    SCOTLAND — A Scotland man was charged Wednesday with killing his infant son.
    Chris A. Miller, 37, was initially charged with felony child abuse and aggravated assault of a child younger than 3 years of age for a Friday incident in Scotland, but when the infant died Wednesday afternoon, Miller was charged with alternate counts of first-degree murder, second-degree murder and manslaughter in the first degree.

Miller, 37, was initially charged with felony child abuse and aggravated assault of a child younger than 3 years of age for a Friday incident in Scotland, but when the infant died Wednesday afternoon, Miller was charged with alternate counts of first-degree murder, second-degree murder and manslaughter in the first degree.
    Court documents say Miller claimed his wife was lying on top of the child, but a later medical examination of the child revealed signs of abuse, and Miller’s wife also told authorities he abused her.

    According to a report filed by Bon Homme County Sheriff Jason Bechtold, police and ambulance personnel were called to the residence of Chris and Stacy Miller at 410 Third St. in Scotland at about 12 a.m. Friday because the couple’s four-month-old son, Jacob, was not breathing.

    When Bechtold arrived at the residence, he was informed that the infant had been transported to Landmann- Jungman Hospital in Scotland.

    The baby was breathing on his own for a few minutes while at the hospital, but a ventilator was needed as Jacob was flown to Sioux Falls for treatment at Avera McKennan Hospital.

    Rodig detected an odor of alcohol on the breath of both parents. He attempted to interview Stacy at the hospital, but she appeared somewhat incoherent and registered a 0.216 blood-alcohol content — about 2.5 times the legal driving limit — when administered a breathalyzer test.

    Rodig then interviewed Chris Miller at his residence and Miller advised the officer that he and his wife had “a couple of stiff drinks.” Miller said his wife fell on the floor in the bedroom and urinated on herself before he helped her to bed.
    Chris Miller then said their son Jacob was fussy, so he brought him to his wife to feed the baby. He said he went in the bedroom one hour and 45 minutes later and found Stacy lying on top of their son, according to court documents.
    Miller then called police and started CPR, he told Rodig.

    Agent Rodig received a phone call Friday from Avera McKennan Hospital noting that Jacob Miller had been diagnosed with a skull fracture and broken ribs, and that the injuries were indicative of child abuse.
    A doctor described the skull fracture and broken ribs as the type of injuries that could occur from being in a highspeed car accident but could not be obtained from someone lying on top of the baby on a bed.
    Agent Rodig conducted another interview with the Millers later that morning.
    Stacy told Rodig that Chris Miller had “assaulted her approximately a week or two ago.” Stacy also noted her husband Chris gets frustrated with their son’s crying and “is rough with him.”

    During the interview, Chris Miller was advised by Agent Rodig that the injuries Jacob had sustained were not consistent with the story Miller told.
    Miller said nothing else happened other than what he had told Rodig the night before.
    Miller was placed under arrest on Friday and taken to the Minnehaha County Jail before being transferred to the Bon Homme County Jail.

    Miller had his initial appearance Wednesday in court in Bon Homme County and is being held on a $700,000 cash bond.
    First-degree murder is a Class A felony punishable by death or life in prison. Seconddegree murder is a Class B felony punishable by life in prison. Manslaughter in the first degree is a Class C felony with a penalty of up to life in prison.
    Chris Miller was previously charged with manufacturing a controlled substance in February 2009 when DCI agents found evidence of a meth lab at his residence in Scotland.
    Miller was sentenced on Aug. 26 to a suspended 203-day jail sentence and 10 years of probation for felony meth possession.

    A full examination was done on Chris and Stacy Miller’s other child, Elizabeth, and according to court documents, X-rays were performed and “there appeared to be signs of abuse.”
    On Wednesday, the breathing tube was removed from four-month-old Jacob Miller at Avera McKennan Hospital, and he died at 3:31 p.m. His funeral service will be at 10:30 a.m. Saturday at the United Church of Christ in Scotland

    SCOTLAND, SD - Disturbing details in the death of a 4-month old in Scotland.

    Court papers describe what happened to Jacob Miller the night he was hospitalized.

    Jacob's father, Chris A. Miller, now faces murder and manslaughter charges stemming from the baby's death.

    Four month old Jacob Miller was rushed to the Scotland hospital seven days ago. He was soon placed on a ventilator and flown to Sioux Falls.

    According to court papers, doctor's say Jacob had a fractured skull, bleeding in his brain and newly broken ribs, as well as other injuries that already had started to heal. And in their professional opinion, Jacob's injuries were consistent with a high-speed car accident, or child abuse.

    Charges against his father, Chris Miller, became much more serious when baby Jacob died.

    "The prosecution team took a look at the witness statement and the physical and medical evidence and made a determination that there would be five charges ranging from premeditated murder down to the child abuse charges,” Marty Jackley, SD Attorney General said.

    Originally, according to court papers, Miller told authorities he found his wife Stacy lying on top of the baby on the couple's bed.

    He then admitted to the criminal investigator on the case that both he and his wife had a few drinks earlier in the evening. Stacy's blood alcohol level registered more than twice the legal limit and Chris refused the test.

    Court papers also reveal Stacy telling the investigator, Chris was abusive with her. A background check on Chris reveals he's no stranger to trouble with the law.

    Chris Miller has also gone by the name of Chris Huber, and the 37 year old's arrest record spans the last 21 years for charges of domestic violence, rape, burglary, manufacturing and possession of drugs. In 2009, Chris Miller was arrested for possession and manufacturing of meth in Scotland. The manufacturing charge was dismissed and Chris Miller pled guilt to the possession charge.

