    Tulsa Police Arrest Janette Mickelboro For Allegedly Murdering Baby Hunter

    TULSA, Oklahoma -- Tulsa Police have arrested 23-year-old Janette Mickelboro in the homicide of her infant son.
    Three-month-old Hunter Warner was pronounced dead after his father discovered him in his bassinet, not breathing, according to a news release from the Tulsa Police Department.

    Janet Mickelboro told police she tied a receiving blanket around the infant's face to hold his pacifier in place then put him into a "bouncy chair" on the morning of August 20, 2010. When she checked on the baby several hours later before she left for work, she discovered him to be "cold and stiff," the report states.

    The mother then untied and removed the receiving blanket from the baby's face, took him out of the bouncy chair and placed him in the bassinet where he was later found by his father.

    tied a blanket around his face to keep his pacifier in? what the fuck?! because it's much too difficult to listen to a baby making their usual noises, or to actually try being a parent to calm and soothe your infant if they're fussy. stories like this hit me hard because i have a two month old. makes me hug him a little more for all the babies in the world like Hunter who have people who only hurt them.

    Most of these young moms do not have the understanding of how to care for their babies, and make serious and deadly decisions. Out here in my state, there was a young mom who taped a binky to the infants face, and another who, with her husband,felt that babies should not be fat.Out came the laxative formula. I have to wonder if intensive parenting classes should be provided at high school. And not the stupid caring for an egg crap. At least the babies of these young parents will have a better chance of surviving.

    According to this newscast; family members had previously witnessed the mother tie a blanket around the baby's head, and had warned her that doing so was dangerous.

    In many cases, I just don't think parenting classes would have kept this from happening. Common sense often can't be taught. She was told to stop, and continued to do it.

    Stupid cow, stupid stupid cow, tie a blanket around your face so as not to offend the rest of the worls, this can only make you think that she intended on suffocating the baby and saying accident, this is comparable to taking your bay and laying him in the middle of the freeway then acting like you are confused that he got hit by a car, bitch was too lazy to keep putting the binkie back when it fell or to listen to him cry, sounds like it was a long time before she checked on him too, stupid stupid stupid ugly cow...

    Still, to see it in writing, shocks me to tears!

    According to an affidavit filed Wednesday in Tulsa County District Court, an autopsy revealed damage to the baby's lungs and heart "consistent with suffocation."

    There were no external signs of trauma, according to the affidavit.

    So family members witnessed this and told her she was doing something dangerous....then wtf?
    did she really not want baby was tiring of him as he was not a doll to put up?

    And tho she looks like 16 but she's not. 23 yo is not so damn young to not have reasonable common sense, besides she was warned not to do as she did, AND, as the video indicates she has a 2yo with the father of Hunter. I wonder with that warning, will intent to harm be brought up. she didn't check on him for several hours ffs!?

    so very, very sad, breaks my heart! poor baby Hunter just starting life and seems to have had a lot of family that did love him.

    I don't think she intended to kill the child, only shut him up so she didn't have to hear him or be bothered with him. The fact that she did not intend to kill her son does not mean she isn't guilty and a general piece of shit.

    When a kid ends up dead, from suffocating because a blanket was tied around his face, does intent really matter? Isn't the net end result the same? What does one expect to happen when one ties a blanket around a child's head? I think all cases involving kids need to have their own set of rules and circumstances, and they should not necessarily be the same as punishment for adult victims of crime.

    Intent could mean a stiffer sentence. Agree, special set of rules when it comes to crimes against children, and as we've seen some laws are geared that way. It will happen even more so when children are valued as treasures by society instead of little people who don't really have rights yet 'cause the don't pay taxes.

    Judge declines to order trial

    At the close of a preliminary hearing, Tulsa County Special Judge Allen Klein determined there was insufficient evidence to bind Janette Mickelboro over for trial on a first-degree murder charge linked to the death of Hunter Warner.

    Hunter was not yet 4 months old when he died Aug. 20.

    On Mickelboro's behalf, defense attorney Marny Hill maintained that the death was an “unfortunate and tragic accident,” and there was no showing of any "unreasonable force.”

    Being a young mom has nothing to do with it. I was 16 when I had my son and 19 when I had my daughter, not once did I tie anything around either of their faces. She was stupid and lazy.

    Can they charge her with second degree murder? Maybe there's not enough evidence to prove she intentionally killed Hunter, but surely there's enough to show she engaged in an act that was dangerous and could have hurt or killed the baby....even if she didn't intend to, she had to know it could have; she'd been told before not to do it.

    I agree. I don't think what she did met the requirements for First Degree Murder. I hope they recharge her with something more appropriate.

    Prosecution appeals and wins!

    A reversal of a lower judge’s ruling means that a Tulsa woman now faces trial on a charge of murdering her baby.

    A Tulsa County district judge resolved an appeal in favor of the prosecution and found that sufficient evidence was presented at Janette Mickelboro’s preliminary hearing to hold her for trial.

    District Judge Bill Musseman sent the case back to Special Judge Allen Klein with instructions to bind Mickelboro over on a first-degree murder charge in the death of Hunter Warner. Hunter, born April 29, was not yet 4 months old when he died Aug. 20.

    At the preliminary hearing level, evidence is to be evaluated in a light most favorable to the prosecution. The applicable standard is whether there is probable cause to believe that a crime was committed and that the defendant committed that crime.

    “There can be no question that the state has in fact shown probable cause to believe that Hunter died because his airway was restricted by the blanket,” McAmis wrote in a court brief.

    Mickelboro, who cried during Tuesday’s legal arguments, is in the Tulsa Jail.
