The defense wants to prove that Cindy knew for quite some time that the car smelled like a dead body. This would make an excited utterance impossible and the call inadmissable.

The State was showing the difference in the 3 calls and pointed out that Cindy had just found out for a fact that Caylee was missing for 31 days...therefore tying the smell to Caylee and making the excited utterance that "it smells like a dead body in the car" which would make the call admissable.

The judge will rule on whether or not he believes through the evidence that Cindy made an excited utterance when making that statement which would allow the call and be really bad for Casey's defense.

The defense is arguing that since they can prove and show that Cindy knew that the car smelled like a dead body all day.......it could not be an excited utterance.

The glasses thing and I assuming your talking about Mason? I t wuld bother me except I have the same problem, whether I need to have the glasses on or off depends on what I'm looking at. I can't see up close but can further away so if I'm rading I need them if I'm driving I don't because I can't see further off wiht them, he seems to have the same problem in reverse, he sees better up close and needs them more for looking in the distance.

Did that make sense?

Anyway I went to CNN to finish the hearing and they disappeared at 5:00, so can anyone tell me what Judge Belvin decided since they weren't coming back from break until 5:05.

I just listened to the 2nd 911 call tape again. It's funny what you forget sometimes. I don't think I remember cindy saying June 7th was the last time she saw Caylee...I thought they always stuck to June 9th until the Fathers day tape came out... She clearly says June 7th..

OMG. Okay, I tried getting on during Cindy and Lee's testimony but D'D wouldn't let me. SOOOOO....WHAT.THE.FUCK. was up with Lee mouthing, "I LOVE YOU." to Casey? Omg, I think I threw up a little when I watched that shit! I can't believe he had the balls to do that. I knew, knew, KNEW he would be the one to make Casey cry. He was so cocky, the way he strutted around the courtroom in jeans and a polo. Cindy was much more subdued than I thought she would be. She has obviously been coached. She tried to lie but there wasn't much dancing she could do, which was refreshing. I kept waiting for her to yell, "What's the relevance?!" Baez was a pig as usual, Mason couldn't be understood, and the only time I saw Casey perk up was when the two girls came and sat down with her during the recess. She was animated, acting like a school girl. They were obviously discussing her fucked-up tooth, because she was pointing to it and saying, "Just one." Glad the judge denied the motion and the 911 calls will be allowed. Argh! Now we just need to get on with the trial!

I am SO mad,,my screen kept freezing and I hardly got any of it,,,I am so pissed!!! I am going to reserve comment till after I get she see the whole hearing. now I know what a guy means when he says "cocktease", I waited months for this,,oh well, I can wait a little longer.
