An Oceano man was arrested on suspicion of raping a 17-year-old after a night of drinking and drugs at his home, according to court records.
Ivan Amador Valdez, 28, out of custody on $45,000 bail, is charged with felony rape of an unconscious person, according to court documents.
The unidentified girl was visiting from Fresno with her family when she and a friend left Nipomo with Valdez and two other people around 8:30 p. m. April 25, according to court documents.
Valdez drove them to the backyard of his Oceano home, where he parked the truck they were in. The teenager said she was impaired after drinking alcohol and using marijuana provided by Valdez, according to court documents.
She remembers sitting on the tailgate of the truck, then sleeping in the bed of the truck and waking up in the rear seat, documents say.
After passing out, she remembers waking up to hear two people arguing outside the truck and noticed her pants were unbuttoned, her underwear was wrapped around one leg and she felt pain in her groin, according to court documents.
A witness at the house said he remembered helping her from the bed of the pickup to the backseat of Valdez’s truck. When the witness checked on the teenager later, he said, she was unconscious or asleep and Valdez was sitting next to her.
Valdez told the man, “Get outta here or I’ll kick your (expletive),” according to court documents.
The witness said he shut the door and sat on the tailgate, then saw Valdez’s head bobbing up and down and felt the truck rocking back and forth.
About 15 minutes later Valdez got out of the truck, appeared to be buttoning up his pants and said, “Don’t tell anyone about this or I’ll kick your (expletive),” according to court documents. A search of local criminal
records shows Valdez has convictions dating back to 2001 for having unlawful sexual intercourse with a minor under age 16, contributing to the delinquency of a minor, domestic abuse and violating a protective order.
He pleaded not guilty to the felony rape charge May 19 and is scheduled to return to court June 11 for a pretrial hearing, according to court documents.
A call to his attorney Friday was not immediately returned.
