State Calls Casey Defense's Motion 'Glaringly Insufficient'

ORLANDO, Fla. -- Prosecutors in the case against Casey Anthony are asking Judge Belvin Perry to strike defense challenges to tests for chloroform in Anthony's trunk and months of plant and root growth around Caylee Anthony's remains.

In a motion filed Tuesday, prosecutor Jeff Ashton wrote that the techniques used to test for chloroform "have been routinely accepted as evidence in courts throughout the State of Florida."

Ashton called the defense motion that seeks to strike the evidence "glaringly insufficient."

"It sites no scientific authority which would call into question the general acceptance of the standard tests used by the Federal Bureau of Investigation and the Oakridge National Laboratory," Ashton wrote.

As for the plant growth, Ashton said that the state's expert has 60 years of experience in the field. He said jurors should be able to make their own decisions about whether his claims are credible.

Both issues are due to be argued in court next month. WESH.com will stream those hearings live.

Anthony's murder trial is scheduled to begin May 9.

Thanks Angel for the PDF of the e-mails between Mason and Baez and the transcription service. What Mason did is called Bait and Switch, he allowed poor Mr Stogsdill to believe one thing while Mason & Baez were planning to do another. Mr Stogsdill didn't realize what a bunch of crooks he was dealing with. I'm guessing that the DUH-fense thought that he would cave and sign the JAC papers when he thought he wasn't going to get paid, but he fooled them and called them on their bluff. Mason can say till he blue in the face that it was not intentional but we all know better than that, he was deliberately trying to cheat the man out of his fee and then went to the judge and lied saying Mr. Stogsdill was trying to cheat them. I really hate cheaters and liars.

OT but today I started to buy one of Kathy Reichs' novels and put it back cause I couldn't stand the fact that she was helping the Duh-fense in this farce. I probably won't buy another of her books for a long, long time.

I love the Linda Drane Burdick signature on the .pdf file. She is bold and confident. Jose needs to be sanctioned. No supporting attachment and it is a vendetta against kathi Belish on Valentines Day no less. I believe that is how petty the Duhfense is. If Perry doesn't take action on this and strike this down I lose total respect for him and he is trying my patience by not sanctioning. I want a bar hearing before this case not after. Linda Burdick has laid it out why there should be no more ignoring of the court order timeframes and you would think by this time that the Dumbfence would have learned to attach supporting documentation after being told that how many times that their motions were submitted incomplete. Can't they afford a good paralegal??? Guess not they have Michelle Mudina mucking things up, though an attorney seems she is serving as a secretary. Guess good help is hard to find and so are good jobs for incompetant personnel. Perhaps Ms. Mudina is exactly in the job she deserves to be and with the Infirm that fits her abilities and skill level!

I was watching the award ceremony hosted by President Obama yesterday and people like Warren Buffett, and Stan the Man (baseball player) and a few others got their Medal of Freedom awards for whatever outstanding things they did in life. Blatently missing was Casey Anthony receiving her "Medal of Freedom" for being the MOTY .. "Mother of the Year" I guess Baez and Mason would say miscommunication. Perhaps Cindy couldn't attend the ceremony because she was concocking another lie or perhaps having her mop cut ... and we know know why Casey couldn't attend the FREEDOM ceremony!!!! It's not funny. It's a total tragedy but I just had to say this. MOTY my ASS!!! Nightmare from Hell is more like it every day!

You know just like Casey is a 2.56 whore... Reich's novels are readily available for a dime and a quarter at yard sales... HINT HINT.. That's my best source of books.......Eventually, they all end up there or on ebay cheap in collections!!!!

OK I lost my post. Isn't JB not DP qualified and that's the reason for the other attorneys... meaning representation really is in their hands, not his.

Well I was at a Baptist Thrift Shop and balked at paying a $1.00 for it. And a hardback, too. She just pissed me off getting all up the Anthony case Koolaide and then just kinda wandering off without producing anything. Not that I think she has anything to produce, just if you say you're gonna do something, do it. And also I do think it was The Duh-fenses responsiblilty to hold her (and others) feeet to the fire to produce whatever it is but really you can do it without somebody begging you to do it. Maybe I'm looking at this the wrong way but if I thought I was right and the Prosecution experts wrong then I would be chomping at the bit to get my say in. I think her and the possibley the rest of them just wanted the extra 15 minutes they thought they were going to get from jumping on the bandwagon with the Duhfense. I think it may have back fired for some of them, like Mr. Henry Lee, working for a box of oranges, indeed! I'm going to cook supper and calm down, check back later!

In order to represent a client charged in a capital first degree murder case, the Florida Supreme Court requires that the attorney be "capital qualified." Being a capital qualified lawyer is the only way an attorney can ethically represent someone charged with first degree murder, unless the death penalty has already been waived on the record. Lawyers who are fully capital qualified meet the requirements of Florida Rule of Criminal Procedure 3.112, which requires at least five years of criminal trial experience, prior experience as lead counsel in serious and complex trials, including murder cases, as well as additional capital defense education requirements, familiarity with the use of expert, psychiatric, and forensic witnesses and evidence, and, importantly, trying at least two (2) death penalty cases to completion before a jury as co-counsel. In addition, capital defense lawyers must be able to provide "high quality legal services", and "perform at the level of an attorney skilled in the specialized practice of capital representation, zealously committed to the capital case, who has adequate time and resources for preparation." This is crucial because a capital case is unlike any other in the law, as "every task is more difficult and time consuming when the client is facing execution." Due to the irrevocable nature of the death penalty "counsel must make extraordinary efforts on behalf of the accused", and must limit his or her caseload, and be familiar with the local practices and procedures in the jurisdiction. These minimum requirements, promulgated by the Florida Supreme Court are, absent exceptional circumstances, absolutely essential in order to assure that the client receives the heightened level of effective assistance of counsel expected and required in capital cases. There are, and rightly so, only a very small percentage of criminal lawyers who are "capital qualified" according to the national A.B.A. and Florida guidelines.
Lawyers who have never tried a capital case in any capacity, much less as lead counsel, currently advertise with the key words "death penalty lawyer" all over the internet; thus, it is extremely important to research or inquire if an attorney being contemplated for representation on a first degree murder case actually meets the specific qualifications. In addition to the above criteria, Rule - 3.112(f)'s - requirement of knowledge of the practice and procedures in "the criminal courts of the jurisdiction" where the trial is to occur, and its requirement that attorneys limit the number of death penalty and other cases he or she is handling at any one time, is designed to insure, as much as possible, the delivery of "high quality" legal services on behalf of a capital client. When life hangs in the balance, we should expect no less.

ORLANDO, Fla. -- Judge Belvin Perry approved the spending of moretaxpayer money for Casey Anthony's defense Wednesday.

Anthony's defense requested $136.30 for a transcript of a Nov. 3 deposition of Dr. Michael Sigman, who specializes in forensic trace analysis.

Anthony was declared indigent in March. A state agency now doles out funding for her defense. Requests must follow the Justice Administrative Commission's price guidelines and be approved by Perry.
