    Daniel Staley has one foot OUT of the grave...

    Dallas police say around 3:30 a.m., 18-year-old Daniel Wayne Stanley walked up to two officers in the 2101 block of S. Buckner Blvd., and said he took the foot of a "Jew girl."

    That's when he opened his backpack, police say, and showed the officers a decomposed foot inside. The foot still had some flesh attached, according to Dallas Police Sgt. Janice Crowther.

    A hachet was also inside the bag.

    Stanley then led the officers to the Tiferet Israel Agudas Achim Cemetery on Buckner Boulevard, just around the corner.

    Police found a freshly-dug hole in front of the gravestone of Polya Gertsenshteyen.

    By mid-morning on Friday, several detectives were on the scene, searching for more clues in the case.

    Daniel Wayne Staley is fascinated by death – so much so, police say, that he dug up a grave and used a hatchet to cut off the foot of a corpse in a private Jewish cemetery in Pleasant Grove.

    "He's infatuated with death and decided to do it," said Sgt. Bruce McDonald, a homicide unit supervisor. "He has some very serious issues and possibly mental problems. He knew what he was doing was wrong."

    Staley's mother, who asked that her name not be published, said he has been in and out of mental institutions and suffers from a laundry list of illnesses, including schizophrenia. She said he won't take his medications. She also said he called her from jail and indicated no remorse for disturbing the grave.

    "He's ready to get out so he can do something worse," she said. "He thinks it's funny. I'm terrified of him doing something to harm another person because it is reaching that point. ... It is just so horrible what he did. I can't find words for it, but it's so sick.

    "As his family, we really have no control over what he did, but also as his family we want to somehow make some sort of apology."

    Staley's MySpace page conveys a sense of nihilism and frequent references to death. In one photo, he points a gun to his head. On April 19, he writes that he is "still contemplating the time when i go get my corpse. i dont think i could fit the whole thing in my bag."

    He last logged in Thursday afternoon, listing his mood as "good as dead."

    Police found a shovel thought to have been used to dig up the grave. They also searched the woods behind the cemetery, looking for more body parts. A rabbi also came to the cemetery to check out the grave. Police believe the foot came from the grave of Leibe Vener, who died in 1941.

    McDonald of the homicide unit said Staley didn't take the foot because the corpse was that of a Jewish person.

    "I think it was a spur-of-the-moment deal," he said. "He just decided to do it."

    For months, Staley has been spiraling out of control, according to his mother and police records.

    Staley faces one misdemeanor count of making a terroristic threat over a March 15 incident that took place in the 13600 block of Preston Road. According to police records, Staley told a sales manager that he would "blow up this building and kill everyone."

    Staley told officers that he had made the statements in anger and because of his inability "to deal with authority." While officers were on the scene, he told the man that he would beat him up if he saw him, police records state.

    On April 1, Staley told police that he was thinking about setting his mother on fire by pouring gasoline on her. He told police that he was off his medications for bipolar disorder and schizophrenia.

    He also stated that he wanted to commit suicide. Police took him into custody and took him to Parkland Hospital for mental treatment.

    "This the first time he's threatened to do anything to me, to my knowledge," his mother said. "He's threatened to kill his dad."

    She said she was at a loss about what to do to help her only child. When he's not on medication, she said, he's dangerous to himself and others.

    "We've all tried to get him help," she said. "The problem is that the help is only temporary and he's released again, and someone with his kind of illness can't be released and expected to take care of himself. He's not going to take care of himself. He has no control over his mind."

    Staley's mother said neither she nor other members of the family plan to bail him out. In fact, she hopes he stays put.

    "I hope he stays in there for a long time," she said. "He does not need to be a free person. I hate to say that about my own child."

    Abuse of a corpse is NOT going to keep him behind bars for long, if at all.

    Surely there is a way to protect everyone and this guy, too. I just hope it does not take someone dying for it to happen.

    Scary stuff! This kid is on a path to somewhere horrible. I hope that authorities take his mother's pleas seriously and step in to take some charge of this troubled boy before it is too late.

    This reminds me alot of the Sam Manzies case- a 15 year old mentally unstable boy who ended up murdering a neighbor boy. His mom begged authorities to take control of him before something terrible happened, but her pleas and warnings were ignored until it was too late!
    If you can't be a good example, then you'll just have to be a horrible warning!

