CLARKSVILLE, Ind. (WDRB Fox 41) -- A Clarksville father sits in jail Monday night accused of abusing his young son to the point of breaking the four-year-old's leg.
[...]
"He struck his younger son and broke his leg and then he struck that child in the face and about ears," said Jeremy Mull, Clark County Chief Deputy Prosecutor.
The accused is 28 year old David Lee Fultz, Junior. The victim is his unidentified four year old son.
"They been here for about 6 months maybe a little longer," said Marvin Simpson, neighbor.
News of Fultz arrest and the serious charges of child battery came as a shock to neighbors. Simpson said he never really saw anything suspicious at the home on Spicewood in Clarksville and only occasionally saw the four-year-old outside playing.
Never talked to neither one, they're pretty much to themselves," said Simpson.
That was until Saturday when Fultz had to call strangers for help. An ambulance took the four-year-old to Kosair Children's Hospital with a broken leg and other injuries.
"To have a father break the leg of his own son is particularly disturbing," said Prosecutor Mull.
Details of what happened inside the Fultz home on Saturday - from court records. Fultz is wearing a University of Kentucky sweatshirt in his mug shot. According to court documents he was watching the Kentucky football game when it all went down.
The documents state the kids were running into the living room when Fultz told investigators he went into the kids bedroom and the four year old jumped on his back. Fultz said he flipped the child over his shoulder at which time the child's leg hit the bed rail. Fultz told police it was an accident.
"The evidence that we received in our investigation was contradictory to that. After investigating that, we came to the conclusion that's not what happened. He had struck this child and battered this child and caused these injuries," said Mull.
The documents also include a detailed interview with the young victim. The child told police, Fultz hit him with an open hand because the four year old was on top of his little brother. It also states the child's mother was at work when the four year old was hurt.
"It's very serious and a sad thing for an adult to inflict this type of an injury on a child," Mull said.
It appears Fultz has been in trouble with the law before. He has a mug shot from Louisville Metro Corrections. Fultz has been charged with Sexual Misconduct, criminal trespass and traffic violations in years past.
As for the four-year-old, Prosecutor Mull said the child had surgery and is now in his mother's custody with Child Protective Services investigating.
