    Christian Perez tortured a baby

    HAYWARD — A Hayward man accused of subjecting an infant to "unimaginable agony" by allegedly submerging him in scalding water was charged with four felonies Monday, authorities said.

    The 16-month-old boy is in critical condition with second- and third-degree burns covering 70 percent of his body, Lt. Christine Orrey said.

    Christian Perez, 20, was charged with child abuse, child endangerment, torture and aggravated mayhem. He's been held without bail at the Hayward police station since his arrest Thursday, Orrey said.

    Christian Perez told Special Victims Unit detectives that the baby suffered burns while he was giving him a shower at his home on the 2700 block of Melbourne Avenue, an explanation they thought to be inconsistent with the boy's injuries, Orrey said.

    Christian Perez said he called his sister and brother-in-law, Patricia Perez and Jose Gamez, when the baby had a seizure, Orrey said.

    When the two arrived, they went to a nearby Walgreens to purchase burn ointment, despite knowing they were within blocks of a Kaiser Permanente hospital, Orrey said.

    Video surveillance shows Christian Perez and Gamez spending 15 minutes shopping for the burn ointment at Walgreens, Orrey said.

    After attempting to treat the baby at the home of Gamez and Patricia Perez on the 1100 block of Tigen Way, they started driving to an unknown location. En route, Patricia Perez held the baby up and said, "He's going to die," prompting Christian Perez to call 9-1-1, Orrey said. He added that the call was placed at 1 p.m., two hours after Christian Perez's neighbor heard a baby's screams coming from the Melbourne address.

    Children's Hospital forensic pediatrician, Dr. James Crawford, told police it was "very apparent that the baby was intentionally immersed in water hot enough to cause second- and third-degree burns over 70 percent of his body," and that the baby likely suffered "unimaginable agony."

    Prosecutors have charged Patricia Perez, 21, and Gamez, 22, with felony child endangerment.

    I agree Michelle. This wasn't a flash of anger kind of child abuse. He had plenty of time time to think about what he was doing while preparing to boil a baby. The only right thing to do in this case is boil him alive. And for the other two, jail is completely in order. They tried to let a baby go on suffering to protect their POS family member. I don't give a fuck who it is, if someone hurts a baby, you call the police and get the baby some real help, not ointment from walgreens. Dumbfucks.

    Ooooohhh!!!! That excuse pissed me off big time! I had no experience when it came to my first child. I KNOW better than putting him in fucking hot water! No experience at changing diapers is UNDERSTANDABLE......but put baby in BOILING water?? This little fucker knew what he was doing.

    When I first saw this I couldn't post. I was so unbelievably angry about what was done to this poor baby. If you wouldn't get into a tub of water that hot, WHY would you put a baby in there? Fucking jackass was TRYING to hurt this baby, of that I have no doubt.

    I suffered 3rd degree burns as a toddler. from hot water. It was an honest accident-my mother still can't talk about it and I am 30. My dad said that my skin came off when they attempted to remove my clothes to assess the damage. I carry some very gruesome scarring as a result. I am also a little bit crazy when it comes to kids being anywhere near hot water.

    First of all, what kind of a person puts a baby in scalding hot water? If that wasn't bad enough, they thought they could get away without medical treatment? I can't believe that these people tried to treat these burns, which can quickly become life-threatening, with burn ointment!!! Jesus wept, google can give better advice than that!

    yeah - i have worked with 3 kids randomly in the past 20 years who have been burned in/with boiling water by their dads or other "men" in their lives. It must happen more than we realize. and there must be a reason it is the rage-punishment of choice for some individuals. all 3 were babies or toddlers when it happened. perhaps they think they can use the bath-was-too-hot excuse? can't bear to actually hit them? i jsut don't know.

    That is really odd that you have worked with 3 kids scalded/burned by water by men. It seems like a much more common occurrence when women do it to their children.

    I am not doubting you but it seems more women than men abuse children that way from what I have seen.

    Really? In my personal experience as a nurse, I never saw a baby scalded by its mother or another woman, but I saw at least four that had been immersed or thrown into very hot water by their mother's male companions.

    One of them actually brought the baby in and told me that "the bitch kept telling me to give the baby a bath while she was at work, and I kept telling her that I didn't want to."

    Like that was a reason to run the water all the way on hot, then dump the baby in it. The others were all toileting accidents that got "cleaned up" by putting the child in a very hot shower or bath, and only one was the biological parent of the child who was hurt.

    Drownings, now, are more likely to be mom, in my experience.

    Christian Perez, 22, faces 25 years to life in prison when he is sentenced on March 25.

    Alameda County Deputy District Attorney Stacie Pettigrew said it was the worst case she'd ever taken to trial. An emotional jury convicted Perez of the crimes on Thursday.

