Kimberly Ann Moore, the mother of deceased 5-year-old Zachary Dominguez, who authorities said was the victim of long term physical abuse, has been under investigation before.

Department of Child Protective Services’ Public Contact Person Marleigh Meisner said CPS was called out to Moore’s home in August 2010. Meisner said that there had been previous accusations of abuse regarding Moore’s children.

Though she did not give many details about the case, she did say that on completion of their investigation, CPS had decided the best course was to provide the family with ongoing services. Meisner did not specify what services were offered to the family at that time.

Moore, 27, along Ralph Martinez Jr., 25, were arrested Sunday afternoon on a first-degree felony charge of injury to a child with intent to cause serious bodily injury. They remain in the Ector County Detention Center on $100,000 bond each. Martinez Jr. also has a charge of motion to revoke probation on a possession of cocaine charge. No bond has been set on that charge as of Wednesday.

Odessa Police spokeswoman Cpl. Sherrie Carruth said Moore and Martinez Jr. were arrested because police had reasonable belief they had committed a crime.

“Once police got (to the scene), they could see the abuse was apparent,” Carruth said. “Due to the circumstances, officers were able to see the abuse. You know (the child) didn’t do that to himself.”

Moore has three other children, a 10-year-old girl, 3-year-old boy and a 1-year-old boy!!

Ongoing services, my ass, Lil Zachary was old enough to tell about his abuse, so why wasn't he questioned?? Grrrr!!

Randy Martinez said he noticed bruises on the boy’s head when he would cut the boy’s hair, but never thought much about it. He said he has never seen his brother hit a child.

“Everyone who knows my brother knows he would never hit a kid,” Randy Martinez said. “Spank, yes, but never hit.”

First thing I thought of when I saw that mug was Grossberger from Stir Crazy. Imagine seeing that fucking beast coming at you? Poor kid. 5yrs old, he didn't stand a chance against that monster on his own. And he died with the knowledge that mummy didn't give a flying fuck about him, didn't care enough about him to get him out of that situation and get him to safety. I hate to say it, but the abuse was long term and we don't know how long the ham beast was in this child's life. That sweet, innocent looking girl child might be the real abusive influence in this poor child's death. She hooked up with that shit monster, so looks aren't everything. I'd say we're going to find out a lot more about the bitch very soon.

Those bruises that his brother saw on Zachary's head should have been questioned, I don't care how 'nice' you think someone is, even family, you have got to check stuff out like that. I had to ask my sister once on bruises my nephew had when he was 3 yo (he's 8 now), as I knew neither her or her bf had wanted Ty from the get go.

Had Zachary's well being been checked out closely, and I mean ask the hard questions and don't take bs for an answer, MAYBE Zachary would be alive today. Not his mother, or anyone one else championed little Zach and now there isn't a chance to do that over. I hope the bitch cries every fuck night begging Zachary to forgive her for not protecting her and that her remaining children are taken from her and never left unprotected. She deserves nothing so precious.

Ector County District Attorney, Bobby Bland, issues the following statement:

On Monday, April 18, 2011, the Grand Jury returned to the 244th Judicial District Court in Ector County, Texas the following Indictments: Kimberly Moore and Ralph Martinez, Jr. were indicted for allegations relating to child abuse. The Grand Jury returned two separate Indictments against each Defendant. The first one includes one count of Capital Murder for the murder of Zachary Dominguez in February, 2011, and four (4) related counts of Injury to a Child, which are First Degree Felonies. The second Indictment includes two (2) counts of First Degree Injury to a Child against Kimberly Moore’s two year old son. The murder is a Capital Murder because the child, Zachary Dominguez, was under the age of six when he was killed. The two had previously be charged and jailed for Injury to a Child.

Ralph Martinez’s probation was revoked today for the maximum of five (5) years by Judge Bill McCoy. District Attorney, Bobby Bland, represented the State in the above listed matters.

And for the record. I don't think Mr. Martinez actually did cause the injuries, but I think he knew how she treated this child. He Is a big man, and I am sure he could have jumped in and taken her ass out if need be.

And yet you told the news reporter that Kimberly had already been investigated by CPS in Aug 2010, so you must have known she was abusive, yet thought nothing of a 5 year old in her care with bruises to his head?
