    Prosecutors may have evidence that could prove the innocence of Stephanie Sloop, her attorney said.

    Stephanie Sloop, 28, and her husband, Nathanael Warren Sloop, 32, are each charged with aggravated murder, second-degree felony child abuse, second-degree felony obstruction of justice and third-degree felony abuse or desecration of a body.

    The Layton couple appeared separately in 2nd District Court on Tuesday before Judge Glen C. Dawson, asking the judge to cancel dates set for preliminary hearings.

    Mary C. Corporon, Stephanie Sloop’s attorney, filed a motion on Oct. 19, asking the judge to order prosecutors to hand over evidence that may be “exculpatory” for Stephanie Sloop. She also filed a motion to have a preliminary hearing set for Nov. 15 through Nov. 17 to be continued to another date.

    Corporon said during Tuesday’s hearing that prosecutors have given her 16,480 documents and 412 disks, which have recordings and/or photographs to examine. But in the last several weeks, new evidence has come forward, which she has not had time to review.

    According to court documents, prosecutors have “received material in search of the cell of Mr. Nathanael Sloop, which is or may be exculpatory” of Stephanie Sloop.

    Also, the Layton Police Department has physical evidence which Corporon wants to examine, but no agreement has been reached between the police department and Corporon on how that will be done.

    Davis County Attorney Troy Rawlings said he likes the new evidence.

    “We like it and we want to use it,” Rawlings said.

    Rawlings said some of the new evidence came about due to advances in technology.

    “We looked at it a year ago, and it’s always been available,” Rawlings said.

    What that evidence is, Rawlings could not comment because of court rules.

    Rawlings said the Sloops are presumed innocent until a court finds them guilty of any of the charges.

    A five-day preliminary hearing for Nathan Sloop that was supposed to start on Oct. 31, but has been changed to March 19, 2012 through March 23, 2012. A preliminary hearing is when the judge hears evidence from prosecutors and decides if the case should move forward.

    The preliminary hearing dates of Nov. 15 through Nov. 17 for Stephanie Sloop were also canceled. No new dates have been set.

    Seven murder cases on docket in Davis

    FARMINGTON -- Davis County has seven murder cases on its court docket for 2012.

    "My hope is murder cases will decline to zero, but I know that is not realistic," said Davis County Attorney Troy Rawlings. "As the county's population continues to grow, all types of crime, including homicide cases, will increase."

    Rawlings declined to comment on any of the cases his office is prosecuting. "In order to be sensitive to the victims and to be fair to the defendants I have to refrain from commenting."

    The oldest case is 10 years old. The newest case will be a year old in 2012. Although each case is different, there are some commonalities among them.

    Four of the cases involve children as victims:

    * Lacey Paige Lawrence, age 6, died Sept. 2, 2002.

    * Ethan Stacy, age 4, died May 9, 2010.
    * Jean Warhola, age 8, died Sept. 8, 2010.

    * James Warhola, age 7, died Sept. 8, 2010.

    Three of the defendants have had mental competency raised as an issue by defense attorneys.

    They are:

    * Jeremy Jacob Hauck, charged with murder after police found the body of his mother, Laura Hauck, in a freezer on Aug. 7, 2006. Police said Jeremy shot his mother twice, then slit her throat before hiding her body.

    Jeremy Hauck is currently at the Utah State Hospital undergoing evaluation to determine if he is competent for trial. A review hearing is set for Feb. 27.

    * Phillip Joseph Simmons is charged with murder after police said he stabbed Suzanne Fry 51 times in her Bountiful apartment on Jan. 20, 2008. Doctors have determined he is now competent to stand trial. Now doctors are trying to determine if Simmons was mentally competent at the time of the stabbing, said defense attorney Mark Arrington. A five-day jury trial is set for Feb. 6-10.

    * Sun Cha Warhola is charged with two counts of murder after police found her two children strangled inside her home. She is currently at the Utah State Hospital undergoing treatment to restore her mental competency. A review hearing is set for May 25.

    "Mental health issues can prolong the period of time a case is in court or, potentially, could permanently halt a case," Rawlings said.

    Rawlings said mental health issues cannot be rushed, so those are out of the control of prosecutors, defense attorneys and judges, which can cause "cases to remain in limbo for the mental health issues to be ferreted out."

    The case of Mark Anthony Ott is the oldest case on the Davis County Attorney's docket.

    Ott pleaded guilty to capital murder in the death of Lacey Lawrence, who died in a house fire police said Ott started. The 6-year-old girl was staying at the home of Ott's then estranged wife. The Utah Supreme Court in 2010 overturned the life-without-parole sentence for his aggravated murder guilty plea and sent the case back to 2nd District Court.

    The newest case will be a year old in March, that of Joseph Allen Nance.

    Nance, 29, is accused of shooting his father, Gregory Nance, on March 19, 2011, during an argument at the Far West Motel in Kaysville. He has pleaded not guilty to the first-degree felony murder charge and is being held in the Davis County Jail in lieu of $1 million bail. His next hearing is set for Jan. 23.

    A married couple, Nathan and Stephanie Sloop, are each facing their own charges in connection with the death of 4-year-old Ethan Stacy.

    Ethan's disfigured body was found buried in Weber County on May 10 after Stephanie Sloop called to report Ethan, her son, missing.

    Both Sloops could face the death penalty. Prosecutors will decide if they will pursue the death penalty after the Sloops enter a plea at a future hearing.

