    ONTARIO -- A Westminster police detective and a Chino prison guard have been jailed in connection with the kidnap and rape of a 25-year-old woman who was carjacked Saturday at Ontario Mills Mall, say Ontario police officials.

    It was later determined that Orban telephoned Jelinek, who picked up Orban in Fontana and drove him back to the Ontario Mills parking lot, police said.

    I wonder what leads them to believe the second man was in on it? Orban could very well have simply called his buddy and gave him some story for why he got stuck away from his car.

    The two men, friends since high school, ate lunch together at Chili's in Rancho Cucamonga, where they drank margaritas. Both men had their service weapons with them, Jelinek told police.

    From there the men went to Boston's restaurant on Fourth Street. They shared a pitcher of beer there, and shared another pitcher at their next stop - GameWorks at Ontario Mills, Jelinek told police.

    Shortly after 5 p.m., the men were in the parking lot outside Dave & Buster's, where the alleged victim was finishing a four-hour shift as a waitress.

    When the men saw the waitress walking from the restaurant's entrance to her car, Orban said, "Let's go meet this chick," Jelinek told police.

    The woman told police she saw Orban and Jelinek standing near the entrance to Dave and Buster's when she left, but paid them little notice on the way to her car, sending text messages as she walked.

    She unlocked her SUV with a keyless remote when she approached. As she stood next to the driver's side front door, she heard a door open on the passenger side.

    She told police she saw Orban holding a silver handgun at his waist. He pointed it at her and said, "Get in the car," she told police.

    Jelinek said he stood nearby watching as his friend confronted the woman at gunpoint. He asked Orban what he was doing, and Orban told him, "Don't worry about it," the woman told police.

    Once the woman and Orban were in the car, the woman told police she pleaded with Orban and told him he could have anything he wanted if he let her go.

    He replied by saying, "Just drive." He ordered her to drive toward her home, which she told him was in the High Desert, the woman told police.

    Orban still held the handgun in his lap, and he and the woman talked about her child - the woman had a child's car seat in the back seat - and other personal details, she told police.

    "As Orban continued to speak, he smiled at her and asked her if she was scared. The victim replied yes," the police report says. "Orban then told the victim he would let her go, but she had to do something before he left."

    Orban told the woman to perform oral sex on him, then ordered her to go into the back seat of her car, where Orban joined her by climbing between the two front seats, the woman told police.

    Once there, Orban ordered the woman to undress, then sexually assaulted her for an hour, according to an estimate the woman provided police.

    At times during the assault, Orban would pause and play with his gun and take photos with his cell phone, the woman told police.

    When police confiscated Jelinek's phone, they found photos of the assault that Orban sent him. One photo was sent with a text message that read: "Look what I'm doing," according to the police report.

    Orban received a phone call during the alleged assault, and as he talked to a man on the other end of the line he suddenly seemed to get scared, the woman told police.

    He asked the alleged victim where they were and why she wasn't wearing any clothes, the woman told police.

    Orban told the woman to put on her clothes and apologized. He appeared to be "freaking out," the woman told police.

    As the woman got dressed, Orban again stuck his fingers in the woman's throat and gagged and choked her, the woman told police.

    Once the woman was dressed, she fled while Orban was distracted by his phone. She ran to a nearby liquor store and told employees to call police.

    Orban called Jelinek and had him pick him up and a nearby gas station. He reportedly took the woman's car keys - Jelinek had them when he was arrested - and he left his gun in the woman's car.

    The gun was Orban's service weapon, and his last name was engraved on it, according to the police report.

    Orban told Jelinek to erase the messages on his cell phone, Jelinek told police.

    When Orban was interviewed after his arrest, he claimed he didn't remember the incident, the police report says.

    "Due to Orban having trouble remembering anything that I was asking him about, no further questions were asked of him," a detective wrote.

    Former Police Officer Says Zoloft Made Him Kidnap, Rape Woman

    MONROVIA (CBS) — Anthony Orban served five years in the Marine Corps and fought in Iraq before working as a member of the Westminster police department for another five years.
    But his career in law enforcement ended after he was arrested on charges of kidnapping and raping a woman in 2010.
    “I knew exactly what it was. It was the medication,” Orban told KCAL9 News.

    His wife, Tracy, said Orban was taking the drug Zoloft to deal with post-traumatic stress disorder associated with his time in combat and triggered by police work.

    “He had invisible wounds that none of us saw. But he’s a casualty of war,” Tracy said.

    Orban’s attorney is presenting a defense of “not guilty by reason of unconsciousness,” claiming the Zoloft made him do it.
    “It doesn’t mean you’re unconscious, falling on the ground, asleep. What it means is that you’re not aware of your actions,” defense attorney James Blatt said.