    Miller now faces five charges in the case, including first and second degree murder; manslaughter, felony child abuse and aggravated assault.
    The court papers also revealed the Miller's have a one and a half year old daughter who also shows signs of past physical abuse.
    Yet another baby killer. I hope this douchebag rots in hell for killing his innocent baby.

    She should face charges as well. Past abuse on the baby and the other children showed signs of abuse from what I read from this post, she had to have known what he was capable of and she should have protected her children from him.

    Dont quite seem fair to charge one and not the other, this case really is kind of he said she said here... this is one of the things I always wonder about and why I wont babysit kids, it takes a while for bruises to show up, supposing a parent or someone slams the hell out of a baby, brings it to you to babysit then when it gets sick and cant breathe you are left looking like you did it, also can happen the other way around, babysitter can hurt the baby, send it back home and the parent is the one fucked, not saying thats what happened here, but they were both fucking drunk, and seems they both made it a habit to get that way, either one or both could be the one, hard to know for sure...

    A Scotland man has been indicted on counts of murder and manslaughter in connection with the death of his infant son.

    Chris A. Miller, 37, was indicted on one count of second-degree murder and one count of first-degree manslaughter, prosecutors announced Wednesday. The counts are alternative, meaning the jury will be asked to pick one of the two counts.

    He was also indicted on one count of aggravated assault of a child younger than 3 years of age.

    A Scotland man pleaded not guilty Wednesday to three counts in the death of his infant son.

    Scott Allen Miller, 37, appeared in Bon Homme County court in Tyndall and pleaded not guilty to seconddegree murder, an alternate count of first-degree manslaughter and aggravated assault.

    Miller’s 4-month-old son, Jacob, died March 8 from injuries alleged to be caused by child abuse. Court documents say Jacob had a severe skull fracture and broken ribs.

    Miller is also facing revocation of his probation for a 2009 conviction of manufacturing methamphetamine. He received a suspended 10-year penitentiary sentence for that crime.

    Following the hearing, Eng heard a request from Miller’s wife for a protection order that would prohibit Miller from being within 1,000 feet of her. Miller did not object, and Eng granted the order.

    In her application, she claimed Miller was physically and mentally abusive to her and both of their children. The couple has a 2-year-old daughter named Elizabeth.

    Thirty-nine-year-old Chris Miller, of Scotland, is on trial in Parker on several charges including second-degree murder in the March 2011 death of 4-month-old Jacob Miller. Attorneys on both sides gave their opening statements to the jury Tuesday.

    Prosecutor Lisa Rothschadl told jurors that Miller abused his son and that the boy died of injuries that “were not accidental.”

    Defense attorney Tim Whalen told the jury that Miller’s wife, Stacy, rolled over on Jacob while drunk.

    Bon Homme County State’s Attorney Lisa Rothschadl recounted the series of events that allegedly led to Jacob’s death and Miller’s arrest, which court documents say began shortly after midnight on March 4, 2011, when Jacob was taken to the hospital in Scotland. Miller had called 911 less than 20 minutes before and reported he had found his wife, Stacy Miller, passed out from drinking and lying on top of Jacob, and that Jacob was not breathing.

    Jacob was later transported to Avera McKennan Hospital in Sioux Falls, where he was diagnosed with broken ribs, severe skull fractures and bleeding in the brain, court documents say.

    “Doctor after doctor will testify that these injuries were not accidental,” Rothschadl said.

    Stacy Miller will testify about a past incident when Miller abused Jacob, and paramedics, police officers and doctors will all testify that the cause of Jacob’s death was abuse, Rothschadl said.

    “The evidence and testimony you are about to hear and see will establish that Jacob Miller did not die from an accident,” she said. “It was abusive head trauma.”

    Miller is being defended by attorneys Tim Whalen, of Lake Andes, Scott Podhradsky , of Wagner, and Ken Cotton, of Wagner. Whalen gave the defense’s opening statement.

    The prosecution’s case is based on nothing more than “speculation, guesswork, innuendo and suggestion,” Whalen told jurors.

    “The state’s evidence will not provide a smoking gun,” he said. “They can’t prove that Chris Miller did anything to harm Jacob Miller.”

    Whalen said an expert witness will testify the cause of death for Jacob was suffocation from “Stacy rolling over on Jacob when she was in a drunken stupor,” not abusive head trauma as alleged by the prosecution.

    Stacy Miller will testify that the last thing she remembers from the night of the incident is holding Jacob in the bedroom, Whalen said.

    “The evidence will show the last person to see Jacob alive was Stacy Miller, not Chris Miller,” he said.

    Karen Evenson, the dispatcher at the Bon Homme County Sheriff’s Office who answered the 911 call when Miller reported Jacob wasn’t breathing, was the first witness called to testify.

    Before Evenson gave any significant testimony, a recording of the 911 call was played in the courtroom.

    “My wife was lying on my son,” Miller says in the recording to Evenson after she answers the call. “He’s not breathing.”

    Miller speaks fast, seemingly in a state of panic, as he tells Evenson his name and address while she dispatches an ambulance.

    “She was sleeping on him,” Miller repeats. “My wife was sleeping on him.”

    After little more than a minute, Miller apparently steps away from the phone, but leaves the line open, and attends to his child and wife.

    “Jacob breathe, please breathe,” he can be heard saying in the background.

    A woman, presumably Stacy Miller, can also be heard yelling in the background of the call.

    While still on the line with Miller, Evenson contacts Bon Homme County Sheriff Jason Bechtold and notifies him of the incident.

    “It sounds suspicious,” Evenson tells Bechtold. “I don’t know what’s going on.”

    Eventually, Miller returns to the phone, and shortly afterward a police officer on the scene tells Evenson that Jacob has been taken to the hospital, and the call ends.