    Rawlings could not comment specifically on either Sloops' case, but did say, "In general, some of these cases are eligible for the death penalty as a realistic course of action."
    Nathan Sloop has a five-day preliminary hearing scheduled to begin March 19. At that hearing, a judge will decide if there is enough evidence against him for the case to go forward to trial. No hearing has been set for Stephanie Sloop at this time.

    FARMINGTON — A preliminary hearing for the man charged with the murder of 4-year-old Ethan Stacy has been changed from five days to one.

    The change in Nathan Sloop’s preliminary hearing was made Thursday, according to the court website.

    Sloop, 32, and his wife, Stephanie Sloop, 28, both of Layton, are each charged with aggravated murder, second-degree felony child abuse, second-degree felony obstruction of justice and third-degree felony abuse or desecration of a body.

    Both are being held in Davis County Jail without bail.

    The charges stem from the death of Ethan Stacy, Stephanie Sloop’s son, in 2010.

    Both Sloops could face the death penalty, if convicted.

    Prosecutors have 60 days following a felony arraignment hearing to file their intent to seek the death penalty.

    Investigators found the young boy’s disfigured body buried near Powder Mountain on May 10, 2010. Authorities believe he was killed the day before.

    The five-day preliminary hearing was supposed to run from March 19 to March 24 in 2nd District Court. A one-day hearing has now been set for 2 p.m. March 20.The court website states the reason for the change was “counsel request.”

    Davis County Attorney Troy Rawlings said, “We will allow the defense (attorneys) to explain their thinking for the change.”

    A call was placed Friday morning to Richard Mauro, Sloop’s appointed public defender. He was not in his office.

    A two-day preliminary hearing for Stephanie Sloop had been set in November, but her attorney, Mary C. Corporon, requested a continuance.

    Ethan Stacy is remembered by group fighting child abuse

    OGDEN, UTAH (ABC 4 News) -He was only four when he died, and police say Ethan Stacy died a terrible and tragic death at the hands of those who should have protected him. Saturday, the little boy was remembered by those who love him, although most had never met him.


    Anissa Martinez and the group that calls themselves Ethan’s Army gathered at the site near Powder Mountain where Ethan Stacy’s body was found. He was found murdered and buried in a shallow grave. Police say his mother, Stephanie Sloop, and his Step Father, Nathan Sloop, killed him; not long after he arrived at their apartment for a summer visit with his biological mother. She said he wandered away, but investigators say Ethan was tortured, and then killed.

    Martinez says they remember Ethan because they don’t want any Utah children to endure the same treatment. “If you suspect child abuse in any way shape or form please notify the authorities"

    Ethan’s Army placed balloons, flowers, and toys where Ethan lay, and offered a prayer on his behalf. They say it doesn't matter that they never had a chance to meet. He died on Mother’s Day, and these moms say he has become their child. “The heartache is too much to deal with sometimes, when you know what he went through, and he didn't have anybody to protect him.”

    A man accused of brutally beating and killing his 4-year-old stepson pleaded not guilty Tuesday to the charges against him.

    Nathan Sloop, 33, slowly scanned the courtroom before he reiterated that he did not want to have a preliminary hearing. He then pleaded not guilty to charges of aggravated murder, a first-degree felony; child abuse and obstructing justice, second-degree felonies; and abuse or desecration of a body, a third-degree felony, in the 2010 killing of Ethan Stacy. . . .

    Nathan Sloop is facing an additional charge of damaging a jail, a third-degree felony. . . .

    Now that Nathan Sloop has had an arraignment hearing and entered his plea, prosecutors have 60 days to indicate whether they will seek the death penalty in the case. Rawlings said his office has yet to make an official decision about the death penalty.

    The attorney’s office filed their notice of intent to seek the death penalty Thursday in 2nd District Court, where Sloop, 34, is accused of aggravated murder in connection with the 2010 death of his 4-year-old stepson, Ethan Stacy. Sloop’s wife, Stephanie Sloop, 29, is also charged with aggravated murder in Ethan’s death, though the attorney’s office has not filed the same intent in her case.

    Pleasepleasepleasepleaseplease - let them BOTH get the death penalty. If ever anyone deserved do die for their crimes, it's these two. I have never wished anyone dead as much as I wish it for the Sloops.

    Wearing a rosary as a necklace is actually quite offensive. It's an instrument of prayer and repentance, not a fashion accessory.

    Finally going to trial!

    A Utah man accused of beating his four-year-old stepson to death will learn next week if there is enough evidence to put him on trial for the murder.
    At an evidentiary hearing Monday, lawyers on both sides agreed on what evidence could be included in the gruesome case, which will be presented at a three-day pretrial hearing.
    Judge Glen Dawson concluded the short hearing by confirming the hearing dates of March 27-29.

    Sloop pleaded not guilty to the charges last year. Asked if they would consider a plea deal, Sloop's attorney, Richard Mauro, said that they are just preparing for the preliminary hearings and waiting to see what the prosecution presents as evidence.
    Mauro said he plans to challenge the constitutionality of the death penalty as part of a series of motions he'll file.
    Sloop's wife, Stephanie Sloop, 30, faces identical charges for allegedly contributing to her son's death or failing to stop it, but it remains unknown whether or not the prosecutors will seek the death penalty for her. She is due back in court April12.

    I don't follow this case, I try to avoid this kind of cases. But I can't help and read whole thing. Reading the details of abuse is bad but seeing the picture of little boy with bruised jaw, sitting with the monster is WORSE. Ethan don't have tell you he was afraid, his expression was enough for you to rescue him. And that "mother" ignored that expression. She is lying if she say she didn't or can't see that face expression. She snapped that picture. WTF? How can she keep her cool, seeing how much Ethan suffered? Stephanie, you really are a bad person.
