MARIETTA, Ga. - Police in Cobb County said Friday evening that a 16-year-old boy accused of murdering his younger brother is in custody. They say U.S. Marshals took Oscar Mondragon into custody, and police were questioning him on Friday night about what happened.
Earlier in the day, authorities had said they were concerned Oscar Mondragon might not surrender peacefully. Police believe he is responsible for the murder of his 12-year-old brother, Javier.
Just after 9 p.m. Thursday night, police say they were called to the Eastside Mobile Home Park in Marietta after they got a 911 call. The caller told police a shooting had taken place in one of the mobile homes. When police arrived, they say they found the body of the 12-year-old boy inside.
Police considered Oscar to be armed and dangerous on Friday. They said they they had secured arrest warrants on felony murder, aggravated assault, and possession of a firearm by a minor.
Neighbors say they saw Oscar and his two younger brothers playing with guns outside the family home before the accident on Thursday night. Oscar’s sister says the shooting was accidental, and that the boys were playing around when it happened.
According to the teen’s sister, he didn’t know there was a bullet in the gun, and he was afraid to come home because of the manhunt.

Police say Oscar made statements in the past indicating he wouldn't go peacefully into police custody. They also say he fled with the gun that killed his brother, and they were concerned he might turn it on an officer.
