    Marci Webber Arrested In 4yo Daughters Alleged Murder

    Illinois police believe Marci Webber of Nassau stabbed her 4-year-old daughter to death
    NASSAU — Police believe a 43-year-old Nassau woman stabbed her 4-year-old daughter to death in suburban Chicago Wednesday before attempting to kill herself.
    Marci M. Webber, of 118 Uphams Corners Road in Nassau, is hospitalized under police supervision in Bloomingdale, a village about 25 miles west of Chicago, authorities there said.
    While no charges have been filed, Bloomingdale Police Chief Frank Giammarese characterized the incident as a murder-attempted suicide and said charges are likely to come for Webber, who has had three children.
    Webber was seen by a neighbor on Uphams Corners Road packing her things into her car early one morning and taking off about three weeks ago with her 4-year-old daughter, said Skye Schiller, who lives on the rural road.
    "She was odd. She really didn’t make friends with anybody on the road," Schiller said of Webber.
    On a page on the social networking website MySpace made by Webber, she depicts herself as a “very Catholic person” who believes the family court system is damaging to children and parents.
    She wrote that she was attending law school to be a legal malpractice lawyer and is active in an organization called Reform Our Courts 4 Kids.
    On the page, she blasts Family Court judges in Saratoga and Warren counties for “abusing their power in order to mess with me.”
    Webber had told people in Illinois that she was in the midst of a bitter custody battle in New York when she left, the Chicago Tribune reported. She previously lived in Lake Luzerne in Warren County where she worked as an artist, according to years-old art exhibit listings in The Post-Star
    Among the photos posted on Webber’s MySpace page is a 3½-year-old photo of her youngest daughter, then an infant.
    The caption below the photo reads: “Life is a gift from God not to be messed with or taken away until it's (sic) natural death and journey into eternity!”

    Police and emergency personnel were summoned to a Bloomingdale townhouse around 1:30 p.m. Wednesday and found 4-year-old Magadine M. Webber dead at the scene, Giammarese said.
    A television station there, WGNTV, cited police sources who said the child had been stabbed and nearly decapitated.
    The girl’s mother was hospitalized with what appeared to be self-inflicted injuries, Giammarese said.
    A Bloomingdale neighbor told the Tribune that a teenage daughter of Webber’s came running from the townhouse Wednesday before police arrived, screaming, "There’s blood everywhere."
    Four-year-old Magadine was "shy and polite," another neighbor told the newspaper.
    Documents on file at the Rensselaer County Clerk’s Office indicate Webber owed $3,657.77 in back taxes to New York State as of March of this year on her home in Nassau. The outstanding tax warrants stretch back several years.
    Giammarese would not discuss a possible motive for the crime and said the investigation continues. Detectives may soon head to Rensselaer County to gather information for their investigation, he said.

    Accused killer feared daughter would become 'Internet sex slave'

    The mother of a murdered 4-year-old Bloomingdale girl said she fatally slashed the girl's throat to keep her from being raped and sold as a sex slave over the Internet, according to prosecution statements at a Sunday bond hearing.


    Bond for 43-year-old Marci Webber, charged with first-degree murder, was set Sunday morning at $5 million by DuPage County Judge Richard Russo.


    When Bloomingdale police entered the home and found the victim, Magdalene M. Webber, dead in the upstairs bathtub, they saw the words "divine mercy" written in blood on the adjacent wall, said Assistant State's Attorney Joseph Lindt.


    Lindt said it believed that the victim was drugged with Benadryl and sleeping pills before she was attacked.


    But Lindt told Russo that the child "may have awoken" during the attack in which the attacking cut severed her esophagus and touched her spine.


    A 4-inch folding knive believed to be the murder weapon was recovered at the scene.

    AND THIS:

    Webber does have prior arrests in McHenry County, including on charges of battery in 1995 and child abduction around the same time. Both of those cases, however, were dismissed.

