6 Year Old Plays Doctor With 5 Year Old - Gets Charged With Sexual Assault

Grant County authorities have accused a 6-year-old boy of first-degree sexual assault of a child for allegedly playing “doctor” with a 5-year-old girl in September.
The case, which is plowing new legal ground in Wisconsin, calls into question when a child’s act can be considered criminal — particularly when it involves behavior some experts say is normal for children that age — and who makes that determination.
Under state law, the boy is too young to be charged with a crime or in a juvenile delinquency petition, the equivalent of a criminal complaint for juveniles. Instead, prosecutors have included the allegations in a petition seeking protection or services for the boy. Such petitions are typically used by parents or authorities to identify children under 10 who need services to change inappropriate behavior.
If a judge finds the boy committed a delinquent act, the court can order that he and his family receive services such as counseling or other treatment.
A second petition accusing the boy of disorderly conduct alleges that last summer he repeatedly grabbed the breasts of two teenage baby sitters, took off his clothes and rubbed himself on their legs and tried to kiss them.
The boy’s lawyer, Stephen Eisenberg of Madison, called the allegations “crazy” and said he has never heard of a 6-year-old being accused of first-degree sexual assault. The boy is now 7.

According to the petition for protection or services filed Nov. 12, the girl’s mother found her daughter in the boy’s yard “with her skirt and underpants around her ankles” and the boy sitting underneath her, penetrating her with his finger. The petition alleges the boy “did have sexual intercourse with a child under the age of 12.”
State law defines sexual intercourse, in part, as “intrusion, however slight, of any part of a person’s body.”
The girl told her mother they were playing “butt doctor” and told authorities the boy only touched her on the outside of her body, court documents state. A third child, a 5-year-old boy, also was with them, but he did not touch her inappropriately, the girl said.
Judge Leineweber refused to dismiss the petitions, saying the relevant part of the sexual assault allegation is the mother’s observations.
The boy needed only to have penetrated the girl and known she was under a certain age, he wrote, adding, “Even the most immature 6-year-old could appreciate these two concepts.”

There had to be something messed up that happened to this boy. Could he have been molested? When I was 14 I lived in a foster home. My next door neighbors had a 7 year old girl. While we were waiting out at the bus stop she would tell my foster brothers and me that she "knew how to suck a dick good" and that she liked having sex. We all thought she maybe walked in on her mom and dad one day...she described everything like she was an old pro at pleasuring men. Well one day I guess the nurses at school reported whst she.was saying, and come to find out, her father was molesting her. This boy knows way too much for his age. He had to be shown or taught these things. No 7 year old child is a pervert.

He needs therapy

This little boy learned this from someone, and he should not be in legal trouble. He is too young to understand the repercussions of his actions. Who molested him, and why are they not being charged.

Come on now. Did everyone forget what it was like to be a kid that age? I recall seeing a boy's penis in 1st grade with that whole "I will show you mine if you show me yours". Stupid kid showed me his and I didn't have to do jack shit but say ewwww afterwards.

Now this kid saw this shit, cause this is not the same as my situation. Mine was actually innocent, this kid seems to have witnessed something sexual.

Well not the finger thing. That is not normal behavior. They are mostly curious to see one another not actually perform sexual acts.

I have never said this to anyone so here goes... When my now 17 year old son & my now 14 year old daughter were 4 & 6, my hubby caught them in the restroom, my daughters undies down to her knees, and my son doing God knows what. They never did anything other than stand there like idiots. My husband was pretty much freaked out and hysterical and calls me at work to tell me what he just witnessed.

I get in my car race home to talk to my kids. I found out that my older nephews, 14 & 16 told my sons that boys have to have sex with girls. So my son went and got the only girl around, his sister. Curiosity is always there but you learn the signs of innocent playing and something far more serious.

Not only are children naturally curious but children need to be taught about personal space and respecting others private space.

This 6 yo seems more than curious (imo), probably has engaged in sexual activity that someone coached him on or has been allowed to watch and is "playing" it out.
That he's being charged with 1st degree sexual assault is ludicrous...seriously, are these adults making these decisions? he needs therapy no doubt, not criminal charges against him.

In most states they have group homes specifically dealing with victims of sexual abuse. He should be placed in one of these and an investigation needs to be conducted on his family and any adult he has regular unsupervised contact with

This is crazy bringing a six year old up on these sort of charges! There is no way in hell this child new how to do this naturally. He saw this and is mimicking the behavior.

