    Former Penn State Defensive Coordinator Charged with Sexual Abuse

    (CNN) -- A former Penn State assistant football coach has been charged with sexual child abuse and two current university officials face charges of covering it up, Pennsylvania Attorney General Linda Kelly said Saturday.

    A grand jury brought down the indictment against Jerry Sandusky, 67, former defensive coordinator for the Penn State Nittany Lions. He had retired from coaching in 1999 and was founder of a charitable organization for young people.

    Also named in the indictment are Penn State Athletic Director Timothy Curley, 57, and Gary Schultz, 62, who is the university's senior vice president for finance and business.

    "This is a case about a sexual predator who used his position within the university and community to repeatedly prey on young boys," Kelly said. "It is also a case about high-ranking university officials who allegedly failed to report the sexual assault of a young boy after the information was brought to their attention, and later made false statements to a grand jury that was investigating a series of assaults on young boys."

    Sandusky, who was released Saturday on $100,000 unsecured bail, faces seven counts of involuntary deviate sexual intercourse, and a litany of other counts including aggravated indecent assault and endangering the welfare of a child.

    "He's maintained his innocence," Sandusky's attorney, Joseph Amendola, told CNN Johnstown affiliate WJAC.

    A preliminary hearing is scheduled for Wednesday, but Amendola said he expects it be postponed in order for attorneys to have enough time to bring in witnesses.

    Sandusky has known about the allegations for three years, the lawyer said.

    "Jerry feels like because of his background and reputation it took a long time to reach this conclusion and he's been ready for it," Amendola told WJAC.

    The two university officials are charged with one count of perjury each, and are expected to surrender themselves Monday.

    Penn State President Graham Spanier said in a statement that the allegations against the former coach are "troubling," and that the investigation is appropriate.

    With regards to Curley and Schultz, Spanier said they have his "unconditional support."

    "I have complete confidence in how they have handled the allegations about a former University employee," he said, adding that the charges are "groundless."

    The investigation was initiated by the claims of one boy who alleged that Sandusky had "indecently assaulted" him and engaged in sex acts while the boy was a guest at his home, according to the attorney general.

    The victim met Sandusky through the former coach's Second Mile charity, Kelly said. Sandusky allegedly used expensive gifts such as trips to professional and college games, golf clubs, a computer and money, Kelly said.

    The relationship continued with overnight stays at Sandusky's home, where touching led to sexual acts, Kelly said.

    "One of the most compelling and disturbing pieces of testimony in this investigation came from an eyewitness to a late-night sexual assault that allegedly occurred in March of 2002, in the locker room of the Lasch Football Building on the University Park Campus," Kelly said. "Hearing what sounded like sexual activity in the showers of a building that was supposed to be empty, a graduate assistant reportedly observed Sandusky sexually assaulting a naked boy who appeared to be about 10 years old."

    The assistant reported the incident to head football coach Joe Paterno, who in turn alerted athletic director Curley, Kelly said.

    Instead of reporting the incident to authorities, Curley and Schultz banned Sandusky from having children from Second Mile visit the football building, Kelly said.

    In all, the grand jury identified eight young men who were the targets of similar sexual advances or assaults by Sandusky between 1994 and 2009. All of the victims first encountered Sandusky through Second Mile activities, Kelly said.

    Authorities said they are continuing to search for additional victims and that the case remains active.

    Former Penn State Football Defensive Coordinator Arrested For Child Molestation


    Former defensive coordinator Gerald "Jerry" Sandusky, 67, of State College, where Penn State is located, faces an array of charges. They include seven counts of first-degree involuntary deviate sexual intercourse, all of which are punishable by up to 20 years in prison and a $25,000 fine, according to Pennsylvania State Attorney General Linda Kelly.

