    Martha Giller Didnt Like Hubbys Love Child From His Mistress Charged With Abusing Her

    SEBRING - Testimony continues today in the trial of a Sebring woman charged with abusing the then 8-month-old child her husband fathered outside of the marriage.

    Martha Lynn Giller, 46, is charged with first-degree aggravated child abuse. On Monday, a panel of four women and three men were picked to hear evidence in the case, which was scheduled for three days this week. One of the jurors will be excused at the end of testimony, leaving the remaining six to render a verdict.

    The trial got under way Tuesday morning, as Assistant State Attorney Courtney Lenhart gave her opening statement. Attorney Catherine Combee elected to save her opening statement until the start of the defense's case.
    Lenhart offered the jurors a road map, per se, as to where the testimony would lead. She said witnesses would state that the child was born to Penny Pedrozo in June 2006 and that the father was Randolph Giller, the defendant's husband.
    Pedrozo was working two jobs - one as a secretary in Randolph Giller's hearing aid store and the other as a server in a local restaurant - and needed help taking care of the infant, according to Lenhart.
    Randolph Giller stepped in to assist with caring for the child, but it was the defendant who eventually took charge of the care, Lenhart said.
    On the witness stand, Pedrozo testified that she wasn't concerned for the baby's safety because the Gillers had four other children of their own.
    "I (would) try and block that thought from my mind because I never thought she would hurt mine because she had four of her own," Pedrozo said.
    The arrest report said that, between Feb. 27 and Feb. 28, 2007, Martha Giller abused the child with her hands and a "possible unknown object."Brandy Giller was eventually taken to All Children's Hospital with what was diagnosed as Shaken Baby Syndrome, according to the report.
    Martha Giller allegedly confessed to hurting the child in the presence of then Highlands County Sheriff's Det. Pete Barone, the report stated. Lenhart told the jury that taped confession would be played for them.
    On Tuesday morning, jurors also watched the taped deposition of the defendant's 19-year-old daughter, Paige Giller, who was testifying for the prosecution.
    The witness said she was watching baby Brandy on that late February day in 2007 when she discovered dime and quarter-sized bruises on the child's arm, legs and midsection.
    "When (my mother) got home, I asked her what those bruises were and she said, 'Don't worry about it. I'll take care of it,'" Giller said in her taped testimony, adding that she hasn't spoken to her mother since the investigation started.
    On cross examination by Combee, Giller was asked if she used to hit one of her younger brothers when staying home alone with him.
    "We were kids. We fought all the time," Giller testified.
    Combee asked Paige Giller if she was aware that detectives had once listed her as a possible suspect and the belief was her mother was covering for her.
    "Yes," Giller answered.
    "Were you aware that Penny had been questioned by detectives prior to this incident regarding a plot to kill your mother?" Combee asked during the taped deposition.
    "No," Giller replied.

    Why is there even a trial for this bitch, taped confession, confessed to an officer...only thing left is to try and throw her kid under the bus and say she did it. Abuses babies then blames it on her own kid, mother of the year there!

    What kind of idiot thinks, "Gee, now that I've had an affair with this man, and had this man's baby, I'll leave my baby with his loving wife? She won't mind." What bare faced gall, and criminally poor judgment.

    You ever heard of the sins of the father being visited upon the son? In this case, it would be daughter. If you are going to do wrong by some woman, don't be expecting her to do you a solid and raise your baby for you! (Or house sit for you. Or get you a good job.) Expect that she might seek to hurt you (or him) through the reminder of infidelity put smack in her face.

    It's like wrecking someone's car and expecting them to put yours in their garage and take care of it for you.

    She forgave her husband for the affair, and then agreed to care for the baby. If she knew she wasn't over the feelings of betrayal, she should never had agreed on having the baby in her home. Deal with your issues, and don't take it out on baby.

    I don't blame the bio-mom, all I can see her responsible for is not taking care of her own. She handed baby over to bio-dad who I am sure must have assured her baby would be okay. Who I blame is the bitch who carried out the abuse on this innocent child. Innocent of the affair, and the adult bullshit in this family.