    Someone needs to just hand this bitch a knife. Maybe this time she'll have the brains to do it right, if not maybe Daddy will help her along. She's not fit to breath the same air as the rest of us. I can't imagine the terror this poor baby felt waking up and finding the person she should be able to trust above anyone else taking her very life.

    She was batshit crazy. Well, still is. Writing on the walls with her and babys blood? What about the older children..were they just a tad bit less easier to kill, than a baby? Oh, she is going to get hers when the meds kick in..I dont want her to die. I want her to remember, when her heads straight, every fucking thing she did to her baby..everyday.

    Webber has three daughters, ages 18, 10 and 4-year-old Maggie, all of whom have different fathers. The oldest daughter discovered the violence Wednesday after going to her grandmother's townhome to check on her mother, police said.

    The teen said Maggie's father was not involved in the toddler's life. She corrected neighbors' accounts that Webber was involved in a custody dispute over Maggie. The New York custody case dealt with the middle daughter, who police said was not in Illinois with her mother.

    "I don't know why my mom was here," the 18-year-old college student said in a Sunday e-mail to the Tribune. "She didn't tell me she was coming in the first place. She said she was scared to be in NY, but I think she was just really lonely. She came and visited me almost every day while she was here."

    Webber's daughter, known as Maggie, was found dead by the victim's teenage sister about 1:30 p.m. Wednesday afternoon inside her grandmother's town home in the 200 block of Amherst Court on Bloomindale's southeast side. The mother and child, who live in upstate New York, had been staying at the home for several weeks while visiting, Bloomingdale Police Chief Frank Giammarese said.

    A lengthy autopsy conducted Thursday on Magdalene M. Webber concluded the child died from a single laceration to her neck that law enforcement officials said was so deep it nearly severed the girl's head.

    What the hell happened to the gift of life isn't to be messed with and should run it's natural course???

    This is so sick and sad to me. There is no way the baby was going to be raped and sold into sexual internet slavery unless the mother had a pervert in the kid's life. The ten year old that can read, type and be lured would be the one to be more concerned about.

    Just a totally SAD story.

    Oh my God that poor sister... she'll be scarred for life for finding her little sis like that. God, how can any mother do this kind of thing to their very own child that they brought into the world??? I really can't imagine being crazy enough to do such a thing... I would have thought that it would have been noticed and the child(ren) made safe before it got to that point.

    "Mental exam delayed in slaying of 4-year-old
    ...has been delayed at least a week due to concerns by her attorneys.

    DuPage County Public Defender Jeff York received a delay today from Bakalis [Judge George Bakalis ] after stating that he has not be able to have a private conversation with Webber in the county jail, because she is on a 24-hour suicide watch, which has required a sheriff's deputy to be in close proximity at all times.

    Also, York said that the defense hasn't been given any evidence or information about the case, which hinders its ability to discuss the case with Webber and offer legal advice.

    Bakalis had previously warned Webber that it is her right to talk or not talk with the prosecution's mental health exam, but that if she eventually offers the defense that she was legally insane at the time of the incident, the state has the right to introduce her statements at the interview at trial.

    "From our perspective, time is of the essence," said McGimpsey. "The best circumstance is to have the mental health exam immediately, nearest the time of the incident."

    Bakalis said he wanted a status of the case next Monday, Nov. 22.

    Meanwhile, more than a dozen relatives and friends said goodbye to Maggie during a small private funeral in Roselle."

    Marci Webber pleaded not guilty today to the brutal murder of her 4-year-old daughter as defense attorneys continued their legal fight to stop DuPage County prosecutors from conducting a mental health exam of her.

    Assistant Public Defender Anthony Coco told Judge George Bakalis that the defense has filed a motion to declare the state statute that permits prosecutors from seeking a mental health exam unconstitutional, claiming the statute denies the defendant a right to adequate counsel.