    "This is a case about a sexual predator who used his position within the university and community to repeatedly prey on young boys," Kelly said.
    Sandusky, who coached for 23 years and was once considered a likely successor to Paterno, was also charged with aggravated indecent assault, eight counts of corruption of minors, four counts of unlawful contact with a minor stemming from a selection of the children Sandusky targeted from 1994 to 2009.
    One of the victims, a boy who was roughly 11-years-old when he met Sandusky in 2005 or 2006, testified that Sandusky performed oral sex on him more than 20 times through early 2008, and forced the victim to perform oral sex on him, the full report from the grand jury said.

    Sandusky, 67, was arrested Saturday and released on $100,000 bail after being arraigned on 40 criminal counts. Curley, 57, and Schultz, 62, were expected to turn themselves in on Monday in Harrisburg.

    The school said Sunday that it would bar Sandusky from campus.

    It's only a matter of time before Paterno steps down. He's fucking old anyway. They are portraying him as having done the right thing as reporting this to his "higher ups". I call bullshit on that convenient washing of his hands. It may have been legally correct but it ethically/morally sucks. His 40+ years as a coach is toilet paper when I wonder what else a blind eye is being applied to.

    STATE COLLEGE, Pa. -- Just hours after stepping down, two high-ranking Penn State administrators face arraignment Monday on charges they lied to a grand jury investigating former defense coordinator Jerry Sandusky and failed to properly report suspected child abuse, a case that has left fans reeling.

    Late Sunday, after an emergency meeting of the Board of Trustees, university President Graham Spanier announced that Athletic Director Tim Curley and Gary Schultz, the school's senior vice president for business and finance, would be leaving their posts.
    Curley requested to be placed on administrative leave so he could devote time to his defense, and Schultz will be going back into retirement, Spanier said. Both men have maintained they are innocent of any wrongdoing in connection with the probe into whether Sandusky sexually abused eight boys over a 15-year period.
    State Attorney General Linda Kelly and state police Commissioner Frank Noonan are expected to hold a 1 p.m. news conference about the case Monday a few miles from the Harrisburg district court. The arraignment is scheduled for immediately after that.

    Sandusky was arrested Saturday on charges that he preyed on boys he met through The Second Mile, a charity he founded for at-risk youths

    The charity said in a statement Sunday that Sandusky has had no involvement with The Second Mile programs involving children since 2008, when Sandusky told the foundation that he was being investigated on child-sex allegations.
    The case has rocked State College, a campus town routinely ranked among America's best places to live and nicknamed Happy Valley. Under head football coach Joe Paterno -- who testified before the grand jury and isn't considered a suspect - the teams were revered both for winning games, including two national championships, and largely steering clear of trouble.
    In a statement issued Sunday, Paterno said the charges were "shocking."
    "The fact that someone we thought we knew might have harmed young people to this extent is deeply troubling," he said. "If this is true we were all fooled, along with scores of professionals trained in such things, and we grieve for the victims and their families. They are in our prayers."

    Sandusky, whose defenses were usually anchored by tough-guy linebackers, spent three decades at the school. The charges against him cover the period from 1994 to 2009.
    Sandusky retired in 1999 but continued to use the school's facilities, but university officials said Sunday they were moving to ban him from campus in the wake of the charges.
    Nils Frederiksen, a spokesman for the state attorney general's office, told The Associated Press on Sunday that whether Paterno might testify was premature and nothing more than rampant speculation.
    "That's putting the cart way ahead of the horse," he said. "We're certainly not going to be discussing the lineup of potential witnesses."

