Guadalupe Gutierrez-Juarez is a father...the mother is 10

ST. ANTHONY, Idaho -- A man has been charged with raping a 10-year-old girl who later gave birth in eastern Idaho.

The girl gave birth less than two weeks ago by caesarian section at Madison Memorial Hospital in Rexburg, Fremont County Sheriff Ralph C. Davis and other authorities said. Officials would not disclose the gender, date of birth or paternity of the baby.

"I wouldn't have believed a 10-year-old could conceive in the first place," Davis said.

St. Anthony police began investigating on April 28 after medical personnel alerted police that a pregnant child had come in for treatment.

Guadalupe Gutierrez-Juarez, 37, of St. Anthony, was arrested the same day, Police Chief James Smith said.

In documents that were filed April 29 in 7th District Court and obtained by The Associated Press, Gutierrez-Juarez is charged with one count of rape. He remained in jail with bail set at $250,000 pending a preliminary hearing May 13.

Authorities said Gutierrez-Juarez did not have legal documentation to live in the United States. His home town and nationality were not immediately clear, but police said they had received no complaints about him before investigating the pregnancy.

The investigation was continuing. Smith would not give details on the condition of the girl but said additional counts of rape could be filed.

It's unclear who would take custody of the newborn or what will happen to the 10-year-old mother.

They have charged his girlfriend now as well.

The Fremont County Prosecutor has filed felony child endangerment charges against a 27-year-old St. Anthony woman.

Isabel Chasarez was arrested Friday by St. Anthony Police. She was booked at the Fremont County Jail and is being held at the Madison County jail on a $50,000.

Local News 8 spoke with the Saint Anthony Police Chief. He is not confirming the woman's relationship to the 10-year-old girl.

They are saying the woman is the girlfriend of Guadalupe Gutierrez-Juarez. He is accused of raping the girl which lead to her pregnancy. He was arrested on a rape charge in late April.

The Prosecutor also filed two additional rape charges against Gutierrez-Juarez.

He pleaded guilty yesterday; sentencing is October 28.

Isabel Chasarez is the child's mother; she pleaded guilty last month to failing to provide proper prenatal care for her daughter. She will be sentenced September 30.

And yes, the little girl was 9 when she was impregnated.

The mom is only charged with failing to provide prenatal care? This is fucking unbelievable.

Allow the children to be adopted out--both the 10 yo and the baby. Cut off the perps dick and send him home to where ever the hell he came from. Send the "Mama" along with him --after blinding her, since she apparently couldn't see what the penis was doing to her 9 yo child anyway.

Usually they try to deport these pricks at the end of their sentence. That means that IF some blind/deaf/dumb/stupid asses decide to Parole him , EVER, he just gets paroled to be deported. Kinda purty. In the meantime, He WILL meet a lot of NEW friends in prison.

I'll try to respectfully disagree. Raping a child and being illegal is twice the crime.

Now, I don't care what country he came from--but, I sure as hell don't want my tax dollars going to feed, shelter and provide medical care--shit, he'd even have the opportunity to get an education on our buck while he's serving his time.

JMLS, I respect your opinion because it is intelligent response. However the crime he is being charged for is for raping a child NOT because he is illegal, two very different subjects. It matters not that he is illegal he would have committed a crime like this anywhere illegal or not. POS bastards of this sort are just that bastards. I cannot believe that the headlines said that he was a father....he wasn't a father, he was a rapist, plain and simple. And this girl's mother, isn't a mother, she is a criminal, for negligence in so many ways, beyond not providing proper pre-natal care. They both need to be deported, I highly doubt she's here legally. And what's more, while they are running naked across the border, several snakes, scorpions, and other venemous creatures should be released in their paths while a firing squads shoots randomly at them from behind. When they reach the border, they should have to climb a razor wire fence to get back into their own country.

As for children being able to conceive at 9, it is possible. Given the additives and preservatives that are now in our food supply, females tend to mature approximately two years faster than their mothers. Most women who have children today, can expect their daughters to begin maturing between 9-11. Advancements that we have made in our world, not only help us, but harm us as well.

If deported back to Mexico, he can and will be set free.
The US does not have agreements with any countries to uphold the sentencing of crimes committed in the US.

Mother going to jail....

A St. Anthony woman sobbed in court Tuesday afternoon as she was sentenced for endangering her 10-year-old daughter...who had a baby after being raped by the woman's boyfriend - Guadelupe Gutierrez-Juarez.

Isabel Chasarez will spend between one and ten years in the state penitentiary.

Chasarez was charged with one felony count of injury to a child for failing to obtain prenatal care for the girl. Her only request was that she see her four children who have been in foster care since she was arrested.

"I would like to see my kids," Chasarez told Judge Brent Moss. "They're all my life."

In September, Chasarez admitted to one felony count of injury to a child as part of a plea agreement. Knowing she would be deported immediately, the agreement stated that Chasarez would serve probation but Judge Brent Moss believes her sentence shouldn't be so light.

"I don't think that just turning you loose to the INS is the best solution for you and your children," said Moss.

Prosecutor Penny Shaul argued that Chasarez knew her daughter was pregnant but failed to do anything about it.

"She gave this child a pregnancy test in January of 2008...about four months before the child was actually born," Shaul said.

As Shaul told the court the state has no problem allowing Chasarez to see her children, the defendant sobbed...then told Moss her family shouldn't be punished for her boyfriend's actions.

"She did not tell her daughter to say nothing about being pregnant. Her daughter never seemed to want to admit to being pregnant," said Brent Eames, Chasarez's attorney.

In the end, Moss ordered Chasarez to go to prison for one to ten years.

"A very unfortunate event for a ten-year-old daughter who had no idea that any of this was coming partly because her mother didn't step in and help her," said Moss.

After one year, the Department of Corrections will decide if Chasarez is ready to leave prison and go back to Mexico.

If she returns to the US legally, she will be on probation for the rest of her sentence.
