    Dogs Kill Concord Toddler; Relative Jailed

    A 2-year-old boy was killed Thursday morning when he was attacked by three of his family's pit bulls, Concord police Lt. Jim Lardieri said. The child's step-grandfather was arrested following the attack, according to police.

    The attack happened at the family's home in the 1700 block of Trailcreek Court at about 8:45 a.m.

    The boy was at home with his grandmother, his uncle and his 4-year-old brother at the time, police said. Two pit bulls were in the yard and three others were in the garage. All the pit bulls have since been euthanized according to police.

    52-year-old Steven Hayashi, the child's step-grandfather, was arrested and charged with felony child endangerment, according to police.

    When the 2-year-old wandered into the garage, the three dogs attacked him, Lardieri said. The boy was taken by ambulance to a hospital where he was pronounced dead.

    I don't understand why they arrested the step-grandfather. Don't get me wrong, I don't think there's any rational, reasonable explanation for owning five pitbulls. But there's no indication the dogs were ever aggressive before (their neighbors didn't even know they had that many), and he wasn't home at the time. If someone's guilty of child endangerment, wouldn't it be whoever was supposed to be watching the boy?

    The victim of today’s pit-bull attack in Concord has been identified as two-year-old Jacob Bisbee.

    The suspect, 52-year-old Steven Hayashi, who is the victim’s step-grandpa, has been arrested on several charges. CBS5 has identified Hayashi as the man pictured above.

    The boy's stepgrandfather, Steven Hayashi, the 52-year-old owner of the dogs, was arrested on suspicion of felony child endangerment and possession of mischievous animals that result in death. He is in County Jail in Martinez on $120,000 bail. He was not home when the attack occurred.
    I wonder if there was more going on as these cases usually take longer to determine if charges will be filed.

    I hate these stories so much. The absolute terror that sweet baby boy went thru his last moments......just kills me.

    DA asks judge for murder charges to be applied:

    During a preliminary hearing in Martinez Wednesday prosecutor Mary Knox asked a judge to add a charge of second-degree murder against Steven Hayashi, a Concord man whose pack of pit bulls attacked and killed his 2-year-old step-grandson last July.

    Hayashi, 53, has pleaded not guilty to charges of child abuse, owning a vicious animal and an enhancement alleging that he allowed his step-grandson, Jacob Bisbee, to be in a situation that resulted in his death.

    Knox argued that Hayashi knew the dogs were aggressive, particularly toward the children, and had not taken adequate steps to protect the children from the dogs.

    She argued that he acted with conscious disregard to human life by keeping the dogs in the home and failing to prevent the attack and therefore should be ordered to stand trial on charges of second-degree murder.

    On the morning of the attack, Jacob's father, Michael Bisbee, left at about 5:30 a.m. to go to work.

    Hayashi left with his son a couple hours later to go play tennis, leaving Jacob, his 4-year-old brother and Hayashi's wife asleep upstairs, Hayashi allegedly told Concord police Detective Greg Rodriguez.

    Downstairs, three pit bulls were in the garage and two were in the backyard.

    Hayashi allegedly told Rodriguez that he usually locked the door from the house to the garage but that he had not locked it that morning, Rodriguez said.

    He also admitted that he did not wake up his wife, who worked a late shift and usually slept late, before he left.

    At about 8:45 a.m., Jacob went into the garage and was attacked by the three dogs inside. The two dogs in the yard were not part of the attack, police said.

    Concord police Officer Jim Nielsen testified that when he arrived at the house that morning, he found Hayashi's wife giving CPR to a toddler. He said he took over CPR until paramedics arrived, but never saw any sign that Jacob was alive.

    Jacob was taken to John Muir Medical Center, where he was pronounced dead.

    The Contra Costa County coroner's office found that he died from skull fractures and severe bleeding from multiple dog bites.