    The allegations against Sandusky, who started The Second Mile in 1977, range from sexual advances to touching to oral and anal sex. The young men testified before a state grand jury that they were in their early teens when some of the abuse occurred; there is evidence even younger children may have been victimized.
    Sandusky's attorney Joe Amendola said his client has been aware of the accusations for about three years and has maintained his innocence.
    "He's shaky, as you can expect," Amendola told WJAC-TV. "Being 67 years old, never having faced criminal charges in his life and having the distinguished career that he's had, these are very serious allegations."
    Sandusky is charged with multiple counts of involuntary deviate sexual intercourse, corruption of minors, endangering the welfare of a child, indecent assault and unlawful contact with a minor, as well as single counts of aggravated indecent assault and attempted indecent assault.
    The first case to come to light was a boy who met Sandusky when he was 11 or 12, and physical contact began during his overnight stays at Sandusky's house, the grand jury said. Eventually, the boy's mother reported the sexual assault allegations to his high school, and Sandusky was banned from the child's school district in Clinton County. That triggered the state investigation that culminated in charges Saturday.
    But the report also alleges much earlier instances of abuse and details failed efforts to stop it by some who became aware of what was happening.
    Another child, known only as a boy about 11 to 13, was seen by a janitor pinned against a wall while Sandusky performed oral sex on him in fall 2000, the grand jury said.
    And in 2002, Kelly said, a graduate assistant saw Sandusky sexually assault a naked boy, estimated to be about 10 years old, in a team locker room shower. The grad student and his father reported what he saw to Paterno, who immediately told Curley, prosecutors said.
    Curley and Schultz met with the graduate assistant about a week and a half after the attack was reported, Kelly said.
    "Despite a powerful eyewitness statement about the sexual assault of a child, this incident was not reported to any law enforcement or child protective agency, as required by Pennsylvania law," Kelly said.
    There's no indication that anyone at school attempted to find the boy or follow up with the witness, she said.
    As a summary offense, failure to report suspected child abuse carries up to three months in jail and a $200 fine.
    Sandusky was arrested Saturday and charged with 40 criminal counts.
    Curley denied that the assistant had reported anything of a sexual nature, calling it "merely `horsing around,"' the grand jury report said. But he also testified that he barred Sandusky from bringing children onto campus and that he advised Spanier of the matter.
    The grand jury said Curley was lying, Kelly said, adding that it also deemed portions of Schultz's testimony not to be credible.
    Schultz told the jurors he also knew of a 1998 investigation involving sexually inappropriate behavior by Sandusky with a boy in the showers the football team used.
    But despite his job overseeing campus police, he never reported the 2002 allegations to any authorities, "never sought or received a police report on the 1998 incident and never attempted to learn the identity of the child in the shower in 2002," the jurors wrote. "No one from the university did so."

    This is soooo sickening! These bastards... my heart goes out to these kids who were looking for some sort of mentor and were giving these vile bastards! ugh! and for so many to make such allegations so "light", by the time they are done they will probably find a whole pedophile ring running in that charitable institution... how sad... they could have helped so many...

    Football coach Joe Paterno and other Penn State officials didn't do enough to try to stop suspected sexual abuse of children at the hands of a former assistant football coach, the state police commissioner said Monday.

    Paterno may have fulfilled his legal requirement to report suspected abuse by former assistant football coach Jerry Sandusky, state police Commissioner Frank Noonan said, ``but somebody has to question about what I would consider the moral requirements for a human being that knows of sexual things that are taking place with a child.''

    He added: ``I think you have the moral responsibility, anyone. Not whether you're a football coach or a university president or the guy sweeping the building. I think you have a moral responsibility to call us.''

    Paterno, who recently became the coach with the most wins in Division I football history, wasn't charged and the grand jury report didn't appear to implicate him in wrongdoing. He has called the criminal charges shocking and troubling.

    ``If this is true we were all fooled, along with scores of professionals trained in such things, and we grieve for the victims and their families,'' he said in a statement Sunday.

    Pennsylvania Attorney General Linda Kelly said Paterno is not a target of the investigation into how the school handled the accusations. But she refused to say the same for university President Graham Spanier.

    ``All I can say is again, I'm limited to what's contained in the presentment, and that this is an ongoing investigation,'' Kelly said.

    Noonan said the case went beyond football and the university.

    ``It is a case about children who have had their innocence stolen from them, in a culture that did nothing to stop it or prevent it from happening to others,'' he said.

    Also Monday, two Penn State officials surrendered on charges that they failed to alert police to complaints that Sandusky had sexually abused eight boys. They are also charged with lying to a state grand jury investigating the former defensive coordinator.

