    MARTINSVILLE, Ind. (WISH) - Police say a young Morgan County boy died Thursday night after he was shot in the head earlier in the evening.

    The Morgan County Sheriff's Department told 24-Hour News 8's Phil Sanchez the 6-year-old and his 11-year-old stepbrother were home alone when the younger boy was shot. They believe the shooting may have been accidental, and they are still trying to determine which boy actually pulled the trigger. The 6-year-old was flown to Riley Hospital in Indianapolis, where he later died.

    The incident happened southwest of Martinsville, near Liberty Church Road and Ind. 37, police said.

    "The oldest son was outside, and he told me what happened. He was hysterical, like a normal 11-year-old whose seen something - he was freaking out," a neighbor, Diana Watson, told 24-Hour News 8.

    "It's very sad that we're here today," Sonnega said at the news conference, "but that's part of our justice system."

    The 11-year-old is being held at the Johnson County Detention Center. A hearing has been set for July 6. Sonnega said it is possible the boy may be charged as an adult.

    11 Yr. Old Boy Accused Of Killing 6 Yr. Old Brother

    MARTINSVILLE — An Indiana prosecutor said Friday he was charging an 11-year-old boy with murder in the shooting death of his 6-year-old brother.

    Emergency crews rushed to the home near Martinsville after the 11-year-old called 911 for help Thursday. They found 6-year-old Andrew Frye shot in the head with a .22-caliber gun. He was taken by helicopter to an Indianapolis hospital, where he died. A sheriff’s officer said no adults were home when the shooting occurred.

    Morgan County Prosecutor Steve Sonnega said investigators initially thought the shooting was an accident.

    “Upon further reflection, and detective work, forensics work, we sometimes end up with evidence different from what we expect,” Sonnega said during a late afternoon news conference.

    He said the boy would be charged as a juvenile with murder and criminal recklessness. However, the case could eventually end up in adult court, as Indiana law allows anyone over age 10 to be tried as an adult.

    Sonnega declined to discuss details of the shooting, citing strict privacy rules in juvenile court.

    He said the judge had sealed court documents and ordered him and police to respect strict confidentiality. A juvenile court hearing was scheduled for Wednesday.

    Sonnega wouldn’t say where investigators believe the boy got the gun or whether his parents might face charges.

    Neighbors said the 11-year-old told them he found his brother shot in the bathroom.

    Im out on this one! Don't know if a 10 year old has the full capacity to know what they are doing!! i have a 7 year old nearly 8 and she still doesn't understand the consequences of her actions. Don't know if two years would make a big difference in maturity? i think if the parents had the gun in an unsafe place then they should be charged as well. Got to think why the hell the kid got this angry to do it in the first place.

    I had a friend when I was about 10 and he was a major spoiled rotten brat and one day when his parents weren't home him and his little brother decided to play with the guns in the house, his little brother was 5. Needless to say the 5 year old got shot in the head. And what started off with a messed up boy became a really really messed up adult. From the rescue workers that I have talked to that were first on scene, my friend had tried to fix his little brother by putting bandaids on him and towels and putting his brain back in his skull. It seriously did some mental damage to him. Later on he done some other really bad things and is in jail now.

    I had a friend I sat next to in 8th grade. He had a really cool sense of humor and we laughed and got in trouble in one class all the time. He went home on a Friday to get ready for a hunting trip with his father and older brother, who was a senior. I never saw my friend again.

    He and his brother were playing around with a rifle before their father, who was a highway patrol officer, got home. They both thought the gun was unloaded. The brother pointed it at my friend and pulled the trigger. He laughed when my friend fell, thinking he was joking around. He swears he never even heard the gun go off. My friend had been shot in the chest and died before the EMTs got there. It was horrible.

    The brother was in shock for a long time and even though he was in school he absolutely never spoke a word for months. I don't know if it was because his father was a cop or what, but there didn't seem to be much of an investigation and the brother was never charged.

    If this boy deliberately shot his brother, out of anger or whatever, there's something seriously wrong with him and he needs some kind of help. At 11, I'm not sure he really is aware of all the consequences of what he's done. I don't think he should get "get away with it" but I'm thinking maybe charging him with murder might not be the way to go either. Terrible situation. I would really hate to be the parents in this story.