    Concord police Forensics Specialist Linda Damarco testified that she witnessed animal autopsies, known as necropsies, of the dogs and watched as a piece of Jacob's shirt and some buttons were removed from the stomach of one dog and hair, believed to be from Jacob's head, was removed from the stomach of another dog.

    In a jailhouse interview the day after the attack, Hayashi admitted that he knew one of his dogs, "Kiwi," was aggressive and said that the dogs had killed a pet Chihuahua about a year earlier.

    Knox, however, said that the dogs had also killed an Akita -- a large dog that can weigh 70 to 100 pounds -- and a pet parrot, and had showed previous signs of aggression toward Jacob and his brother.

    Hayashi has said the dogs were supposed to be family pets and were not bred for fighting.

    Contra Costa Animal Services Lt. Joseph DeCosta, however, said that when he arrived at the house shortly after the attack on Jacob the dogs appeared to be acting as a pack and were in a state of frenzy as they tried to attack his fellow animal control officers.

    The three dogs in the garage were throwing themselves against the door, DeCosta said.

    "They were physically trying to chew through the door to get to the officers," he said.

    The two dogs in the backyard were throwing themselves up against a sliding glass door that led into the living room, he said.

    "I believed the dogs to be in a state of frenzy," DeCosta said.

    Concord police Cpl. Joseph Higby testified that there was a lock and a dead bolt on the door from the house to the garage, but no child safety mechanisms were in place. The doorknob was only 3 feet from the ground with the dead bolt about 6 inches above that.

    Rodriguez testified that he interviewed Hayashi at the hospital and then again at the police station.

    During his initial interview at the hospital, Hayashi allegedly told Rodriguez his wife had asked him to get rid of the dogs because it was dangerous to have them around young children.

    "I know the animals have aggressive tendencies toward people and other animals," Rodriguez said Hayashi told him.

    Hayashi allegedly told Rodriguez that Kiwi was particularly aggressive and was not allowed around the children.

    Rodriguez said Hayashi told him that in the week before the attack, Jacob had become interested in the dogs and would stare at them through the sliding glass door in the living room. When Kiwi saw him, he would allegedly bark at him aggressively and charge the door.

    During another incident, Hayashi said he was holding Jacob and Kiwi jumped up and nipped Jacob, Rodriguez said.

    Hayashi allegedly admitted to Rodriguez that he knew the dogs were aggressive and that was why he tried to keep them away from the children.

    Hayashi's wife, Leticia Hayashi, who testified for the defense, claimed that Jacob's father left the house at 5:30 a.m. every day without discussing childcare arrangements with anyone.

    She said she worked a late shift at work, so her husband would usually take care of Jacob and his brother in the mornings when their father "abandoned them".

    She said she had asked her husband to get rid of the dogs because she was tired of cleaning up after them, not because they were vicious.

    "They bark, but they're not vicious," Leticia Hayashi said.

    She claimed she had never seen the dogs behave aggressively toward anyone in the home.

    She denied telling a police officer at the hospital that she knew something like this would happen and that it was only a matter of time.

    She denied telling the officer that Jacob and his brother could reach the locks on the garage door and that she had asked her husband to put the locks higher up so they would not be able to reach them.

    She claimed that Bisbee moved into their house without permission and would often leave children in the house without telling anyone.

    Lauser also called Bisbee to testify, but he did not show up.

    Contra Costa County Superior Court Judge Clare Maier heard the case Wednesday and is expected to make her ruling Thursday morning.

    There were so many signs of aggression, many incidents and even one as he held little Jacob and the damn dog, still nipped at him?!!
    During another incident, Hayashi said he was holding Jacob and Kiwi jumped up and nipped Jacob, Rodriguez said.
    What a stupid, foolish man to put any favor over those damn dogs instead of the well being of his grandkids, negligent beyond understanding. My God, I hope he is given a chance to feel what the horror must have been like for 2yo little Jacob as he was malled to death by 3 vicious dogs. Rot. He deserves what punishment he faces.
    I will say I don't agree that all the dogs were euthenized, including the 2 in the backyard that were not part of the attack. Makes no sense. About as much sense as this idiot who left aggressive dogs within contact with children.

