    12-Year-Old Mo. Boy Arrested In Killing Of Parents

    OSAGE BEACH, Mo. -- A 12-year-old boy was arrested on suspicion of killing his parents Monday night, Miller County Sheriff's Department said.

    Around 11:50 p.m. Monday, police were called to the Palace Lane Estates mobile home park in Kaiser, Mo. Police said the boy called his grandmother, who lives in Kaiser, and then 911 to report that he shot his mother and stepfather.

    The mother and stepfather were found with multiple gunshot wounds.

    Five other children live in the home, police said, but were not at the house during the shooting. Police said the boy attended the School of the Osage.

    The bodies of the mother and stepfather are at the Boone County Medical Examiner's Office, where they will undergo autopsies.

    Currently, the 12-year-old is being held in secure detention. An update this afternoon said the Juvenile Division received a petition stating that the 12-year-old committed two acts that would be considered first degree murder if committed by an adult and additional charges are possible.

    What the fuck was going on in that home? A mobile home with 2 adults and 6 children? (Maybe it was one of those double-wides...if it was a single, I can see why with that many folks that some shooting was going on...damn)

    Charges Filed Against 12-Year-Old Boy In Parents' Killing
    OSAGE BEACH, Mo. -- A 12-year-old boy was arrested on suspicion of killing his parents Monday night, Miller County Sheriff's Department said.

    Two first-degree murder charges have been filed against the boy in the shooting deaths of his mother, Rachael Duncan, and stepfather, Jason Duncan. The 26th Judicial Circuit's chief juvenile officer, Tammy Walden, told The Associated Press on Tuesday there will be a hearing later on whether the boy will be tried in adult or juvenile court.

    12 year old plus 5 other kids in article equals 6 kids. How the hell does a couple get out of having all 6 of their kids on any given night? Isn't there place of residence a little small for all those people?
    This boy must have been pretty desperate.... he even called his grandma and 911 afterwards...

    Would like to know more on this one but it sounds like he may have been justified f he was really abused and feared for his life.

    6 kids in a trailer? I have 6 kids, my 3 story house isn't big enough for them. lol

    And- He's 12 years old! They're seriously considering trying him as an adult? He's not a teen about to be an adult,he's not even a young teen... shit, he's not a teen at all, he is a full fledged CHILD. The entire thing sounds screwy to me.

    Family members are standing by the 12-year-old accused of killing his parents. They want him tried as a juvenile, rehabilitated and given a chance at a future. The boy’s first hearing was an emotional day for Rachel and Jaeson Duncan's families.

    A judge ruled the boy must stay in juvenile custody until his certification hearing. Rachel Duncan’s uncle Terry Rowden says she was more like a sister to him. They were only three years apart. “He was about the sweetest and lovingest one of the bunch,” Rowden said. That's how he and a handful of other family members described the boy investigators say killed his parents inside a Kaiser, Mo., mobile home. “The last year or so he's gotten around the wrong crowd at the lack he is in a bad environment there at that trailer park,” Rowden said.

    Rowden describes 35-year-old Rachel Duncan as generous and loving. He says the boy’s stepdad, 31-year-old Jaeson Duncan was hardworking and strict. “He was probably a little heavy handed, but I never saw any bruises,” Rowden said. “I asked the other boys, and they say he never punched them or anything like that. I believe he was trying to discipline, straighten this boy up and keep him off the road he was heading down.”

    Instead, the boy sits inside the Mary Dickerson Juvenile Justice Center. He is possibly facing murder charges as an adult. The looming question is why. “I'm not sure that he knows,” Rowden said. “His only answer is that he got mad and it doesn't make any sense to anybody I know.”

    The family says the boy is sorry. When they visit, they say he cries constantly. After losing two lives, the family says they hope he can be rehabilitated and get a chance at a future. “We are a Christian family. We believe in forgiveness. We believe forgiveness is a necessity,” Rowden said. “Christ forgave the worst of us. That's the way we got to do it.” Rachel’s uncle admits it was not easy at first. “I was initially angry when I heard the evidence,” Rowden said. “Until I saw that baby walk in and cry on my shoulder. He is a baby. He is a lost baby.”

    The family says the boy had one request to say to the media. “Please stop putting it on the news. He doesn't want everyone to hate him, and he is very sorry,” Rowden said.

    No date is set for the certification hearing to decide if the 12-year-old will be tried as an adult.

    Miller County Judge Kenneth Hayden decided not to certify the 12-year-old suspect.

    The defendant will remain in the juvenile court system.

    Hayden said he considered the 12-year-old’s background and education. He took into account the child’s record, environmental situation and the viciousness of the crime.

    Hayden said crime was not part of the suspect’s repetitive nature.

    Hayden said the juvenile trial will start Wednesday afternoon.


    The 12-year-old boy suspected of killing his mother and step-father early July is in court Wednesday for a certification hearing.

    The 12-year-old was wearing jeans and a shirt without handcuffs and shackles in court during the hearing. The defendant’s biological father was there with him.

    The hearing started at 1 p.m. Wednesday and took a 15 minute recess around 2 p.m. Before the recess six witnesses took the stand.

    Miller County Deputy John Wilson, the first officer on the scene, said the defendant’s step-dad Jaeson Duncan was found shot in the back in the mobile home’s doorway. The defendant’s mother was found shot in the bedroom doorway.

    Wilson said neighbors told police they saw the defendant hide something under a shed. When police investigated they found a .22 caliber handgun and rifle. Wilson also said the neighbor behind the defendant’s home said the boy asked to spend the night before the shooting, but they said no.