    "(Eli) was placed in 150-degree water for a matter of a few seconds," Pettigrew said. "He was burned from belly button down to his toes. All of his skin came off almost immediately. "... The baby would have been in unimaginable agony as they drove around taking their time trying to cover it up."

    Perez was arrested in April 2008 after Eli -- his girlfriend's baby -- was scalded in a Hayward home. Perez, his sister Patricia Perez and her husband, Jose Gamez, drove several miles to a Walgreen's to get burn ointment and didn't seek medical treatment until the baby had a seizure, Pettigrew said.

    "It wasn't until the baby was obviously dying that they called 911," she said.

    Police said at the time that by looking at pictures of the damage done to Eli's body, it was apparent that the injuries were far too serious to be treated at home.

    Eli died two months later at Shriner's Hospital in Sacramento.

    Patricia Perez and Gamez were convicted last year of misdemeanor charges of being accessories after the fact and were sentenced to probation, Pettigrew said.

    Christian Perez also was convicted of two charges related to an earlier child abuse incident, which involved the beating of a 2-year-old girl.

    Defense attorney LeRue Grim said Perez testified that his father, who also was living in the house, was responsible for both the beating and Eli's death.

    "He thinks the beating was the result of her disturbing his father while he was watching TV," Grim said. "And (Perez) loved Eli like a son, but his father didn't get along with him. "... I don't think anyone but (Perez) and his dad know what happened."

    Pettigrew said Perez didn't display any remorse, but that jury members had broken down because of the nature of the case.

    "You get a little bit stale," he said. "There's a tendency to react a little dumbed. But I think he did show remorse. I've seen him cry several times when talking about little Eli."

    Maximum sentence for Hayward man convicted in baby scalding death
    HAYWARD -- A judge told Christian Perez to "get ready to enter the gates of hell" as he handed down a maximum sentence of 30 years to life in prison for scalding an infant to death and savagely beating a toddler.
    erez, 23, was convicted in January of torture and second-degree murder for the death of 18-month-old Eli Rojas, as well as child abuse charges stemming from the beating of a 2-year-old girl in 2007 that covered her with bruises and laid open her scalp, which needed to be stapled shut.

    "If you think what you did to those babies was bad, wait until you get to prison," said Alameda County Superior Court Judge C. Don Clay at the Friday sentencing. "There is nobody in prison who likes and can accept children being hurt in this fashion."
    Perez was arrested after Eli was taken to the hospital, scalded from his bellybutton to his toes, after being immersed in water that experts said must have been 150 degrees.

    Instead of calling for help, Perez, his sister Patricia Perez and her husband, Jose Gamez, drove several miles around Hayward, going to a drugstore to get burn ointment. They sought medical treatment only when the baby had a seizure "and was obviously dying," prosecutor Stacie Pettigrew said.

    Perez had been watching over Eli -- his girlfriend's child -- when the scalding occurred. The baby died two months later at Shriner's Hospital in Sacramento.
    Pettigrew said a lack of evidence gave Perez "a pass" after

    the 2007 baby beating, but "instead of taking that pass, 15 months later he did what he did to Eli."

    Jurors -- three of whom returned to court Friday to watch the sentencing -- said photo evidence was unbearable, and Clay said he also had trouble looking at the images in what he called "the most disturbing case I've ever had."

    He cited a doctor who, looking at the photos, asked what happened to the first layer of Eli's skin.

    "The pink part of Eli, that wasn't skin -- that was the muscle underneath the skin," Clay said.

    The judge said after Perez was arrested, he was heard speaking in Spanish to somebody over the phone, asking, "Did you get the stuff out of the trash?"

    "That's where the skin went," Clay said. "They peeled his skin off and put it in the trash. That's sick, disgusting and should never happen."

    He said Perez committed "cruel, vicious and callous crimes against little babies," called him a liar for testifying that relatives were culpable for the crimes, and said he never accepted responsibility.

    Jurors agreed, and said Perez's demeanor throughout the trial never appeared remorseful.

    "How do you do it?" asked juror Jim Graydon, who dabbed his eyes during the judge's admonition. "How do you do it and just show no emotion? Those were beautiful little children. I couldn't do that to any animal, and I'm a hunter."

    Pettigrew said Eli was an inquisitive and intelligent child who loved playing with his toy tool set, mimicking adults he saw working on projects with a miniature version of the real tool. She said the case struck close to home for everyone involved, including paramedics, doctors, law enforcement officers, jurors and the District Attorney's Office.

    "I think of Eli every time I run hot water, burn myself cooking or give my own children a bath," she said. "I will never forget this case, and the jurors will never forget."