    So the 11 yo is being charged with murder. Appears this was not just an accident playing with guns.
    We don't know what the home life is there but we do know a gun was left insecure for a child to get his hands on it...AND based on the murder charge perhaps the child playacted what he has seen in the home...and adult pulling a gun out to make a point in anger?

    Makes me sick thinking that these children were left alone in a home with a loaded, available gun, (i don't *think* I'd leave my 11yo to supervise his little brother....depends on maturity). It could be the 11yo was ticked off at the 6 yo for something really dumb, like over a toy/video game or not shutting up over something....pulls the gun on him scaring him, not intending to shot him, but off it goes.

    Sonnega said no charges have been filed against the child's parents, but they could be pending.
    I want to see the parents held responsible for their part in this. I did not read whether the child loaded the gun himself or the gun was found loaded....did he know it was loaded? I would think based on the murder charges the child knew the gun was loaded or loaded it and knowingly pointed the gun on his brother. Did he mean to shoot him? thinking yes. Did this child ever hav a gun pulled on him by a angry parent? gotta wonder what went on in that home. Also curious if this child has a history of violent behavior and/or anger issues.
    No two ways about it, the parents are responsible for the weapon in the home and making it available.

    Mom and Boyfriend arrested

    The mother of a 6-year-old boy who was fatally shot by his 11-year-old brother should be held responsible, Morgan County authorities say, because she left the children at home with access to an unsecured rifle.

    Amanda Vandagrifft, 28, was arrested Wednesday on four felony neglect charges. Her most serious charge, a Class A felony count of neglect resulting in death, which carries a penalty of 20 to 50 years in prison, stems from the shooting.

    The other neglect charges were filed because she had endangered her children at other times, prosecutors said.

    Her boyfriend, Matthew Boulden, 29, has been charged with three counts of neglect, a Class D felony.

    Morgan County Prosecutor Steve Sonnega said Vandagrifft should have taken steps to secure the .22-caliber rifle used in the June 30 shooting at Vandagrifft's home south of Martinsville. The weapon was propped against her bedroom wall with ammunition, investigators said.

    Sonnega also said Vandagrifft should have heeded warnings that her 11-year-old might become violent with his siblings.

    Boulden's charges stem from incidents before the shooting.

    On the day of the 6-year-old's death, Vandagrifft had gone with Boulden on a vehicle-towing job. She left the 11-year-old and 6-year-old at home alone, according to the court documents.

    The 11-year-old boy used the gun to try to scare the 6-year-old into cleaning his room. He fired a shot at close range into the 6-year-old's forehead, between his eyes, the documents say.

    At first, the 11-year-old told police that the 6-year-old shot himself, but police determined that was impossible because of the nature of the wound. The 11-year-old later told police he pulled the trigger.

    Vandagrifft and Boulden had stored the rifle and ammunition between a wall and a desk in Vandagrifft's bedroom, the documents say. They thought it wasn't visible there. They had tied the belt from a robe around the handles of the double-doors that led to the bedroom, but Vandagrifft told police that was to keep the dog out of the room, not the children, according to the court documents.

    They previously stored the rifle above kitchen cabinets and had noticed that someone had tampered with it.

The girl said she was so afraid the 11-year-old would shoot Andrew that she "stepped in between the two of them and said, 'If you are going to kill him you are going to have to kill me too.'"

    According to the probable cause affidavit, the older boy threatened his younger brother and sister with knives and guns on multiple occasions.

    This child was threatening the younger siblings regularly. Seems the two fucktards were letting this kid discipline and bully them around.....I can't tell you how much that pushes a button for me, my older sister was left to do the same to me and my younger brother. Parents who refuse to do the parenting 'cause their selfish and useless.
    I feel for all the children here including the 11 yo who did this horrid deed. ALL of them were failed. The 11 yo is a product of the fruckery in that home, I hope these two get hit hard with the law, this shit is not acceptable!
    I think the 11yo was using the gun as a threat as was used on him. Learned by example, taking out his rage out on his own siblings. That's what my brother started doing to us, his own sisters the shit he learned from dad. What a fucking mess of home.