    Is it needless to say that there are sooo many situations where the abuse goes on for years?
    Julia Roberts in that movie stepmother put too good a light (fairytail light)on what is often a shitty situation for the kids.
    What really sucks here is that the stepmother did (maybe snapped) and instead of guilt and remorse (making sure the child was okay) she tried to ignore it.
    Speaks tons about what kind of woman she is as do the others behavior.
    As for the daughter testifying for the prosecution? I would bet she's been there herself with mommy dearest.

    Except that he didn't, did he? He left it to his wife and daughter to do. I think that's fucked up.

    There is no doubt that Martha Giller is guilty and I see nothing to suggest that she tried to deflect that blame onto anyone else, including her daughter.

    I doubt that she agreed to take care of the baby, too. I'm betting that Mr. Giller, philanderer and sensitive guy extraordinaire, persuaded his daughter to do babysitting duty and the natural outcome was that the baby's care fell, in part, to his wife without any consent or agreement on her part. She should have stood up for herself and insisted the baby's care take place in Pedrozo's home. No doubt. She should have beaten the tar out of Mr. Giller, divorced his ass and taken half of everything. She should have fired Ms. Pedrozo from the shop, and sued her for home wrecking. She should have stayed far away from the baby and left the baby alone.

    But I absolutely believe that Pedrozo should never have thought that her baby was safe with the woman she betrayed. Never. Having four children of her own is, yes, proof that she knows how to raise children. Probably safely. It might also mean she doesn't want Pedrozo's child (e.g. no possessive jealousy). However, the issue isn't whether she's a good mother; it's whether she might be a vengeful wife and a scorned woman. Why would Pedrozo think she had no hard feelings? Why would she take that chance with her baby? I'd think she would have some caution about the woman's state of mind and the very vulnerable baby she so blithely put in her care.

    Jurors hear taped confession in child abuse case
    SEBRING - The prosecution played for the jury Wednesday a taped interview between investigators and a Sebring woman charged with child abuse, where she reportedly confessed to hurting the then 8-month-old infant.
    Martha Lynn Giller, 46, is charged with first-degree aggravated child abuse. Wednesday was day two of a scheduled three-day trial.
    The victim's father is Giller's husband and the child was conceived outside of the marriage, according to witness testimony from Tuesday.

    He went to the hearing aid store operated by the defendant's husband, Randolph Giller, and came into contact with Martha Giller, according to his Wednesday testimony.
    Barone said that as the two were talking, the defendant asked what could be done to someone who had abused a child. Giller also allegedly told the detective she had planned to call him today to talk about what had happened to the infant.
    Before she said anything more, Barone instructed her to stop talking and, before making another statement, let him read her the Miranda rights, according to his testimony.
    "I said, 'Did you do it?' She said, 'Yes,'" Barone said.
    The taped interview conducted at the sheriff's office was then played for the jury. Giller told Barone she was trying to change the baby's earrings because they were too long and were poking the infant in the head.
    Giller said Brandy was kicking, moving her arms and putting her hands up in the air. The defendant crossed the baby's arms across her chest to try and get her to stay still.
    "And then I remember laying on her to make her hold still," Giller was heard saying on the tape.
    The defendant also told investigators she was frustrated because the infant wouldn't hold still, as well as admitting her thoughts toward the child weren't always favorable.
    "It reminds me of her mother, and what she did to ... my family and myself," Giller said on the tape.
    On cross-examination by defense attorney Catherine Combee, Barone was asked if the defendant understood her rights before making any statements.
    Barone testified that Giller was crying, but it wasn't a hysterical crying that would make it difficult for her to understand her rights.

    During the first day of testimony on Tuesday, the victim's mother, Penny Pedrozo, testified that her child's father was Martha Giller's husband.

    Woman found guilty in child abuse trial

    SEBRING - A Highlands County jury returned Thursday with a guilty verdict in the case of a Sebring woman who abused the then 8-month-old daughter her husband fathered with another woman.

    Jurors began their deliberations around 11:20 Thursday morning and returned at 2 p.m. announcing that they were convicting Martha Lynn Giller, 46, of aggravated child abuse, a first-degree felony.

    The defendant was taken into custody by Highlands County Sheriff's deputies after the verdict was rendered. Sentencing is scheduled for June 28. The maximum penalty could be 30 years in prison.

