Next week it will be 100 days since Bellevue toddler Sky Metalwala disappeared, and his father is planning a vigil to mark the date.
Members of the community are invited to gather Sunday, February 18 at 5:30 p.m. at Bellevue Park, organized by lawyers for Sky's father, Solomon Metalwala. On February 14, it will be 100 days since the 2-year-old was last seen.
Sky went missing the morning of November 6 in Bellevue. At the time, his mother, Julia Biryukova said her car ran out of gas on the 2400 block of 112th Avenue Northeast. She said she left the toddler alone in the car in his carseat while she went for help.
Investigators later determined there was no mechanical problems with Biryukova's car, and that it drove a considerable distance without refueling.
Julia and Solomon were in the midst of a custody battle at the time of the disappearance. Solomon claimed he had not seen Sky or his daughter since December of 2010. Solomon's lawyer's claim the boy hasn't been seen since May, 2011.
Biryukova has refused to be interviewed by police.

I read that as she hadn't been questioned at all. Perhaps interviewed is not the same as being questioned. I know she can be silent, that much I know and can see she does well.

I believe they have tried to question her several times and she has refused to talk. When they interview someone it's basically questioning them down at the station and she is refusing to give an interview. It sucks there is nothing the police can do about that.

So unless shes going to voluntarily going to chit chat with them,

until they have something to hold her on they cant harrass her into talking
But dont worry I bet they are watching her every move and the minute she jaywalks or litters a candy wrapper they will swoop in and grab her for the legal 72 hour hold

Maybe this little girl will make it to adulthood, since it sounds like the court won't be making her have visitation with her crazy mother. This might be one the authorities get right! It's still early in the case, though.....

Missing Sky's dad 'hanging in there' for daughter

The attorney for Sky Metalwala's father says they want to make sure Julia Buryikova doesn't gain access to her daughter Maile, a possible witness to a crime involving missing Sky.
Maile must be dismissed as a witness by the police department before Biryokova can seek visitation to see her daughter. And according to Attorney Clay Terry, "She will not have visitation until it's approved by the child's therapist and the agencies involved."

As police continue their investigation, Solomon Metalwala and Terry have continued to pound the pavement. A few weeks ago they reached out to medical professionals on the Eastside to discover if either of the children had received medical care within the last year.

The answer was no.

If it's seemed like you've seen fewer headlines featuring Sky in the past couple of weeks, Terry said it's because they've been intentionally under the radar. "I think it's finally hitting [Solomon Metalwala,] that something happened to his son," Terry said. "But he's hanging in there because he's been there for Maile."

Terry says their search will be out again next week as they hold a vigil on Sunday, Feb. 18 at Bellevue Park, to mark 100 days since 2-year-old Sky was reported missing.

Four months after she reported that her little boy had vanished from his car seat, the mother of missing toddler Sky Metalwala once again failed to show up for a court hearing over custody of her children.

And now the judge in the case has set a March 30 deadline for Julia Biryukova to submit a parenting plan, or else the boy's father, Solomon Metalwala, will likely be granted full custody of Sky - if he's ever found - along with the boy's 5-year-old sister, Maile.

Now Metalwala says he is afraid that if his ex-wife sees or even talks to their daughter, Maile, it could set back any chance that the little girl will ever remember or feel safe enough to talk about what happened to her baby brother.

"The way that Julia had treated her, I think just her presence will do the trick," Metalwala said.

"Remember, our concern is that Maile is a witness in this case," added Metalwala's attorney, Clay Terry.

The boy's father also said he still believes little Sky is alive somewhere. He has said it's even possible that Sky actually vanished months before Biryukova reported him missing, and now he wonders whether the little boy's uncle took him to the Ukraine after a visit to Washington state in April 2011.

In the meantime, Terry said, he has confirmed that Biryukova is still living in the Puget Sound area - but he doesn't know exactly where.

I don't know if they will ever find this child. I just hope they keep that little girl far far away from her crazy mother. I know it's hard when they are so young but maybe one day the girl will be able to tell her father what she knows. It sounds like the kids were treated poorly and probably were abused. Poor kiddos.

They were going through a very nasty divorce. Accusations and court orders flying back and forth. Limited contact in the final months seems to be more of HER doing than his. I forget the details without rereading the whole thread... and if Sky WAS missing long before he was reported, it most definately is a reason she wouldn't be letting him visit/call.

Now that you mention it (I had seen this story in the news when he first was reporting missing so my memory is kind of foggy) I remember hearing the parents were in the middle of a nasty divorce. I would make sense that if he was missing longer it would be more the reason to keep him away. I wonder if the little girl (sister) was able to tell them how long it had been since she seen her brother.

If I remember right, the little girl originally said Sky was in the carr with them the morning he supposedly went missing. I don't think there has been any other news from the little girl. Although, I am not certain.

