    Penn State puts child abuse scandal costs at $3.2M

    Penn State says it has spent $3.2 million on lawyers, consultants and public relations firms in response to child sex abuse allegations against a former assistant football coach arrested in early November.

    The university posted a breakdown of its related costs Monday as it unveiled a new website, part of an effort to provide more information to the public.

    Through December, the university had spent $2.5 million on crisis communications and an investigation led by an independent firm. It also reports spending $470,000 on university legal services and $210,000 for the legal defenses of a former vice president, a former president and an athletics director on leave.

    All I have to say is that all of the people involved have some culpability, right up to the DA who chose not to prosecute Sandusky in the first investigation. He alone could have saved probably countless kids. I am sure there are more out there who haven't come forward for whatever reason.

    Sandusky was the pervert child rapist. Paterno was his boss. Paterno's name is out there in front of everyone other than Sandusky probably just because of his name and his position. As the boss, yeah, he passed it on to HIS superiors, so to speak. But what then? If you know that Sandusky is still around, then you know that not enough has been done.

    You don't just take away a man's keys to the locker room or deny a man a promotion or whatever, then ask him to retire and actually expect to stop him from a lifetime of molesting boys. I'm just not giving Paterno a pass b/c of his mindset and/or age. Nothing makes child molestation something that can be overlooked. Those kids were failed all the way up from their so-called role-model mentor, Jerry Sandusky. No one is exempt.

    The state Legislature passed and sent the governor Thursday the 'Jerry Sandusky bill' requiring some higher education employees to report suspected child abuse or neglect to authorities.

    The legislation became known as the "Jerry Sandusky bill" after the former assistant coach at Penn State University who has been accused of molesting minors.
    In following the horrific media coverage of the Penn State University abuse scandal last fall, I knew right away we had to add higher education employees as mandatory reporters of child abuse or neglect,” said the bill’s sponsor, state Sen.Jeanne Kohl-Welles, D-Seattle.

    “There are an increasing number of children on our college campuses for sports, academic camps and child care programs. It is imperative we do all we can to ensure their protection. This bill does just that and will strengthen our ability to avoid a Penn State situation here in Washington,” she said.

    Kohl-Welles said the bill would make academic and athletic employees who are most likely to have contact with minors “mandatory reporters.” But not all employees would fall under the mandatory reporting requirements.

    “Not every school employee is a mandatory reporter (someone who must report an incident to either law enforcement or child protective services) nor would be all higher ed employees under the bill’s provisions. It is not assumed that every custodian, cafeteria worker and clerk has the practical knowledge to be a mandatory reporter,” she said.[...]

    Penn State's Board of Trustees on Monday defended its firing of legendary football coach Joe Paterno and the university's president, saying they showed a "failure of leadership" in not doing more after reports of child sexual abuse by former assistant coach Jerry Sandusky.

    A report released by the university's board on Monday said a graduate student told Paterno in 2002 about seeing Sandusky "fondling or doing something of a sexual nature" to a boy in showers on campus.

    Paterno told his supervisor, Athletic Director Tim Curley, but did not call police, the report said. The board said it learned the details of Paterno's actions in a grand jury report.

    "We determined that his decision to do his minimum legal duty and not to do more to follow up constituted a failure of leadership by Coach Paterno," the report said.

    The Penn State board said Spanier "failed to meet his leadership responsibilities" after learning of the 2002 incident. Spanier did not tell the board what he knew about the episode and also made statements to the media that were unauthorized or contradicted the board's instructions, it said.

    The board said it issued its explanations at the request of Penn State students, faculty and alumni.

    A lawyer for former Penn State assistant football coach Jerry Sandusky vowed to seek a dismissal of child sex abuse charges against his client after a judge on Tuesday refused to force prosecutors to provide more details on the allegations.

    Judge John Cleland rejected attorney Joe Amendola's request for more information such as exact dates of the purported molestations, details that Amendola said were crucial to building a defense against 52 counts of sexual abuse.

    Instead the judge in Pennsylvania's Centre County Court sided with prosecutors, who said they had already extracted as much information as possible from the accusers, described by prosecutor Joe McGettigan as "very troubled children" who were now adults.

    "If the victims were capable of providing detail ... we would have done so," McGettigan said.

    Several of the accusers allege in court documents the abuse occurred over several years, including one who said it began when he was 8 and lasted six years.

    "Any order directing the Commonwealth to supply details would be a futile act since the Commonwealth has explained it cannot supply the details requested," the judge wrote, using Commonwealth to refer to the state.

    In response, Amendola said he will seek a dismissal of the charges.

    Amendola told reporters on Monday he believed Sandusky's right to due process was being violated.

    More than a decade before former Penn State coach Jerry Sandusky was charged with more than 50 counts of child sex abuse, a psychologist warned university police that his actions fit that of a “likely pedophile’s pattern.”

    The finding by State College, Pa., psychologist Dr. Alycia A. Chambers, the therapist for one of Sandusky’s alleged victims, was contained in the internal Penn State files of a 1998 police investigation of the former coach for showering and bear hugging her client and another young boy in the school’s athletic locker room.