    This kid is clearly mentally ill and a danger to society. Sadly...given the state of our mental health system, I sadly fear the only way he'll be locked up forever is when he commits a really horrible crime.... and then it will be too late.

    Having read the articles, this is definately a case where he needs to be found not guilty by reason of insanity. Even if he's sentenced to the max on both of the charges he's facing in criminal court,he will be locked up for a max of two years and then he'll be out, no supervision, nothing. That will NOT keep society safe. But if he's found not guilty by reason of insanity, he can be locked up much longer.

    Parents fear state will free Dallas area teen who abused corpse, dwells on killing
    Daniel Staley dug up a grave, cut off a decomposed foot and later gave the bones to a police officer.

    "I planned it before I did it," Staley said in a recent interview. "I wanted to get up a whole bunch of body parts and kind of sew them up together."

    The macabre incident earlier this year at a Pleasant Grove cemetery made headlines and caught the attention of police and prosecutors, who moved quickly to have him declared incompetent and send him to a state mental hospital. It took more than two months to get him into the institution, and his family now lives in fear that he'll soon be out on the streets again. Staley knows he's mentally ill. His parents and the prosecutor who handled his case think he's dangerous.

    Now they worry that he'll become another casualty of a faltering system that takes too long to start helping the mentally ill and is too quick to put them back on the streets.

    Staley has lived at various times with one or the other of his divorced parents since he was 5. He's been in and out of mental hospitals since he was about 12, suffering from a smorgasbord of mental illnesses, including bipolar disorder and schizophrenia.

    In fall 2009, Russell Staley said, his son briefly ended up homeless, then again was in a mental hospital after slashing his wrist. Russell Staley said his son called repeatedly from the hospital: "He went into great detail about his fantasies of torturing and dismembering humans, and that he wanted to look into their eyes as they died." At one point, Russell Staley said, his son threatened to follow hospital staff members home and torture, skin and dismember them.

    Staley said he doesn't believe he's incompetent and would prefer to serve jail time and be set free. But once stabilized by his medications, he is likely to end up on probation for at least five years for the graveyard incident, said his attorney, Douglas Schopmeyer.

    "When you speak to him in person and sit down with him, he is not the monster that he has been portrayed as," Schopmeyer said. "But I believe he is very seriously mentally ill. He is going to need to be closely monitored."

    It will probably be a condition of his probation that he take his medications, his attorney said.

    But nothing requires Staley to continue taking his medications once his encounter with the court system ends.

    "Once they complete their probation or jail time – whatever it is where they are being supervised – they're on their own, there's nothing that you can do," said Collins, the county prosecutor. "They're on their own to make the choice to take medicine or not to take medicine."

    Russell and DeLinda Staley both fear the cemetery incident is a prelude to something more horrific, and that their son will step right back through the system's revolving door.

    "I'm really scared for him and for others," his mother said. "He's already talking about how he's not liking taking the medications. Because of his illness, we can't control him and he can't control himself."

    Larry Doane, coordinator for Dallas County's mental illness probate court, is intimately familiar with the revolving door of the mental health system.

    "For the most part, they get off their medication and then they start to deteriorate and they get picked up for something and the hospital files an order for protective custody and we have a new case and it starts all over," he said. "A lot of these names I see here every 60 to 90 days."

    Truly there is nothing to make him take his medicine after he's walked away from the hospital he's in whether he's on probation or not, they can't hold his hand while he's out and about doing his crazy thing.

    He's gonna do something awful, the signs are all there, and they all know it.

    This pretty much shows the failures of our mental health system from top to bottom.
    The same system that doesn't provide help to families and society protection from people who are mentally ill and dangerous (a small,small number) will be the first to go for blood when they finally do commit a crime. And of course, they then are given help and meds not provided before.
    Also not surprised Daniel fails to see that he has a mental illiness. With many of the mentally ill, nothing anyone can do or say will convince them they're sick. One of the reasons it's a bad idea to trust them to take their meds. If you don't think anything is wrong with you,why take something for it?
    Plus, the side effects of many of these meds aren't pleasant. Weight gain, nausea,fatigue.
    His probation should be five years in a hospitall,not out on the streets. This guy is a ticking time bomb,everyone knows it. Yet they're powerless to stop him... until he injures or kills someone.
