Key Hearings In Casey Anthony Case To Determine Course Of Her Trial

Casey Anthony is back in court this week for hearings to determine whether she should face the death penalty, where her murder trial will be held, and what evidence the jury will hear.

Anthony, 24, is accused of killing her daughter, Caylee, who was 2 when she disappeared in June 2008. Caylee's body was found that December in a vacant lot near the Orlando, Florida, home where she lived with her grandparents.

At this week's hearings, Anthony's attorneys will argue to take the death penalty off the table. Her defense team also will argue to keep some evidence it considers "gossip" away from the jury. And, the defense has asked to move the case to an area of Florida where there has been less publicity about the case.

Rulings made on a tall stack of pretrial motions will likely have a significant impact on the trial, which is scheduled to begin May 9, 2011.

Circuit Judge Stan Strickland, who had been presiding over the case, has been replaced with Chief Justice Belvin Perry Jr. Judge Strickland took himself off the case after Anthony's attorneys claimed he had improper communications with blogger "Marinade Dave."

"Miss Anthony cannot get a fair trial by an impartial jury in Orlando because of extensive, inflammatory, and prejudicial pretrial publicity in this case," the defense argued in court papers seeking a change of venue.

Under Florida's open records law, prosecutors released tens of thousands of pages of witness statements, forensic reports and computer and cell phone records gathered by police. Evidence includes dozens of photos of Anthony and her friends partying, text messages, 911 calls, witness statements to police and Anthony's letters and notes to fellow inmates at the Orange County Jail.

Anthony's defense team led by Orlando attorney Jose Baez is fighting hard to keep the "party photos" out of the case, saying they are prejudicial and prove little.

The photos show Anthony at a nightclub and a residence in the Orlando area, dancing and drinking with friends. Automated dates on the images show two of photos were taken after the date Caylee was reported missing. Investigators retrieved the photos during a search of Anthony's computer.

In a related motion, the defense asked to exclude from the trial "hearsay evidence, gossip and innuendo." The defense particularly mentions television interviews potential witnesses have given since Anthony was arrested, as well as their sworn statements to law enforcement.

Both they say include gossip about Anthony that if allowed would prejudice the jury and violate her right to a fair trial.

The defense is also seeking to keep out of trial the 911 call Anthony's mother, Cindy Anthony, made on July 15, 2008, reporting Caylee missing, calling it "hearsay."

During the call Cindy Anthony screams that her daughter's car smells like a corpse.

Prosecutors usually argue under such circumstances that the law allows the jury to hear an "excited utterance." It is an exception to the hearsay rule, and it is allowed as evidence at trials because the statement can be considered spontaneous and therefore trustworthy.

Several legal motions challenging the death penalty allege that the prosecution is acting in bad faith.

One motion contends that prosecutors are seeking death against Anthony because she is a woman. The defense argues that focusing on Anthony's lifestyle before she was arrested is gender bias. The defense maintains that Anthony is facing more serious charges and harsher punishment than a man in the same position would receive.

"Women who are accused of violent crimes are tried not only for the facts of the crime, but also for their non-conformity with traditional gender expectations," the defense argues in its court papers.

The defense also alleges that prosecutors had sought the death penalty to bankrupt the defense and prevent Anthony from having the attorney of her choice.

The defense maintains that prosecutors had originally said they would not seek death in this case but reversed that position in March 2009 when they learned that Anthony had $205,000 for her defense.

The money came from ABC News for the licensing of photos and videos, Baez testified during a previous hearing.

The two-day hearing began Monday and ends Tuesday.

Judge Perry ruled today that the trial will take place in Orlando, but that 12 jurors and 6 potential alternates will be chosen from somewhere else in Florida. Once they are chosen, they will be sequestered, Perry ruled.

Judge Perry also placed the attorneys in the case under a gag order.

The judge deferred ruling on a stack of other motions, most involving what evidence prosecutors can present to the jury.

The judge also delayed ruling on whether jurors can hear the 911 call in which Caylee's grandmother, Cindy Anthony, reports her missing.

Prosecutors revealed Monday that there are actually three 911 calls, but they are only interested in playing one of them to the jury. They did not say which one, but the most damaging to Anthony is the call in which her mother says Anthony's car smells like a corpse.

What we need to do is find every comment made by a person in or around the Miami area, to show that they too are just as judgmental. Maybe do a graph. You may be surprised that possibly Orlando isn't as outspoken about this case as other areas of the country.

ICA (Inmate Casey Anthony) stated in her letters to Robyn why they want to move the hearing to Miami. What the reporter should have asked (had she done their homework) was, isn't it true you want to move the hearing to Miami because they let people walk down there?