    CBS2 spoke with Dr. Joseph Haraszti, who is a forensic psychiatrist and a psycho-pharmacologist. He said an anti-depressant can’t make you perform complex behaviors such as kidnapping and rape and not realize it.
    “To me, this seems like as a defense is a cop out. There is no such case where a person would become unconscious and not know what they’re doing while taking Zoloft,” Haraszti said.
    Originally, Orban’s attorney was expected to present an insanity plea.

    But changing the defense to “not guilty by reason of unconsciousness” could allow Orban to walk out as a free man.

    I call bullshit on the Zoloft made me do it. I took Zoloft for a while and besides making me nauseous and keeping me puking every time I took it, I never had any weird thing happen that I felt like I forced to do by Zoloft.

    A San Bernardino County jury Wednesday rejected a controversial "Zoloft" defense presented by a former Westminster police detective accused of kidnapping and raping a waitress in 2010, finding the defendant guilty of all eight charges.

    Anthony Nicholas Orban's attorney acknowledged from the outset that his client attacked the woman, but argued that the former detective was rendered mentally "unconscious" by a powerful dose of the prescription antidepressant and was not responsible for his actions.

    A jury of eight women and four men deliberated less than a day before dismissing that defense and finding Orban guilty of kidnapping, two counts of rape, two counts of forced oral copulation, two counts of sexual penetration with a foreign object and one count of making a criminal threat.

    The victim sat in the front row of the packed Rancho Cucamonga courtroom, reacting with a subtle smile as Superior Court Judge Shahla S. Sabet read the guilty verdicts. The victim's unflinching, graphic account of the sexual assault was the most compelling testimony given during the month-long trial.

    Orban showed little emotion as the verdicts were read. His wife wept gently in the back of the courtroom.

    Orban will face a sanity hearing to determine whether he knew the difference between right and wrong at the time of the attack. He almost certainly faces a life prison sentence if the jury determines he was sane. If declared insane, he would be sent to a state mental institution for treatment, and later could be released. The same jurors will be impaneled for the sanity proceeding.

    The hearing is scheduled to begin Tuesday and testimony is expected to last two days.

    The psychotropic effects of Zoloft again will be central to the sanity phase.

    Psychiatrist Dr. Peter Breggin of New York, a controversial critic of psychiatric drugs, will be the defense's sole medical expert. Earlier in the trial, Breggin testified that Orban had stopped taking the prescribed antidepressant, then resumed it at full dose, provoking a psychotic break during which he was "delirious" and not fully aware of his actions.

    Deputy Dist. Atty. Debbie Ploghaus, in her closing argument earlier this week, called that defense a "bunch of baloney." She told jurors that Breggin's opinions ran counter to medical consensus on the drug's effects. Prosecution expert Dr. Douglas Jacobs, an associate clinical professor at Harvard, testified that Zoloft has been prescribed to millions of people and proved safe. He attributed Orban's actions more to alcohol consumption.

    Orban had shared eight margaritas and two pitchers of beer with a friend, and was seeking sexual encounters before he kidnapped the victim at gunpoint and made her drive to a Fontana storage facility, where he raped her, Ploghaus told jurors.

    Proving insanity is a "high hurdle" and successful in a minuscule number of cases, said USC law professor Elyn Saks, head of the Saks Institute for Mental Health Law, Policy and Ethics. Even if a defendant can convince a jury that he has no memory of an incident, that by itself is not enough to absolve him of responsibility.

    "It's a difficult case to make, and it's a difficult case to win," Saks said.

    A jury has determined that former Westminster police Detective Anthony Orban was sane when he kidnapped and raped an Ontario Mills waitress in Fontana in 2010.

    Orban was found to be sane on all eight felony counts, which included kidnapping, rape, oral copulation and sexual penetration with a foreign object. The verdicts were announced this morning in West Valley Superior Court, in Rancho Cucamonga.

    The victim, who was seated in the courtroom, cried quietly and hugged a friend who sat next to her.

    Orban closed his eyes and shook his head as each verdict was read by the court clerk. Tracy Orban, the defendant's wife, sobbed.

    The defendant is scheduled to return to court Aug. 9 for sentencing, and prosecutors say he could face 75 years to life in state prison.

    The sanity phase of Orban's trial started last Tuesday, with Orban testifying about his time in the military and as a police officer, as well as his rocky marriage.

    The defense argued that Orban's actions were caused by the anti-depressant Zoloft and anti-seizure medication Neurontin. On Wednesday, Orban testified about the effects that the prescription drugs had on him and described what he remembered from the day of the attack.

    Ploghaus said there is no validation to Orban's story.

    "I think it was something he made up after the fact... it was his only way out," she said.

    The prosecutor said she was not surprised when defense lawyer James Blatt called the defendant to the witness stand, adding that Orban and co-defendant Jeff Jelinek were the only two witnesses. In her opinion, Ploghaus said, Orban is very dangerous because he's very manipulative.

    Ploghaus said she believes in her heart that Orban had no intentions of letting the victim go.

    "I think the minute she ran from him, he started making the mistakes he did," the prosecutor said.