    NBC News has obtained the complete file on the investigation – the police report and assessments by two psychologists who interviewed the boys -- which provides new details about Sandusky’s behavior. It also could raise fresh questions about how school and local authorities handled his case.

    “There was very little doubt in my mind (Sandusky) … was a male predator, someone that was in the process of grooming a young man for abuse ,” said Chambers, speaking publicly for the first time, with the permission of her client’s family, in an interview with NBC News. “I thought…my report was strong enough to suggest that this was somebody who should be watched.”

    Chambers’ detailed report is potentially significant because it was the first clear warning about the former Penn State coach’s actions – nearly four years before a then-graduate assistant, Mike McQueary, reported to the late Coach Joe Paterno and other top school officials that he had found Sandusky in the Penn State showers one evening with another young boy, engaged in what he viewed as sexual contact. (Paterno testified last year he was unaware of the 1998 investigation and Gary Schultz, the former Penn State vice president who oversaw the school police, testified that he never reviewed the details of the case. A Penn State spokesman declined comment, citing pending investigations.)

    One of the investigators on the 1998 case, Jerry Lauro, then with the state Department of Public Welfare and now retired, told NBC News he was never shown a copy of Chambers’ report and was stunned to learn of its conclusions.

    “Wow!” he said when he was read Chambers’ conclusions by a NBC News correspondent. “This is the first I’ve heard of this. I had no idea . If I would have seen the report, I would certainly have done some things differently. Boy, this is a shock. “

    Chambers was the psychologist for a then-11- year-old boy, who had met Sandusky through his Second Mile charity for troubled children and was later invited by the defensive coordinator to several Penn State football games. The boy is now known as Victim 6—one of 10 allegedly molested by Sandusky and one of the key figures in the criminal case against him slated to go to trial this spring.

    Wow. Does this mean Penn State knew all along? When did Sandusky leave Penn State?

    He played defensive end for the Nittany Lions in the mid-60s and was a coach on Joe Paterno’s staff from 1969 until 1999.
    Sandusky retired in 1999, but was allowed to keep using the school’s facilities.
    Oh maybe I knew that. He retired after this 1998 or because of this 1998 investigation. So this being in the file, whoever decided to grant him access still to the facilities (condition of his retirement package?) should have to answer to something? Who is that person? A whole department of people? I don't think anyone at Penn State can say they had no idea or no knowledge at this stage now.

    At this point IMO,there is no way anyone can say Paterno didn't know that Sandusky had no business at Penn State. Yes he had his bosses but these were the sames bosses he basically told to f off when they suggested he retire a few years before this scandal broke.
    Paterno WAS the boss and cared more about his and the university's images than protecting children.

    New documents filed by the attorneys for former Penn State assistant coach Jerry Sandusky suggest there are at least 17 accusers in the child sexual abuse case, a much higher number than described in criminal charges.

    The requests, dated April 16 and April 23, were attached to a motion filed Thursday in which Sandusky defense attorney Joe Amendola asked the supervising judge to mandate more disclosure of investigative materials.

    The criminal charges against the former Penn State assistant football coach only pertain to boys named as Victims 1 through 10 in court records.

    The April 16 discovery request asked for information on "uncharged conduct evidence," while the one filed a week later pertained to employment records.

    The court filing did not name the people, explain what might make them accusers or indicate what role, if any, they play in the criminal case in which Sandusky has denied all allegations.

    "This in all likelihood means that there are other people who have come forward who have accused him of improper sexual conduct," said Wes Oliver, a Widener Law School professor who specializes in criminal law.

    A spokesman for the attorney general's office declined to comment, citing a gag order issued by the presiding judge.

    Lawyers for potential civil litigants have said there are accusers beyond the 10 alleged victims for which Sandusky, 68, faces 52 criminal charges. One alleged victim has filed a lawsuit in Philadelphia that is on hold while the criminal case proceeds.

    There are many possible reasons why prosecutors might not file charges based on the claims of a purported victim, from problems with the statute of limitations and questions about credibility to a strategic analysis about how much evidence to put before jurors.

    Information about any additional accusers for which Sandusky has not been charged could help the defense try to undermine the credibility of the prosecution's case, said University of Pittsburgh law professor John Burkoff, an expert on Pennsylvania criminal law procedure.

    "There may not be anything there, but who knows?" Burkoff said. "It's all a part of getting as much evidence as you can, to see what you've got."

    Oliver said there are theoretical scenarios under which the additional names could be either helpful or damaging to Sandusky's defense.

    "If the other eight people are kooks, that's actually a great story for the defense to put before the jury," Oliver said. "If, however, there are eight other alleged victims out there who the prosecution just can't corroborate but they've got pretty good stories, then that's really bad for the defense."

    A change in the timeline of the Jerry Sandusky case will likely lead to one of two charges being dismissed against two Penn State administrators, legal experts contend.

    The experts are weighing in after prosecutors said last week the infamous incident when Mike McQueary walked in on Sandusky in a campus shower with a boy happened in 2001, not 2002.