    Kelly and Noonan encouraged anyone who would accuse Sandusky of sexual assault to step forward and talk to police, with Kelly specifically asking that a child reportedly assaulted by Sandusky in view of a graduate student in 2002 to call detectives.

    When asked if it was possible that there were more victims, she said: ``When you look at the totality of the circumstances and the number of victims that we have, I don't think it would be beyond the realm of possibility that there are other victims that exist here.''

    The grand jury report that lays out the accusations against the three men cites the state's Child Protective Services Law, which requires immediate reporting by doctors, nurses, school administrators, teachers, day care workers, police and others.

    It appears neither Schultz nor Curley had direct contact with the boys Sandusky is accused of abusing.
    Schultz's lawyer said his client was not among those required by law to report suspected abuse. He also argued that the two-year statute of limitations on the summary offense has expired.

    Spanier, Penn State's president, called the allegations ``troubling'' but predicted the school officials would be exonerated.

    Unfortunately for Paterno, the story is tawdry and nauseating, but really not that complicated. On March 1, 2002, Jerry Sandusky, a former player and coach for Paterno, was in the shower in the Penn State locker room committing unspeakable acts on a boy believed to be about 10. A graduate assistant walked in and witnessed the attack. While he didn’t stop Sandusky right there and then, the grad assistant did go to Paterno the next day and tell him what he saw.

    There are two kinds of sports fans this morning: Those who are sickened and outraged by the callous, selfish way Paterno handled the news that his former right-hand man and friend — a guy he coached and worked with for 32 years — was believed to be a rapist and a predator who used the football facility as a place to corner his young victims.

    And those who haven’t yet read the 23-page report from the grand jury.

    But that’s the thing with those pedophiles: They just don’t listen. In the fall of 2000, a janitor caught Sandusky — where else? — in the shower at the football facility. He had the boy pinned against the wall and was forcing himself orally on the victim. The janitor told a fellow employee and his supervisor, but no one did anything about it.

    So the janitors knew what this monster was up to. The campus police knew. A bleeping grad assistant knew! But Joe Pa, who had known and worked intimately with Sandusky for more than three decades? No clue. Old Joe would like us to believe he was out of the loop in Happy Valley.

    The nonprofit agency at the center of the Penn State University child sex abuse scandal had warning signs of questionable conduct by its founder, longtime football defensive coordinator Jerry Sandusky, a full decade before it acted to ban him from contact with children it served.

    The Second Mile, a program for at-risk youth, said in a statement that it immediately acted in 2008 to ban Mr. Sandusky from programs involving children when he told them he was under investigation for sexual contact with a juvenile but had denied any wrongdoing.

    However, the organization knew as early as 1998 that Mr. Sandusky was under investigation for similar sexual misconduct in a Penn State shower involving a different boy from the program, according to a presentment by a statewide investigating grand jury.

    Mr. Sandusky started the program in 1977 to help troubled boys, but it provided him with access to hundreds of vulnerable youths, at least eight of whom he is accused of sexually assaulting over a 15-year period, the presentment said.

    State College attorney Wendell V. Courtney was apprised of the investigation in 1998 because he was then-counsel for Penn State and for The Second Mile, a position he still holds. He was unavailable for comment Monday.

    That investigation, by University Police, was closed when the Centre County district attorney's office decided not to file charges.

    The Second Mile learned of another investigation involving Mr. Sandusky in 2002. In its statement, the agency said its chief executive officer, Jack Raykovitz, testified at the investigating grand jury that he had been told by Penn State athletic director Tim Curley that an internal investigation had found no corroboration for an allegation of inappropriate contact by Mr. Sandusky with a youth in a university locker room.

    Despite those two allegations, it wasn't until November 2008 that the program took steps to keep Mr. Sandusky away from children. It was then, according to the organization's statement, that "Mr. Sandusky informed The Second Mile that he had learned he was being investigated as a result of allegations made against him by an adolescent male in Clinton County, Pa. Although he maintained there was no truth to the claims, we are an organization committed first and foremost to the safety and well-being of the children we serve.