    DuPage County Public Defender Jeff York has objected to that exam, claiming that the defense team doesn't know enough about the case yet to adequately counsel Webber. Whatever Webber says in the proposed exam could be used against her if she decides to claim she was insane at the time of her daughter's death.

    McGimpsey, who initially stated he wanted the mental health exam done promptly to better evaluate the defendant's mental state, said he would review the defense's motion and respond within several weeks. Bakalis said he would set a hearing after that response.

    Why would the defense NOT want an mental evaluation? If their client is crazy as a shit house rat then the truth of the matter is that Justice will be served by getting her into treatment.

    Why would the defense NOT want an mental evaluation? If their client is crazy as a shit house rat then the truth of the matter is that Justice will be served by getting her into treatment

    I don't know. It's not like you can tell a crazy person "Don't talk about the voices" and they will listen to your lawyerly advice.


    @badfish76 and DV Maybe, they are afraid she will say something, that will prove that she wasn't insane, at the time of her daughters death so they want to coach her privately first so they can tell her what to say an do during the exam?

    Mental exam ordered.
    A New York woman accused of murder in the death of her 4-year-old daughter in Bloomingdale in November was ordered Monday to undergo a mental health exam despite claims by her attorneys that such an exam could be unconstitutional.

    Assistant Public Defender Anthony Coco argued that the mental health exam request violated the defendant's rights because the defense hasn't had a chance to completely review the evidence against her and give her adequate legal counsel.

    But DuPage Judge George Bakalis said the Illinois statute that allows the state to request a mental health exam was "reasonable because there is a possibility of an insanity defense. It is better to do it sooner to the event. That is why the statute allows it."

    The mental health exam is expected to take place within the next week in the county jail, where Webber is being held.

    When Coco brought up the possibility that Webber may refuse to cooperate with the exam, Bakalis warned that such a refusal could result in the defense not being allowed to use or being restricted in its use of expert witnesses to support its own future claims.

    The defense hasn't declared if it will claim Webber was legally insane. Coco told the judge the defense is pursuing possible defenses other than insanity, but he declined to elaborate.

    Judge orders involuntary confinement for woman who killed 4-year-old daughter
    Marci Webber gets lengthy stay in a mental institution after judge finds her not guilty of murder by reason of insanity
    A DuPage County judge Friday set a maximum 100-year term of involuntary confinement in a mental health facility for a former Illinois woman who killed her young daughter in Bloomingdale in 2010.

    Judge George Bakalis issued the order in a brief hearing for Marci Webber, 45, of East Nassau, N.Y., and formerly of northwest suburban Woodstock. Last month the judge found Webber not guilty by reason of insanity of the murder of her 4-year-old daughter, Maggie.

    The 100-year term was expected by Webber's attorneys. The length of an involuntary confinement in an insanity case is usually the same as the maximum prison sentence that could have been imposed in the event of a conviction.

    Webber, who appeared in court Friday in a gray sweatshirt and jeans, likely faces a lengthy stay at a mental institution, Assistant Public Defender Jill Eckhaus said. Webber eventually could be freed if her doctors determine she is mentally fit and a judge rules in her favor.

    At an Aug. 17 court hearing, the Illinois Department of Human Services is expected to announce a treatment plan for Webber, who has been confined at the Elgin Mental Health Center, Eckhaus said. The court will receive updates on her condition every 60 days.

    At Webber's trial in June, DuPage prosecutors had sought a conviction for first-degree murder, but Bakalis ruled that Webber's mental health issues had mitigated her actions. At the trial, her teenage daughter described finding her mother and the body of her little sister in the blood-smeared bathroom of Webber's mother's town house on Nov. 3, 2010.

    A psychologist testified that Webber, who had a history of mental illness, had suffered a break with reality and had slit her daughter's throat because she believed the child would fall prey to sex traffickers. Webber and Maggie had traveled from New York to Illinois several weeks before the killing, as Webber had devolved into a paranoid state, her attorneys said at trial.