The other day I watched a 48hrs show on ID. They featured this woman who they accused of killing her mother by staging a car accident and setting the car on fire.
I saw the woman featured on Snapped or a show similar and after hearing the experts testimony, I would have convicted her. The Defense was saying the car caught fire due to the ignition switch. The Prosecution, while it had a weak motive, presented a stronger argument.

The 48hrs feature story was about her appeal. A expert was hired to discount the Prosecutions witness. And let me tell you, this guy didn't have to try very hard. It was also revealed that the Expert for the Prosecution worked for Ford as an investigator who was assigned to the recall of several models during the late 80's because the ignition switch caught fire. He claimed that her model was not listed in the recall. But he was also paid by Ford to limit the number of cars involved in the recall. This information was never disclosed to the jury in the first hearing. The Prosecutions Expert testifies again at the second hearing and was torn to pieces upon cross examination.

Now, obviously her Defense Team during the first trial, didn't do their homework and they presented a weak defense from the get go. It didn't take the second hearing long to clear her. The jury said 2 reasons they came to their conclusion, #1 being the conflict of interest in the Prosecutions expert witness. Of course he would say it wasn't the ignition switch in that model car or they'd have to recall thousands of 87 models. Wasn't rocket science and the woman lost several years of her life (in prison) due to this oversight during the first trial.

So it truly boils down to not just the expert witness but how strong the opposing team is in presenting the case and discrediting these people. They can have all the Dr Lee's they want but rest assured, the Prosecution will point out his actions during the Phil Spector trial. If they don't, they're idiots. And I don't think they're idiots.
ICA is going down the river because to me Lyons who is one of the strongest of the circus, is weaker than the Prosecutor.

Now, watch the segment on WFTV where Baez is being interviewed regarding the duct tape. He totally dismisses Caylee. When he finally gets around to answering the reporter, he poo-poo's the seriousness of it and actually lies and says it was found near or around the search site.
His complete disregard and disrespect for Caylee is very evident and he sees her very much as the Anthony's and ICA does now -an annoyance who caused all this.

His actions will come across to the jury and they will pick up on this. The fact that no family member is sitting on her side of the courtroom will also be an issue.
The normal things that people should feel i.e. anger, sadness, agony, over the death of this child, that will be void in this trial by the family, will also be evident.

Also, I hope they replay clips of things like her walking into the courtroom yesterday LAUGHING, Smiling and not taking this the least bit serious. It's beyond comprehension for the average person to even understand or find a logical reason for her behavior and disregard for even her own life.

It was as if she was walking the red carpet and smiling to her adoring fans.

baezWell, looks like the truth is coming out on Baez, J.A.B. For 8 years after graduation, the board that screens prospective attorneys in FL, would not let Baez practice law. The FL Supreme Court agreed with this decision due to unpaid bills, extravagant spending and other “financial irresponsibility” at that time. Before he was admitted to the FL Bar, he had to demonstrate that he had rehabilitated himself.

Noted, his behavior showed “a total lack of respect for the rights of others and a total lack of respect for the legal system, which is absolutely inconsistent with the character and fitness qualities required of those seeking to be afforded the highest position of trust and confidence recognized by our system of law.”

Baez taught internet research to lawyers in the Miami-Dade public defenders office and started 4 business ventures, including 2 bikini shops. Bon Bon Bikinis and Brazilian-Bikinis.Com, LawStudentWebsites.Com and LawyerConcepts, plus applying for a real estate license….is what Baez was up to.

Baez was in the Navy, got out after 3 years as yeoman seaman, or an E-3. He divorced his first wife and failed to pay child support. He graduated 6 years later from Florida State University. In 1997 he graduated form St Thomas University School of law in Miami. In 1998 he was called before the FL Board of Bar examiners. The Supreme court ordered to review uncovered debts and other problems.

According to the Supreme Court summary of the case, the Board of Bar Examiners filed formal allegations against J.A.B. in September 1998. In addition to unpaid child support, a personal bankruptcy and default on a student loan, the investigators said he left out parts of his history, including that he wrote a bad check and entered a pretrial program to avoid conviction.

In 2001Baez created a nonprofit group, the Miami Domestic Violence Project. It dissolved two years later. In 2004, Baez created another nonprofit in Miami, Miracles for Children Foundation Corp., according to state records. It continued until Sept. 2005. Annual reports are not available on either of these “NON”-profit organizations.

Just some problems:
√In 1990 he filed Bankruptcy.
√In 1995 FAILED to pay his student load for $4,336.00.
√In 1995 Leased a Mazda Miata, considered unnecessary expense when he owed money to others.
√In 1998 Baez was reassigned at the public defenders office, to a job that did NOT require a law degree. He resigned in 1999.
√In 2004 he owed some $12,000.00 in back child support. It is said that an agreement was made to pay this…..Miami court HAD to dock $550 a month from his pay. Sounds like the court made him pay the child support.
