Joshwa Carlisle Charged with Killing Mistress and Burning His Baby Daughter Alive

INDIANAPOLIS (WISH) - Marion County Prosecutor Carl Brizzi told reporters Wednesday that he is considering seeking the death penalty against Joshwa Carlisle, the man accused of killing his mistress, burning her and burning his infant daughter alive.

Carlisle was in court Wednesday for an initial hearing where he heard the charges being filed against him. The judge entered a not guilty plea.

“He’s being charged with 2 counts of murder and also with a Class A felony arson,” Brizzi said

“According to the information contained in this probable cause affidavit, the allegations are that he killed mom first and then set her on fire. There was accelerant that was used. And then as far as the infant goes, the information contained in the probable cause document, alleges that the baby was in fact burned alive. And we know that because there was actually carbon monoxide in the baby’s lungs which means she was breathing at the time she was set on fire. And accelerant was used in at least two different points of origin so the fire was clearly not accidental,” the prosecutor told 24-Hour News 8

He went on to discuss the decision he has to make about seeking the death penalty against Carlisle.

“I was sitting in court thinking through these statutory aggravators present. In order to file an enhancement such as death penalty or life without the possibility of parole, we have three factors here. One: the multiple killings; The age of the baby, the victim; And then also torture. I would consider it to be torture lighting somebody on fire while they’re still alive.

Death penalty cases are extremely expensive and the level of scrutiny is higher. The prosecutor is probably making sure there are enough coins in the coffers and enough evidence to guarantee a win before taking on such an expense.

i am shocked as well! this is one of those cases that i truly feel no wishy washy feelings. he could have left them, just walked out the door. adults do as adults do but to burn an infant alive . . . she didn't even know why she was hurting so or why her daddy was not stopping it.

I am not (usually) a supporter of the death penalty*; but if he's found guilty (yeah, right), the death penalty was made for this.

*I'm not a bleeding heart who wants to coddle criminals; I'm just plain mean. Dad speaks about daughter's fiery death

Juliana would have turned 1 year old Nov. 25. Her grandfather told 24-Hour News 8 that unlike her mother, Juliana loved taking pictures. In one picture she's wearing a shirt that says, "I love daddy." Sadly, it was her daddy who killed her and her mother.

Crippled by a stroke he had two years ago, Jerry Shannon relives Sept. 19. That Sunday, Shannon lost his daughter and granddaughter.

Shannon told 24-Hour News 8 the tragedy is all because Carlisle didn't want to pay child support."It's pretty painful to know what kind of death they went through," he said.

The five-page probable cause affidavit details what happened . Juliana was burned alive in her crib.Police said there were burns on her chest and face with zig-zag patterns.

"She was like a match ... set her on fire," Shannon said.

Tracie was found in her bedroom dead with her hands locked straight above her head. Investigators believe she was killed before the fire was set.

24-Hour News 8 Reporter Daniel Miller asked Shannon how he's dealing with what happened.

"It's hard. It's hard," Shannon said, "I would like to meet him in the street one day, but I'm not going to get to do that because he's going to be locked up for the rest of his life."

Jerry Shannon told 24-Hour News 8 that if anyone learns something from this, he said be careful who your children meet on the Internet. Shannon said his daughter met Joshwa Carlisle online and he never knew anything about him.

She met him on the internet.. later had a baby with him..he didnt feel like paying child support. Thats why he killed them. Sadly Indiana has the lethal injection. If this garbage is convicted, I am hoping and praying for a nice life without parole sentence. In Indiana it can take 20+ years for a death penalty to be carried out. I personally am from Indiana and I'd prefer my tax dollars go to put some worthy student through college than to support this trash. The really sad fact is most who are sentenced to death in Indiana end up dying of old age or natural causes before facing the death chamber. This guy deserves to be placed in general population in prison and by doing so, we the taxpayers would not be forced to pay for his attorneys.

Victims' family dismayed after mistake sets murder suspect free

INDIANAPOLIS (WISH) - The disappointment was written all over their faces. Tuesday, Kenneth and Carla Scott learned that the man police believe killed their daughter and granddaughter will be set free.

Joshwa Carlisle had been charged with killing his girlfriend, Tracie Shannon, and their 9-month-old daughter, Juliana, in 2010. Lawrence police said Carlisle smothered Shannon, then set her and their child on fire in an apartment.
Joshwa is cold-blooded and calculated,” said Shannon’s stepfather, Kenneth Scott.
However, because of a technicality, Carlisle will be set free before he even faces a jury trial. Marion County prosecutors failed to hand over DNA evidence to the defense in a timely manner. That means that a judge is bound by law to let Carlisle go free until his trial, set for Jan. 17
“I’m not going to make excuses. And the bottom line is that it should not have happened,” said Gregory Spencer, deputy prosecutor for Marion County.
Wednesday, Carlisle had yet to be released from the Marion County Jail. Once he is released, he will have to wear a GPS device, check in with a probation officer and remain in Marion County. But despite those precautions, the victims' family is upset.