    A 12-year-old boy charged with murder didn't know a rifle was loaded when he pulled the trigger and shot his younger brother in the head, he told investigators in a videotaped interview played Tuesday in court.

    In two other videotapes, the boy, who was 11 at the time of the shooting, said 6-year-old Andrew Frye shot himself June 30 at their home near Martinsville. He changed his story when questioned a third time after an autopsy showed no powder burns and that Andrew's arms were too short to shoot himself in the head.

    Lawyers began presenting evidence before a Morgan County judge who will determine whether the boy is guilty of murder and reckless homicide charges in the June 30 shooting. The boy, who has a different last name than his brother, is being tried as a juvenile but still could face several years in detention if he's convicted.

    In the third videotaped interview, with his mother and stepfather present, he said he loaded the rifle the day of the shooting but ejected bullets from its magazine, not realizing one round was still chambered. He then confronted the younger boy over a chore.

    "I said, 'Clean up your room.' He said, 'No,'" the boy said. He said he then pointed the gun and shot Andrew.

    Andrew was shot from 3 to 6 feet away, an autopsy determined.

    Also during the third interview, the first in which he was considered a suspect and not merely a witness to a suicide, the boy acknowledged he had threatened Andrew and a sister with loaded weapons in the past, telling them at the time, "I am going to kill you."

    The boy was escorted out of the courtroom during the playing of the first two videotaped interviews, in which he was emotional and sometimes cried. He remained present for the third, peering over defense attorney John Boren's shoulder at a transcript.

    Earlier, the boys' former stepfather testified he trained the older boy how to handle guns safely, but not specifically on the 22-caliber bolt-action rifle used in the shooting.

    Randy Vandagrifft testified he began taking the boy hunting after he turned 9, teaching him gun safety skills like making sure the safety was on and that a weapon didn't remain loaded.

    "I tried to drill that into him," Vandagrifft said.

    However, on Boren's cross-examination, Vandagrifft said he couldn't remember if he trained the boy on how to shoot the bolt-action rifle used on June 30 and never had a chance to teach him how to handle the weapon safely before separating from the boys' mother..

    Morgan County prosecutor Steve Sonnega said after the hearing ended that he was trying to prove the boy acted recklessly with the rifle because he had a stronger case on the lesser charge and believed he could establish that because of the boy's gun training.

    "He had a functional understanding that it wasn't a toy. It was a deadly weapon," Sonnega said.

    Boren in his opening statement didn't dispute that his client fired the deadly shot but insisted that he didn't mean to hurt his younger brother. He said he would have a gun safety expert testify about how difficult it is for adults to know for certain whether a gun is loaded, much less a child

    A judge on Friday acquitted a 12-year-old Indiana boy of murdering his 6-year-old brother, but he convicted him of a lesser juvenile charge of reckless homicide.

    Morgan Superior Court Judge Christopher Burnham determined that the evidence did not show that the older boy intended to kill his younger brother, Andrew Frye, when he pointed a gun at him and pulled the trigger June 30 at their Martinsville home.

    The older brother, who has a different last name than Andrew's, was 11 years old at the time of the shooting and was charged as a juvenile because he was deemed too immature to be tried as an adult.

    A sentencing date for the reckless homicide conviction had not been set Friday. Until he is sentenced, the boy will be held in a juvenile detention facility and must undergo a psychiatric and behavioral evaluation so that probation officials can determine what punishment he should face.

    Burnham can choose from a wide range of penalties geared for rehabilitation, including probation, special programs and juvenile detention. The boy could face detention until age 18 and remain on probation until he is 21.

    Prosecutor Steve Sonnega argued that the boy's actions after the shooting implied guilt. He also said the boy had enough hunting experience with his stepfathers to understand how the gun worked.

    Sonnega said the boy's sister told police the youth had used a gun before to threaten his siblings into doing their chores. She told investigators the other children had kept kitchen knives in their rooms for self-defense.

