ellen somehow don't know the perpetrator, they have a ton of pictures of him and of the incident in general—you can see them posing for the photos in the video we posted on Sunday. Since the New Orleans police are investigating this case, those photos are probably of some importance right now.

The video itself was originally uploaded to YouTube by Reilly Terrell, proprietor of BamaSportsForum. He says in an email that he was simply passing by and saw what was happening through the Krystal window. He says he doesn't know any of the people who appear in the video.

If Alabama fans are truly as angry about this incident as the emails we've received from so many of them suggest, you'd figure one of them would know the teabagger's name. The tip line's open. Here's the most detailed tip we've gotten:

I met this guy at The Rusty Nail in New Orleans earlier that day. He said his name is Brian and he was from Pheonix [sic] City, Alabama. He's married and has a 3 month old baby….(which he decided to tell us rudely that he left at home so he could have more fun). He was completely intoxicated and rude the whole entire time, even to the Alabama fans.

Oh, and as for Chris Kelley, the troll who tried to take credit for the incident, congratulations to him. We tracked down his wife, her place of work, her phone number, and even called her boss. Chris Kelley sent us on a wild goose chase that included our informing his wife's boss that he had confessed to a sexual assault. Successful troll!

Russell County Sheriff Heath Taylor said today that his cousin Brian Downing has been identified as the Alabama fan allegedly videotaped placing his genitals on an unconscious LSU supporter in a New Orleans Krystal restaurant after the Jan. 9 college football championship.

Taylor confirmed Downing and Phenix City attorney Walt Gray came to the sheriff’s office in Phenix City about 2:15 p.m. today. While they were there, Taylor talked to New Orleans Police Detective Corey Lymous, who’s investigating the incident. Downing and Gray then left for Louisiana, Taylor said.

The video has gone viral and web searches for “Brian Downing” are widespread.

A New Orleans Police Department news release Wednesday reported the incident took place about 11:45 p.m. Jan. 9 in the New Orleans Krystal at 116 Bourbon St. The department’s sex crimes unit learned of it Jan. 17, from the video posted online. Under still photos from that video, the statement read in part: “The video displayed the above male suspect committing a sexual battery upon another male subject.”

Brian Downing, the University of Alabama fan who was booked with sexual battery late Thursday after being identified as the man who committed a lewd act on an unconscious LSU fan after the BCS championship game spent last night in the Orleans Parish jail. His bond was set at $10,000 by a magistrate this morning.

Downing was subsequently released from jail, according to online court records.

"It is a shock that it happened as an Alabama fan. It is a shocker that it is my family. It is out of character for Brian," Taylor said. "I would never in a million years have dreamed he would have done that, period. I assume, like everybody else does, it is not a Photoshopped picture of him."

Both Deadspin and Out Kick The Coverage reported that Downing worked at a Hibbett sporting goods store in Columbus, which is on the Alabama border.

A vice president with Hibbett Sports would not confirm that Downing worked for the company, but he said the company learned Wednesday that the person in the video was a company employee. By 5:00 p.m., Hibbett had made the decision to fire the man, said Scott Myers, vice president of loss prevention and human resources.

"We felt comfortable to terminate employment of the person in the video," Myers said. "We don't support or condone these activities and it is certainly nothing we are about."

Football is practically a religion down here; fans are passionate about their teams, but the worst I've ever seen is drive-by hollering. This wasn't the act of an exuberant 'Bama fan; it was a flat-out, and disgusting, assault by a drunken, immature asshole. He has embarrassed his whole state, and now people will think all 'Bama fans are ugly-natured people who can't handle a loss or a win. I've had to put up with 'Bama fans for years, the most we've ever done is send each other rude emails and make triumphant, drunken phone calls. Got one right after the game that said "9 to 6? how about 21 to zereaux! To which I replied, "roll Tide! around the bowl and down the hole, BITCH".

I mean it's one thing to get a couple of Sharpies and cover a passed out fan with purple and gold slogans,or to shave his head, but to put your schweddy balls on a guy....I dunno cause I don't have (literal) balls, but that would never occur to me. You have a point, any guy that teabags and claims domination over a guy who is passed out, is a latent homo and a coward. Normal men do not do this. If he tried to pull a faggy move like that when the guy is awake, he would likely get more than he bargained for. Lawyers for an Alabama man accused of committing sexual battery on an unconscious LSU fan after the BCS championship football game say it's mind-boggling that police and prosecutors would give substantial energy and attention to the matter.

Charging Brian Downing, 32, of Smiths Station, Ala., with sexual battery "demeans the real and serious trauma of actual victims of sexual violence," New Orleans attorneys Miles Swanson and Michael Kennedy said in a statement Thursday.

Swanson also said the idea that his client could be charged and face up to 10 years in jail if convicted is "also a little troubling."

"It just doesn't fit," Swanson said late Thursday of the situation.

The Orleans Parish District Attorney's Office has not brought charges in the case.

"As the District Attorney's office screens this matter, we hope that it will keep its priorities in line with addressing real crime in New Orleans," the attorneys said.

If that had been an 18 year old girl, NO ONE would be trying to play the "boys will be boys" card. Even thought the act would have been exactly the same. In fact, an underage drunk girl would have made it worse, but because it's a guy the drunk part is somehow a mitigating factor.

Excellent double standards, which one of these geniuses is willing to let this guy rub his nuts all over their face and have it posted on the internet for all the world to see. No fighting back now, remember, if you're a guy who's out cold drunk it's game on, if you're a girl, who's out cold drunk it's assault. A Louisiana State University football fan has filed a lawsuit against a University of Alabama fan and Chattanooga-based company Krystal after an incident earlier this year at one of the burger chain’s restaurants in the French Quarter.

The lawsuit alleges lewd acts by the Alabama fan and that Krystal employees ignored the situation.

Krystal spokesman Albert Waterhouse said company representatives have just become aware of the lawsuit but haven't seen it.

"As such, we are not prepared to comment on the allegations nor do we comment on pending litigation," he said.

After the incident, Waterhouse told Outkick the Coverage that Krystal leaders are "appalled" by the "despicable incident."

"Something like this has never before happened in our restaurants," he told Outkick. "According to the franchisee of this location, Big Easy Enterprises, one of their employees notified the manager as soon as they were aware of the incident … at which time they took action and dispersed the crowd."

The video does show a Krystal employee attempt to quiet the crowd, but the effort appears lackluster, and as soon as the employee walks away, the situation continues.

Downing doesn't bother to cover his genitals when the employee comes through.

A University of Alabama fan has pleaded guilty to two counts of obscenity for sexually taunting an unconscious LSU fan in New Orleans after this year's BCS national title game.

Prosecutors said a deal reached Tuesday before the scheduled trial for Brian H. Downing of Smith Station, Ala., calls for him to be sentenced to two years in jail.

State District Judge Karen Herman set sentencing for Nov. 29.

A video that went viral on the Internet appeared to show someone in a University of Alabama jacket performing a simulated sex act on an unconscious man at a Bourbon Street restaurant after the Crimson Tide beat LSU for the BCS football championship on Jan. 9.
