Allgier also received new attorneys from the Gale and Kawai Law Firm to represent him in the case. Both attorneys, Richard Gale and Dusty Kawai, were in court Tuesday and will likely submit a motion regarding Allgier's weight, since he has lost 30 to 50 pounds since the alleged murder took place. Gale and Kawai say Allgier needs to gain the weight back to prove some points about the attack.

Prosecutors say they are thrilled the trial date has been set.
"We are just anxious and glad that we have a trial date," said Prosecutor Robert Stott. "It's been a long time. We've been pushing this thing to be able to get it resolved and of course it's important that the defense have everything ready on their side. We don't want to make them go to trial too soon, but everybody believes June is an appropriate time."
The court hearing Tuesday happened a week after the Utah Supreme Court ruled a letter penned by his former inmate must be made public. The letter, penned by Brent Cobb in April 2008 to Judge Robin Reese, says Allgier confessed to Cobb that he had shot corrections officer Stephen Anderson in the chest and in the head.
Defense attorneys say only a portion of "The Cobb Letter" was released to the public and that it is appropriate for the entire document to be released. They say Cobb is not a reliable witness because it appears he is rambling throughout the entire letter.

So what's the word on covering his tats?
I can't think the weight loss is terribly critical. Juries see defendants all the time whose weight has changed while in prison -- usually going up, but . . . they have pictures of him and in-take forms. Surely the fact he's turned into a bean pole won't suddenly make him look innocent.

A 3rd District Court judge said Monday he will reconsider the issue of Allgier’s portion sizes at the prison, where he was transferred two weeks ago to await his June 2012 trial for allegedly killing a corrections officer.
Allgier, 32, and his defense attorneys had raised the issue of how much food he was getting at the Salt Lake County jail in prior court hearings. Defense attorneys have argued it is important for Allgier to appear at trial near the same weight he was at the time he allegedly shot and killed 60-year-old Corrections Office Stephen Anderson during an escape attempt during a medical appointment on June 25, 2007.

Allgier’s attorneys asserted in court on Monday that the same issues that applied to their arguments for more food for Allgier at the jail, also apply to him at the prison. Allgier’s public defender Dusty Kawai wants the prison to give his client double servings of meat, starches and other supplements to help him regain some of the 50 pounds he has lost while being housed in the jail.
Kawai said that at the jail Allgier was "put in a cell with ants where there are no other nutritional options other than sack lunches."

At the restaurant, according to preliminary hearing testimony, Allgier was disarmed by a customer. But his attorneys argued that Allgier entered the restaurant because he was looking for a public place to surrender where he would not be shot by police. The defense claims Allgier could not have been forcibly disarmed by the customer, who is a "much smaller" man.
While at the county jail, Allgier was not able to receive the extra food he wanted because of the section where he was housed.
Moving Allgier to the prison potentially meant that the arguments over food at the jail would become moot, before defense attorneys launched arguments about the prison food on Monday.

I've heard of some pretty odd defenses, but the "I'm bigger than he was so of course I was going to surrender" is a new one to me. And how do they plan on covering up his tats? Nothing shy of gauze, paint, or a professional makup artist can pull that off!!

Spray paint the idiot blue and call him a Smurf.
I'm not quite sure why they would want to bulk him up for this trial. Maybe people would feel more sorry for him and feel he was too frail to have committed murder if they leave him thin.

I agree, @badfish and @nopatience, I don't see what his size proves about his intentions. All I'm really hearing is a whining, selfish, entitled bastard racist who wants to control the system. His tattoos should not be covered and his weight is of no consequence. He should not get extra portion (than any of the other prisoners) just because he thinks he's entitled.

Are you kidding? He's a white man!!! He should get more food and more yard time. Didn't you know that the white man should always get what he wants? Especially if he has tattoos all over his face, inside his ears, and everywhere else telling you he is white and proud.
Of course, if he wants to cover them for trial, it seems he isn't as proud now as he was when he got them.

It's just possible that the big, fat version of Allgier had no intention of surrendering when he went into the restaurant. It's possible that when they interview the guy who subdued him, it will become clear that the man (or woman) had the knowledge needed to put Allgier down. I would expect that to be part of the testimony.

Curtis Allgier offered a rambling statement that mixed apology and a tribute to his victim with a rebuttal of the evidence against him, while cursing and ranting against the court system and his lawyers.
"I apologize from the bottom of my heart. I didn't want to hurt anybody. It was an accident," the 33-year-old inmate said at the hearing.
He added, "Just because I've got tattoos on my face and I'm proud of my race, I'm not some violent monster."
Prosecutors said the June 25, 2007, shooting was no accident. Allgier wrestled a gun from Stephen Anderson of Bluffdale after being unshackled for an MRI scan at a University of Utah medical clinic, they said. He then fled on foot and stole a vehicle before leading police on a highway chase at speeds exceeding 100 mph.
His freedom lasted 45 minutes.
Allgier pleaded no contest in October to aggravated murder. He pleaded guilty to additional charges of disarming a peace officer, aggravated escape, aggravated robbery and possession of a firearm by a restricted person.
The plea deal spared Allgier a trial and the death penalty if convicted.
Third District Judge Paul Maughan opened the sentencing hearing to family members of Anderson, a 22-year employee of the Utah Department of Corrections. Anderson, 60, was survived by a wife, five adult children and 18 grandchildren.

Fullerton "went into action," grabbing the much larger Allgier by an arm and forcing him to drop the gun. Allgier punched Fullerton and then slashed his throat with a knife before finally surrendering to police.