    But defense attorney John Boren said Andrew's death was clearly unintentional and that anyone, even a trained adult, could make a mistake and believe a gun wasn't loaded. Several witnesses testified that they had known the 12-year-old as a polite child and a good influence on other children, though he occasionally sulked and acted out when he didn't get his own way.

    Good. The kids said that he had a habit of threatening others with the gun to get them to do chores. Loaded or not she knew what he was doing and it isn't right. Maybe he didn't realize the gun was loaded but someone neglected to slap some sense into him, ie, his mom. You don't ever point a weapon at someone unless you plan on killing them dead. My Dad taught me that at age 2.

    Has anyone ever known a child to go into the juvenile system and not come out more fucked up than they were when they went in? IMO currently, its just a school to raise criminals run by the state... I dont think this kid was born evil, he was left with too much responsibility, made to watch his younger brother and sister for it seems like I saw overnight trips, told to get the house clean, feed the kids and that he was responsible for it, so in these days of TV movies and video games glorifying violence, parents teaching him about guns I can kind of understand his thinking when he did this, doesnt mean I think his thinking is right but he was a kid left with doing an adults job and yes, the parents should be the ones charged, this boy may not have been born evil but he will come out of the satan spawning juvenile prison system evil and will never be able to lead a good life...     There is a portion that shows the juvenile system, they are locked in box type cages for school, kind of like a taller dog kennel and we are told they get a good education but the education is that they are dogs and deserve to be locked up, so this is what they learn. This little boy actually needs counseling and help to deal with this, he wont get it though and will come out a very productive member of criminal society...

I dont think this kid was born evil, he was left with too much responsibility, made to watch his younger brother and sister for it seems like I saw overnight trips, told to get the house clean, feed the kids and that he was responsible for it, so in these days of TV movies and video games glorifying violence, parents teaching him about guns I can kind of understand his thinking when he did this, doesnt mean I think his thinking is right but he was a kid left with doing an adults job and yes, the parents should be the ones charged, this boy may not have been born evil but he will come out of the satan spawning juvenile prison system evil and will never be able to lead a good life...     There is a portion that shows the juvenile system, they are locked in box type cages for school, kind of like a taller dog kennel and we are told they get a good education but the education is that they are dogs and deserve to be locked up, so this is what they learn. This little boy actually needs counseling and help to deal with this, he wont get it though and will come out a very productive member of criminal society...
    I know 4 from the same family that ALL did time In juvenile detention centres (many times each)
    2 grew up to social workers,1 is a prison guard in Alberta,1 is a border guard in Alberta

    My moms best friend was "married to the mafia" basically her hubby was in deep and the kids were always in trouble
    He went to prison(had to have a complete new face built from a beating in there)
    As soon as she had the nerve to divorce while he was in there the kids were in completely diff surroundings (she moved them) and they all stood a chance after that
    Skipped school for the first time when I was in grade 1 with the one,hitch hiked at age 7 with the other one
    we all grew up to be normal healthy adults
    Thats one thing I have noticed is there are no Juvenile Detention Centres here,they were all in the one in Sudbury Ontario havent ever seen or heard of any here in all the years Ive lived here

    So yeah kids that get into trouble dont always keep it up,,Look at Judge Greg Mathis(from across from me) jail and juvie non stop for years until he promised his mom on her death bed he would smarten up look at him now a cop first then a judge

    It can go both ways. You can be more fucked up, or just happy to come out of there and never want to go again. The education is NOT good. It's just going through the motions and everyone gets an A. If you aren't in your cell, you are eating one of your three meals or playing spades. And the access of adults from the opposite sex to you naked is a concern IMO since many of the kids are victims of sexual abuse. Juvie jail could be better, for sure.

    Boy sentenced to group home for brother's death
    MARTINSVILLE, Ind. (WISH) - The 12-year-old who was convicted in the shooting death of his brother has been ordered to live at the Children’s Bureau.

    The Morgan County prosecutor’s office tells 24-Hour News 8 the children’s home was the most appropriate place to send the juvenile.

    You know this story pisses me off to no end. These useless mother fuckers that had no damn sense or just didn't quite care about the kids caused1 kid's death and the placement of the other. IMO the 12 year old is the only one that lucked out. He gets to be away from these winners.