When I was little I played "doctor" in a fort behind my house with other kids, I was a naturally curious kid. No one had touched me inappropriately (at that point) and my mother was pretty much June Cleaver and never showed any type of sexual behavior in front of us kids. We didn't even have a tv in our house but I remember walking through the living room at my neighbors house and seeing a scene on tv of a man simulating oral sex on a woman. I dragged my friends older brother out to our fort and told him to try it on me. I quickly bored of it and left but I certainly didn't grow up to be a sex offender.

It pisses me off when people assume just because a kid is showing signs of sexual behavior then he/she must have been abused. I don't know many people who weren't curious at that age and a lot of the time it doesn't have to be a result of sexual abuse. Boys parts are different than girls parts...it's natural to wonder how the opposite sex works.

As for charging this boy with anything is fucking obsurd. When we got caught at that age my mom spanked my ass and told me not to do it again...it was effective.

I felt up a girl at school when I was that age and didnt know it was bad and had no idea what I was doing. Just curious. I never saw that behaviour and didnt know anything about sex.
I didnt actually penetrate her I dont think, but it always makes for good conversation at the class reunion. I wonder if her husband knows.

@malq feeling up a girl is one thing. I remember being curious at that age as well but the penetration with the fingers is a little out of the norm. I personally don't thnk that falls into the catagory of normal curiousity at that age.

Sexual experimentation at that age is as natural as breathing, and if a kid stumbles across a hole, they may try to stick something in there. Just because it didn't happen to you, or you didn't do it to someone else doesn't mean it's abnormal.

This whole thing is a ridiculous waste of the court's time and resources.

LMAO...You didn't grow up in Ohio by chance? I was telling a friend about this story and he told me about showing a girl his thingy and she didn't show hers. She then went and told his little sister. LOL he said he cried or almost cried, scared his sister would tell on him. He said she was cool though and didn't squeal.

The parents of a 6-year-old boy who faced charges of first-degree sexual assault have sued Grant County officials who investigated and filed the juvenile petition. The charges came after a 5-year-old girl's mother suspected that play had gone too far.
The lawsuit, filed in federal court in Madison, contends that officials violated the civil rights of the boy and his parents, and seeks damages and an injunction against Grant County District Attorney Lisa Riniker. The suit also names a sheriff's deputy and social worker as defendants. None of them could be reached for comment late Thursday.
The plaintiffs are identified only as D, who is now 7, and his parents as Jennifer and Kurt D.
According to the lawsuit, in the fall of last year the boy was playing with the girl and her 5-year-old brother when the mother arrived. The children said they had been playing doctor. Their mother told investigators she suspected D had put his finger in the girl's anus.
The lawsuit states that prior to the play date, D had medical conditions that required rectal examinations.
Riniker wound up accusing D of first-degree sexual assault, as part of a juvenile court petition for protective services filed last November.
In the spring, according to a report in the Wisconsin State Journal, which was granted access to the juvenile records, a judge declined to dismiss the petitions, which a criminal attorney for the boy called "crazy." The report stated that the girl said that D had only touched the outside of her buttocks.
The boy's parents said they provided evidence their son did not act out with other children and had gotten appropriate services. The girl's parents told the paper that they tried to work things out privately but that D's parents did not provide that opportunity.
The new federal lawsuit contends the whole investigation was biased because the girl's father is a "well-known political figure in Grant County," and her aunt a regional social services supervisor. It claims now-retired Grant County Sheriff's Sgt. James Kopp "waged a relentless campaign to discredit and embarrass and humiliate 6-year-old D," and that the entire process was unreasonable and unconscionable.
More recently, Riniker has tried to coerce D's parents into signing a consent decree by implying she will seek to remove the couple's children from their custody, the suit says.
The plaintiffs contend the guardian appointed in the case thinks they are fit parents.
The lawsuit says the boy, who had ADHD, now also suffers from anxiety, depression, vomiting, crying and lack of sleep because of the investigation and prosecution.

Ugh. The girl's parents sound like assholes, especially after learning that the boy had a medical condition that required rectal exams. They tried to work things out in private? What the fuck is there to work out?!? You sit the kids down and explain why that's not appropriate behavior and you move on.

I hope D's parents win. Families have to be shielded from this type of insanity.

What exactly are the parents of this little girl trying to achieve by this stupid, stupid lawsuit? What if the boy's parents want to sue the shit of out the girl's parents for bringing on such anxiety and anguish to their child? This is ludicrous, and the fact the courts are entertaining this shit makes it all the worse.