I'd really like to be more optimistic, but with the list of babies missing (...Aliayah, Lisa, Sky, Ayla....among more) getting longer by the minute, it seems, I honestly believe that it would take some kind of miracle for most of these babies to reappear again.

It's sad to think it, but the biggest household hazard for babies these days seems to be their own parents. I honestly don't see how someone can go about their normal lives when they have killed their own child, either intentionally or by accident.

Sky Metalwala's mom a no-show at custody hearing

The mother of missing Bellevue toddler Sky Metalwala did not show up Friday morning for a custody hearing regarding her older daughter.

A representative for Julia Biryukova's lawyer was present in court, but the juvenile dependency hearing involving Biryukova, Solomon Metalwala and 5-year-old Mailie was continued for March 30

Biryukova and Solomon Metalwala have been in the middle of a divorce and custody dispute since 2010. Friday's hearing was to finalize a custody arrangement that would place Mailie in Solomon's custody.
"Bottom line, she is not signing the parenting paperwork," said Clay Terry, Solomon Metawala's attorney.
In addition to custody, Metalwala does not want Biryukova to be allowed visits with Maile. He said Julia's presence would have influence on the 5-year old.

"She is a very smart little girl. She has seen a lot, and everything she does say, it goes right to the Bellevue Police Department," said Metalwala.

"This child is a witness and until she is no longer a witness, our concern is she should not have any outside influence. And the only other witness in this case is Julia. We don't want the two of them together," said Terry.

Two-year-old Sky went missing the morning of November 6, 2011. Biryukova told police she left Sky in his car seat that morning after her car malfunctioned and she went to seek help. After test drives, police later determined there was nothing wrong with the vehicle.

Terry said he does not know of Biryukova's whereabouts currently, however, he said police told him this week they know where she is.

Sunday marks the six-month anniversary of Sky Metalwala's disappearance.

The boy's father, Solomon Metalwala, is still holding on to hope that he's alive.

"He very strongly believes his son is alive. I think, to tell you the truth, it's keeping him going," Solomon's attorney, Clay Terry, told 97.3 KIRO FM's Ron and Don Show.

There will be a prayer service for Sky Sunday night (8- 9pm) at Heritage park in Kirkland.

Meanwhile, the Bellevue Police Department said Thursday that the Metalwala case is still a "very active open missing child case."

"We all hope for his safe return," Police Spokeswoman Carla Iafrate said via email.

Solomon Metalwala and Julia Biryukova have divorced and Solomon has full custody of Sky's 5-year-old sister, Mailie. Terry said Mailie is thriving in her new environment. She's in school, she's eating well, and counselors continue to work with her.

"We're hoping like Elizabeth Smart's younger sister...where they start to remember things and draw pictures. They're kind of hoping that this will happen with Mailie, but it has not happened yet," said Terry.

Terry said Biryukova has not fled the country and she remains in Redmond. Police have assured him that they can't find any evidence Sky was taken to the Ukraine.

“I think her story is a bunch of crap,” says Solomon. “I think the whole story about her running out of gas is a bunch of baloney.”

Metalwala says he now believes something happened to Sky before that day: November 6th, 2011. He and Julia were locked in bitter divorce and custody fight. He chose to canvass the neighborhood after his son’s disappearance. Julia has still not given a statement to police or made a public attempt to find her son.

“When a person hides, doesn’t do anything, lead to the question okay why isn’t this person doing what they are supposed to do?” Solomon adds “She is definitely hiding something.”

Metalwala’s attorney Clay Terry is more blunt. “I think Julia extinguished that child’s life.”

Terry says he believes, based on Julia’s erratic behavior just before, and after Sky’s disappearance, that she has something to do with it.

“I think this child passed from a lack of care,” Terry says, “More likely negligently than intentionally.”

“No mother would ever leave a child locked up in the seat, with the door open, and take one child and leave the other to get gas,” Terry adds, “Sky was not in the car, that was an absolute lie.”

Bellevue Police acknowledge that Julia admitted at one point leaving her children alone on more than occasion. She has otherwise been uncooperative. Police have not named a suspect, or made an arrest. The Bellevue Police Department has declined repeated requests for even a written statement on the status of the investigation.

Terry believes, in part, it’s because Julia and her extended family have not helped. “Not once have they ever lifted a finger to help us find this child. If that’s not an indication of wrongdoing,” says Terry, “The circumstances in its totality indicate something bad has happened.”

Solomon says he still remains hopeful that his story will have a happy ending. “I still believe he is alive. There is no evidence that he’s dead, and I’m a believer.”

Metalwala is planning a public vigil for his son, on Saturday, November 10th at 4pm at the Redmond Downtown Central Park, at 16119 Redmond Way.