    I totally agree, and I think they should charge the childrens' father- who decided it was ok to leave the house every morning without making arrangements for his children. Afterall, the father is the one who moved himself and his 2 young sons into a home with 5 aggressive pitbulls. That's not an excuse for the grandmother & grandfather; if they really had a problem with their son & grandsons' living in their home, they should have kicked them out. Either that, or make their home child-friendly (ie:get rid of the dogs!). They can't have it both ways.

    The father is his step-son and the boy was his step-grandson. I guess he just didn't give enough of a shit about the kids to take, oh, say, ten minutes to put a deadbolt at the top of the door.

    Personally, there's nothing I value more in a "family pet" than the tendency to kill other animals and "nip" children. We've been talking about getting a dog recently; my husband likes labradoodles for the breed (F1B is his current preference) characteristics - low-shed, hypoallergenic, labrador personality - although he thinks they look stupid.

    Me, I say fuck that. I want a proper dog, something that will eat my cats and possibly maul my child as she's pouring her breakfast cereal. Give me another reason to haul my ass out of bed pronto in the morning, you know what I mean? I was really into presa canarios for a while, and then the Jayelin Graham story put me on to cane corsos, but it's stories like this that make me think, no matter how shitty the owner, you just can't beat a good old-fashioned frenzied pit bull.

    Poor, poor little guy. I just hope it was quick.

    Judge denies request to up charges to second-degree murder
    A judge ordered a Concord man Thursday to stand trial on charges of involuntary manslaughter in connection with the fatal pit bull-mauling of his 2-year-old step-grandson.

    Contra Costa County prosecutors originally charged 53-year-old Steven Hayashi with felony child abuse and owning a mischievous animal that caused death. But in June, they asked Superior Court Judge Clare Maier to increase the charges to second-degree murder, citing as precedent the 2001 fatal mauling of a San Francisco woman that led to the murder conviction of a neighbor who was keeping the two dogs involved in the attack, Marjorie Knoller.

    On Wednesday, Maier said that although there were similarities between the two cases, there was "scant evidence that Hayashi's dogs made repeated attacks toward humans."

    In contrast, she said, Knoller's dogs had been involved in 30 known attacks on animals and humans before the fatal mauling.

    Hayashi knew that the dogs that mauled his step-grandson were aggressive, Maier said. But she said she had heard no evidence that he had been responsible for the young boy getting into the garage.

    The judge said she was using her discretion, however, to increase the original charge to involuntary manslaughter, which is defined as being responsible for a death but without intent.

    Outside court, prosecutor Mary Knox said she was not disappointed with the judge's ruling, and noted that involuntary manslaughter carries a stiffer sentence than the original charges. Hayashi could get a 10-year term if convicted.

    I agree there should be more people charged. Knowing they were aggressive dogs, if they chose to keep them, they should have at least been in a crate while the kids were around.

    We have 2 dogs. (I'm sure I've told this story before). One growled and cornered my son a few years back because he tripped over her. She is not an aggressive dog. She is not a mean dog. But she is obviously not a kid dog. She lives in our garage now. My husband has built her an area that is hers. She usually goes out by herself and is much more happy. We did what we could to keep her in the house including trying a puppy "downer" to help curb her anxiety around kids. It worked wonders but her liver started to fail. We stopped the meds and put her in the garage as a last resort. Every now and then, we let her out with the kids, but it's never for very long. She lets us know when she's had enough. She is still part of our family which is why we choose to keep her. We take the precaution needed to keep her, the kids and other dog separated and it works fine. She is also on her very last leg of life. She is pushing 14, which I believe plays a big role in her not wanting young children crawling on her or playing rough. Point is, she has never bit any of my kids, but I will not wait until she does to take precautions.

    I hate stories like this one. It is a horrific way for any child to die and so preventable.