    "Consistent with that commitment and with The Second Mile policy, we immediately made the decision to separate him from all of our program activities involving children. Thus, from 2008 to present, Mr. Sandusky has had no involvement with Second Mile programs involving children."

    The presentment said all eight victims whom Mr. Sandusky is accused of sexually assaulting were involved with The Second Mile, but the organization noted in its statement that "to our knowledge, all the alleged incidents occurred outside of our programs and events."

    While coaching at Penn State in 1977, Mr. Sandusky started The Second Mile in State College as a group foster home for troubled boys. In its first year, it served 45 youths. Today, the organization said, it serves 100,000 children annually across the state with nine prevention, early-intervention and community-based programs and services.

    Typically, children and families are referred to The Second Mile by school counselors and other youth service professionals.

    In its annual IRS filings, The Second Mile says its mission is to "provide opportunities for young people" and "support parents and professionals addressing the needs of youth." In the 2010 tax year, the 501(c)(3) reported $9.45 million in total assets, according to tax returns filed this January.

    The organization relies solely on private contributions from individuals, corporations, foundations and special events. Last tax year, it listed revenue of $2.1 million. Among its fundraising activities are auctions, golf tournaments, sports banquets and large prize drawings.

    Its board of directors, as of the 2011 filing, included state Sen. Jake Corman, R-Centre; Penn State alumnus and board chairman Bob Poole, president and CEO of S&A Homes and Poole Anderson Construction; Louie Sheetz, executive vice president of marketing at Sheetz Inc; and nearly three dozen more.

    The charity, in 2010, reported having seven full-time employees. Two of them took home in excess of $100,000 from the organization: Mr. Raykovitz, who is the CEO and president, and his wife, executive vice president Katherine Genovese.

    The last time Mr. Sandusky appears to have derived any income from the foundation was in 2007, when he was paid $57,000 for "consulting" services provided to The Second Mile.

    Who in the fuck walks in on a child being raped, and just turns around and walks out? I can't say that I've ever been in that situation but if I were I'm pretty confident I wouldn't walk away and let the guy finish.

    I can't think of any logical reason someone would have for not intervening.

    That's part of why this whole thing stinks. EVERYONE turned a blind eye.

    And even if we could magically figure out a damned good excuse for why he didn't step in at that moment, how do you reconcile that the "graduate assistant" continued there and saw the asshat on campus a regular basis? All the way up to LAST WEEK.

    He was obviously NOT being held accountable in ANY way, shape or form... and there is NO way that all these adults didn't know it.

    All I keep hearing about is how Joe Paterno did what he was supposed to tell in telling the AD and that was it. BULLcrap is all I can say to that.
    How about being a fucking human being and call the police? How about checking up on the victim?
    I'm sorry, I don't care how many wins he has..when push came to shove, he showed he cared more about winning than doing what was right.

    Well, can't say I'm surprised with the reaction here. For the record, if Sandusky is convicted on all counts, he could face up to 90 years in prison, $150,000+ in fines, and lifetime registration as a sex offender.

    Here's one thing we should all remember: Not ONE player on this team had anything to do with this. They've played their hearts out and now this, this revelation that some of the men they viewed as leaders failed them, and who-knows-how-many children. This all happened before any of them even started at PSU. Please don't start to root against them or anything like that- unless you already do

    Normally, I don't care what happens in the Big Ten (I'm a Florida State fan, BTW), but for this week I'm rooting for these kids. I can only hope that this makes them stronger- if so, Nebraska is in for a WORLD of hurt.

    From what I've seen, in addition to those charged, Paterno and Spanier are getting most of the heat. Few folks have anything but compassion for the team itself. I'm sure the players are just as shocked/surprised/pissed as anyone. Anyone holding them to ridicule for it is an idiot.

    My son-in-law is Penn State all the way (PA born & raised, so not his fault). I am anti-Penn State just to razz him. But nothing serious or anything to do with this travesty.