    The incident ultimately led to Joe Paterno’s firing and criminal charges being filed against Tim Curley and Gary Schultz, the former administrators now fighting criminal charges of perjury and failure to report suspected child abuse.

    Prosecutors charged Curley and Schultz with failing to properly report suspected child abuse, saying the charges met statute of limitations requirements because the alleged incident happened in March 2002.

    Now that prosecutors have amended the date of the shower incident to February 2001, attorneys for Curley and Schultz said the case should be dismissed.

    “Based on the prosecution’s own pleading, the statute of limitations is 10 years from the event,” Tom Farrell, Schultz’s lawyer, said in a statement Friday.

    The state Attorney General’s Office declined comment on whether the date change means the charge will be dismissed.

    Jules Epstein, an associate law professor at Widener University and an expert in criminal law, said statutes of limitation are absolute.

    “Once they expire, a charge cannot be revived, even if the legislature later changes (expands) the time period,” Epstein told the Centre Daily Times on Saturday.

    The failure-to-report charges, classified as summary offenses, carry up to 90 days in jail and a $200 fine.

    A&E IndieFilms says it's partnering with Asylum Entertainment to produce "Happy Valley," a look at former Penn State assistant football coach Jerry Sandusky, who faces 52 criminal counts for alleged abuse of 10 boys over 15 years. Sanudsky says he's innocent.

    Amir Bar-Lev will direct the film. He was also behind "The Tillman Story."

    John Koch, president of Asylum, is a native of State College who once worked as a camp counselor for The Second Mile, the charity that Sandusky founded.

    Koch says the film will tell the story of the whole town of State College, as well as the investigation.

    Production is scheduled to start this month.

    BELLEFONTE, Pa. (AP) - A judge on Wednesday denied a request from former Penn State assistant coach Jerry Sandusky to delay the June 5 start of his child sex-abuse trial.

    Judge John Cleland, saying no trial date is perfect but that "some dates are better than others," said he would not give defense attorney Joe Amendola more time to prepare his defense.

    Cleland said starting jury selection on Tuesday would, on balance, protect Sandusky's right to a fair trial, the alleged victims' rights to their day in court, the state's obligation to prosecute promptly and the public's expectation of a swift proceeding.

    Surprise guest shows up at Sandusky's trial



    An Internet-born character called "Pedobear," which mocks pedophiles or is their mascot, depending on which website you believe, is at the Centre County courthouse this morning, outside the Jerry Sandusky sex abuse trial.

    Judge throws out three of the 51 charges
    The judge overseeing Jerry Sandusky's child sex abuse trial has thrown out three of the 51 charges in the case, leaving the former Penn State assistant football coach facing 48 counts.

    Judge John Cleland has dismissed two counts of involuntary deviant sexual intercourse related to the alleged sexual abuse of an accuser known as Victim 4. Cleland says the charges did not bear out what testimony revealed.

    In his ruling, released this morning, Cleland says he would have been required to set aside any convictions on those counts, because "the verdict was not supported by the evidence."

    He also dismissed a count that he says was the same as another charge.

    Cleland also ruled against a defense motion to dismiss five counts related to a boy who was allegedly seen with Sandusky by a janitor.

    Closing arguments are set for this morning in the trial of Sandusky, a longtime Paterno assistant accused of sexually abusing boys he met through a youth charity he founded.

    Uh oh! Sandusky's adopted son says he's also a victim
    Jerry Sandusky's sex abuse trial ended today with an emotional plea from the prosecutor to convict the former Penn State football coach and then a bombshell revelation that his adopted son had told prosecutors he was willing to testify against Sandusky.

    The jury of seven women and five men were sequestered this afternoon to begin deliberating Sandusky's guilty or innocence on 48 charges of sex absue.

    While they met behind closed doors, Matt Sandusky -- who had defended the man who adopted him throughout the investigation -- issued a statement saying that he had been prepared to tell the jury that he had been sexually abused too.

    "Matt Sandusky, one of Jerry Sandusky's adopted children, asked us to confirm with you... that he was prepared to testify truthfully as a Commonwealth witness," said the statement issued by lawyers Andrew Shubin and Justine Andronici.

    "During the trial, Matt Sandusky contacted us and requested our advice and assistance in arranging a meeting with prosecutors to disclose for the first time in this case that he is a victim of Jerry Sandusky's abuse. At Matt's request, we immediately arranged a meeting between him and the prosecutors and investigators," the statement said.

    "This has been an extremely painful experience for Matt... There will be no further comment at this time," the lawyers said.

    The only comfort I get from this case is the fact it helped shine a light on sexual abuse in children and put this fucker away forever.
    It really doesn't seem far that given his age,he won't rot in prison for long.
    But for the time that he's there,I hope every minute of it is filled with pain and misery.

    We've already seen several cases where victims of other abusers have come forwad after hearing the coverage of this case. Hopefully that will continue. There is hope.



    At least one child advocate says she thinks some good can come out of the conviction. Teresa Huizar, executive director of the National Children's Alliance, based in Washington, said this might encourage young male victims in general to speak out — and prompt proper responses by institutions.