    Giller was convicted of injuring the young child, Brandy Giller, in February 2007 while the baby was in her care. Doctors determined the infant suffered from Shaken Baby Syndrome.

    In her closing argument, Assistant State Attorney Courtney Lenhart said the defense threw out a lot of "red herrings" during the trial - the affair and an "unfounded plot" to kill Martha Giller were just a few - to try and distract jurors from the real issue.

    "The real issue here is the aggravated child abuse of Brandy Giller," Lenhart said.

    Regarding the alleged plot to kill the defendant, Lenhart said no evidence was ever found by police, and no one was ever prosecuted for it.

    "As far as we know, it never existed," she said.

    Lenhart added that the victim spent several days in All Children's Hospital after suffering from vomiting, seizures and bruises over her body.

    "It took her, according to her mother, four months to return to normal," Lenhart said, adding that the baby was on anti-seizure medication for another year.

    The prosecution also put on the stand a witness who shared a cell with Giller and heard her confess to hurting the child, according to the prosecutor's closing argument.

    "She said she did it because the baby was born out of sex, not love," Lenhart said.

    On the first day of testimony, the victim's mother, Penny Pedrozo, took the stand and testified that she became pregnant through an affair with the defendant's husband, Randolph Giller.

    "Martha Giller's 19-year marriage had been interrupted by this little girl, who reminded her of her mother," Lenhart told the jurors. "Every time she looked at that child, she thought of Penny Pedrozo and what she did."

    In her closing argument, defense attorney Catherine Combee said her client was faced with a man who had deceived her and brought another woman into their lives.

    "Pure and simple, truth is rarely pure and never simple," she said.

    During the trial, testimony revealed that at one point, the defendant's 19-year-old daughter, Paige Giller, was being looked at as a possible suspect.

    The younger Giller was the one reportedly watching the victim when the bruises were discovered. The infant also stopped breathing at one point and, according to Paige's testimony, she tapped the baby on the foot and blew into her mouth.

    Combee reiterated to the jurors that Paige Giller had been trained in CPR.

    "The newspaper is filled with 3-year-old kids who pick up the phone and call 911 and save their father's life, and yet she, a 15-year-old, does not pick up the phone and call 911. She calls mother," Combee said.

    The attorney also used a sandwich analogy in her closing argument when talking about the prosecution's case, specifically Giller's taped confession that she committed the crime, but without explaining how she did it, and the testimony of a "jailhouse snitch."

    "You have to believe that they've made their BLT," Combee said. "I would report to you that they have not made their BLT. I would report to you that they've given you substitute products."

    SEBRING - A woman found guilty of aggravated child abuse in May by a Highlands County jury was sentenced Friday to 10 years in the Florida state prison system and 15 years of probation upon release.

    Martha Lynn Giller, 46, was convicted of injuring the young child, Brandy Giller, in February 2007 while the baby was in her care. Doctors determined the infant suffered from Shaken Baby Syndrome.

    It sounds like she might be fine, though it was a long recovery! I'm so glad she beat the odds. I do hope there is no residual damage. Poor little mite.

    That's kind of a pointless argument. 3 year olds who make 911 calls are rare and they do so because 911 is a simple number sequence, and there is no other, older, responsible person in the house to ask for help. i daresay most teens who are babysitting turn first to a more familiar authority figure if they can. The problem is when adults who ought to be more confident and knowledgeable do the same thing.

    I was always under the impression that it takes "two to tango" as my grams would say. Not to mention that "it" is a child - a beautiful little girl who has nothing to do with what her parents did, so why should she be punished for their indiscretions?

    I certainly hope so. It's rare that a baby survives SBS, let alone have a full recovery. Great news ~ and a nice fuck you to the lady who abused her!

    How much more simple can it get? Hubby cheats on her, she ends up having to take care of his "love child," she hates it, she abuses it. The so-called plot to kill her was just BS. There SHOULD have been a plot and it SHOULD have been carried out.

    THAT would be the purest and simplest to me.

    Why not just say, flat out, that she was NOT going to take care of the child since she was conceived during an affair?

    Why stay with a man that cheated on you to begin with?