    School of Osage Middle School Principal Tony Slack said the defendant had failing grades and needed a lot of positive reinforcement. Slack said when the defendant was younger he had A’s and B’s, but recently the defendant was getting failing grades. The defendant was also getting in trouble for talking back to teachers and had a few run-ins with other students.

    Department of Child Services Julie Lester said the defendant “had a complex family with multiple problems. Lester continued to say the defendant’s home life was chaotic.

    Juvenile services Dr. Patricia Carter said she met with the defendant twice and each time he exhibited rational manners. Carter also said the defendant’s sexual abuse caused functioning to be delayed. Carter said there are services available to rehabilitate the defendant in the juvenile court system.

    The courtroom was filled with about 50 people, most of which were the defendent's family members.

    Sounds like he survived horrible abuse, horrible enough to affect his schoolwork, behavior and ability to relate to others. These are the markers that should alert adults to child abuse. Acting out is all most kids can do; abusive families ingrain "don't think, don't talk, don't feel" in the kids. A kid who can't take the abuse anymore, can't make it stop and can't ask for help, may kill the abuser/s. Not as punishment, just to make it stop. Some kill themselves. Just to make it stop. I'll reserve judgment till more info on the family comes out....but that trailer sure looks trashy.

    A 13-year-old boy has admitted shooting his mother and stepfather to death in their mobile home in Kaiser, Mo. in July.

    The boy made the admission through his attorney Wednesday after a judge declined to certify the youth to be prosecuted as an adult.

    Miller County Circuit Judge Kenneth Hayden committed the boy indefinitely to the state Division of Youth Services. The judge said he believes the boy can be rehabilitated.

    The boy was 12-years-old when he shot 35-year-old Rachel Duncan and 31-year-old Jaeson Duncan at their home in Kaiser, near the Lake of the Ozarks.
    Update: Wednesday, Nov. 17 at 6:25 p.m.

    The 13 year old boy sat between his biological father and attorney during the hearing. He was dressed like most teenagers in blue jeans and a long sleeved t-shirt.

    He sat showing no emotion for most of the hearing until his step father's sister read a letter to the court.

    In that letter she talked directly to the boy, saying, “I don't hate you but I'm very upset with you”.

    She went on to say "I hope you find god", and ended calling for some sort of punishment saying, "You don't need a slap on the hands because you committed cold blooded murder".

    The boy and his father were both brought to tears.

    Then the accused's older brother spoke, asking the court to forgive his brother.

    He said the boy told him he would he would give his own life to bring back his mom and step dad.

    The boy's attorney then turned to the Duncan family and said the boy was genuinely sorry, the boy shook his in agreement.

    The only time the boy spoke throughout the hearing was when the judge made clear to him that the laws for adults are far different, to which the boy said "yes your honor".

    The 13-year-old boy who admitted to shooting his mother and stepfather to death at their Kaiser home in July faces an indefinite road to rehabilitation in the Missouri Division of Youth Services. At the conclusion of Austin Pinion’s adjudication hearing Wednesday afternoon in Tuscumbia, Judge Kenneth Hayden told the boy that he believes he can become a productive member of society

    “I sincerely believe that you can be rehabilitated (...) but there is no promise or guarantee of that,” Hayden said.

    The teenager, who was 12 at the time of the double homicide, faces an indefinite detention sentence within the juvenile justice system. He will be the subject of counseling, therapy, education, and vocational services in a secure care center. His treatment program will be specified to his individual needs. The Division of Youth Services can continue treatment up until the boy’s 18th birthday.

    “My opinion is because of the severity of his acts, I strongly believe the division would petition to have him stay beyond his 18th birthday,” 26th Judicial Circuit Chief Juvenile Officer Tammy Walden testified at the hearing.

    The Division of Youth Services could take the case back to court to allow for Pinion’s treatment schedule to be extended to his 21st birthday. For the five months between his initial arrest and this week’s court hearing, Pinion stayed at a Camden County detention center.

    Walden testified that Pinion did not commit any serious rules violations during his close to five month stay at the Mary Dickerson Juvenile Justice Center in Camdenton. She noted that Pinion had some difficulties adjusting to the structure of the detention center, but that he corrected his behavior when staff members identified minor rules violations.

    Two educators from School of the Osage took the witness stand to testify about Pinion’s background. Osage Middle School principal Tony Slack noted that the child’s grades slumped over a three-year span from third grade to sixth grade. Discipline problems led to some incidents of acting out.

    “He sought out a lot of attention... wanted some positive attention from people,” Slack said.
    Slack described how the boy had some conflicts with other students, the worst was a “pushing match.”

    Assistant Principal Brad Yoder noted that many of his office visits with Pinion ended positively.
    “He might be upset at first, but oftentimes he would settle down and be more forthcoming,” Yoder explained.

    Walden testified that Pinion had not shown a reputation for violent behavior in the past and that his case marked the first time he had ever been referred to the 26th Judicial Circuit for criminal action. The family had a history of calls to the Division of Youth Services hotline, and serious allegations of abuse surfaced in 2006 and again in 2008.

    “(Home life) was extremely chaotic for periods,” Walden said.

    A psychologist established the teenager understood his actions, but was immature for his age. “I think we have to consider his educational background and history. And although not the best student in the world (...) he is a candidate for rehabilitation,” Judge Hayden said. “He has the educational and the learning capabilities for rehabilitation.”