    I would be just as upset with responsible members ANY organization that has seemingly condoned this shit by turning a blatant blind eye. It transcends any bias that sports teams engender.

    None of my anger is directed towards the players or former players that have come out to defend him. I am sure they are more shocked then anyone. More to the point, they have become engulfed in a scandel they have nothing to do with.
    But as more and more stuff comes out,the more and more Paterno looks like a liar.
    ALl those life lessons and speeches he gave...didn't apply when it came to protecting those who needed it the most.

    On Tuesday, four days after 40 counts of sexual abuse of children were filed against former Penn State assistant football coach Jerry Sandusky, those in charge finally mentioned the alleged victims.

    At his State College house, surrounded by hundreds of students and fans chanting his name, head football coach Joe Paterno said this.

    "The kids who are the victims, …. I think we ought to all say a prayer for them. It's tough in life when people do certain things to you."

    Later that night, as university officials left the campus' Old Main administrative building without comment, Penn State's Board of Trustees issued a statement saying it is "outraged by the horrifying details contained in the Grand Jury Report."

    "As parents, alumni and members of the Penn State Community, our hearts go out to all of those impacted by these terrible events, especially the tragedies involving children and their families. We cannot begin to express the combination of sorrow and anger that we feel about the allegations surrounding Jerry Sandusky. We hear those of you who feel betrayed and we want to assure all of you that the Board will take swift, decisive action."

    Some university employees were left asking, 'What took so long?'

    In interviews and conversations with employees who work on campus, a view has emerged beyond the charges or the future of the football program. They're also asking, what will happen to the university? Students asked the same thing: loudly, en masse and often from different points of view.

    Several hundred turned out at Paterno's house around 6 p.m., chanting the coach's name and drawing him outside twice. "It's hard for me to tell you how much this means to me," he said.

    The masses then moved to campus, where a conference-call meeting of the board drew their attention. Outside Old Main, students delivered various messges: rage at Sandusky, support for Paterno, dismay at Paterno and a desire to the stadium chant when the football makes a big play. They called for Univeristy President to come outside, to speak and to resign. They played "Sweet Caroline," a mainstay song at Beaver Stadium on gamedays.

    The groups then flowed downtown to the area of Beaver Avenue known as "Beaver Canyon," where police wearing riot gear met an unruly but largely obedient crowd. They returned to Old Main, with louder cheers and louder chants.

    Some university employees mixed in with the crowd. Around Old Main, a sense of dread pervades. Many have not heard from Spanier, either, perhaps signaling his departure. They were confused that Spanier's only statement on the matter voiced "unconditional support" for athletic director Tim Curley (now on administrative leave) and Gary Schultz, former interim senior vice president for finance and business, who stepped down. Both have been charged with perjury and failure to report the suspected abuse.

    As part of its "swift, decisive action," Penn State's board has announced that it will convene a task force to review the university's procedures "related to the protection of children."     Penn State University President Graham Spanier will either resign or be voted out by the end of today, a source close to the board of trustees told The Express-Times.

    An interim president, most likely Executive Vice President and Provost Rodney A. Erickson, will be appointed and a nationwide search for a permanent replacement will begin, according to the source who requested anonymity.

    Spanier was made aware in 2002 that a graduate assistant coach had seen former assistant coach Jerry Sandusky allegedly sexually assault a young boy in a shower in the Penn State locker room, according to grand jury testimony. Spanier did not involve police, according to testimony. Spanier has not been charged, but there have been many calls for his resignation.

    Sandusky has been charged with 40 counts of sexually abusing children.

    Two university administrators -- athletic director Tim Curley and Vice President Gary Schultz -- face charges related to a cover-up. Spanier, who was named president in 1995, in recent days has shown his support for the administrators.

    Head coach Joe Paterno, the winningest coach in Division I history, announced this morning he will retire at the end of the season.

He saw a naked boy … whose age he estimated to be ten years old, with his hands up against the wall, being subjected to anal intercourse by a naked Sandusky.”