    In terms of sentencing, the defense lawyer said several factors will be considered, such as the nature of the crimes, the fact that there was a kidnapping, that a weapon was used and that there was great bodily injury. Orban could possibly be sentenced to 100 to 200 years, according to the defense lawyer.

    "The reality is, Mr. Orban will receive a life term," Blatt said.

    The defense lawyer said one of his goals during this trial was to expose to the public the dangers of psychotropic drugs and their effects. This was not an easy case, nor a quick decision by the jurors, Blatt said.

    The problem the defense had was there was a significant amount of drinking by Orban, which may have been a large factor for the jury, the defense lawyer said. In the end, this is a life destroyed, Blatt said of his client.

    "This is a sad day,"
    Blatt said. "I'm also sad the victim had to go through all of this." Quite the afterthought, Mr. Blatt.

    The Zoloft defense was complete and utter bullshit but had he said the Neurontin he could have done better. That is a nasty drug. My mom was on it for migraines for a bit and totally lost her shit, no one dead, no one raped but she was whacked out from it. She went off it and has been fine for years. Nasty, nasty drug.

    He needs the max sentence and should be tattooed with COP on his forehead and put in gen pop cause inmates love cops.

    I think it depends on the individual and dosage. It's an anticonvulsant that they discovered has a blessed side effect of relieving nerve pain. If I have a neuralgia attack (my legs feel like someone is putting cigarettes out all over and up and down them, excruciating), it is the only thing that works. Luckily, I get no other side effects from it. A short time and I'm good as new and off it.

    Sharing eight margaritas and two pitchers of beer was asking for trouble all by itself. Zoloft can increase the effects of alcohol. Alcohol increases the chances of nasty side effects from Neurontin. He should never had a drink while taking either of them... much less both.

    In a surprise twist Thursday, the attorney for a former Westminster police detective convicted of rape said he had evidence of juror misconduct, causing a delay of his client's sentencing for one week.

    James Blatt, Anthony Orban's attorney, said juror No. 4 came to him during the trial claiming that he overheard two other jurors talking about their history with domestic violence and psychotropic drugs.

    West Valley Superior Court Judge Shahla S. Sabet moved the sentencing to Aug. 16 so she could hear from prosecutors and defense attorneys about the issue.

    On Thursday, Blatt asked for the court's guidance in rendering a decision of misconduct.

    The judge and Deputy District Attorney Debbie Ploghaus criticized Blatt for admitting that his investigator had spoken to the juror and for not acting immediately to inform the court or the opposing attorney.

    "Such a delay tactic violates not only the victim's and jurors' rights but the rights of your client as well," Sabet said. "I am obligated to protect the rights and the privacy of all involved."

    Now that the trial is over, Sabet said she cannot order the juror to return to the court.

    "If I did that, it would be devastating to our jury system, and the system would fall," she said.

    RANCHO CUCAMONGA, CA — A former Westminster*police detective has killed himself just hours before he was to be sentenced after being found guilty of raping a 24-year-old woman he abducted from a mall.
    Back in 2010, the victim*was leaving her cocktail waitress job at Dave & Buster’s in the Ontario Mills Mall, when 33-year-old Anthony Nicholas Orban*forced her at gunpoint to drive to a strip mall in Fontana. There he*proceeded to beat and sexually assault the woman for more than an hour. Luckily, she was able to escape out of an unlocked door of her SUV and Orban*fled the scene.
    It didn’t take police long to identify Orban as a suspect as his*dumbass left his registered service revolver in the victim’s vehicle. He was arrested, charged, and kicked off the force.     SoCal Ex-Cop Who Committed Suicide Could Still Be Sentenced For Kidnapping, Rape

    ONTARIO (CBSLA.com) — A former police officer could still be sentenced for kidnapping and raping a waitress in 2010 even though he committed suicide seven months ago.

    Anthony Orban, 33, was working as a detective in Westminster when he stalked Erinn* at a Dave and Buster’s parking lot at Ontario Mills mall, forced her into her car and then raped her at another location.

    Erinn was able to escape and helped police track Orban down.

    In June 2012, Orban was convicted of the attack. His attorney blamed the anti-depressant Zoloft for his client’s behavior, claiming he was unaware of his actions because of the drug’s effects.

    Right before his sentencing last October, however, Orban took his own life in his jail cell.

    Erinn told KCAL9’s Tom Wait she would have forgiven Orban at the hearing.

    “I was going to forgive him, actually. I had my whole impact statement written out and prepared. I was going to tell him exactly how I felt. That he had disgraced his fellow officers, fellow military personnel with what he had done. And the fact that he didn’t own up to it was very sad and pathetic,” she said.

    Orban’s attorney told Wait via phone that sentencing Orban after his suicide is “a ridiculous charade” and is “hurtful to Orban’s family.”

    Erinn said, “Just because he chose to take the coward’s way out on the day that was supposed to be his sentencing does not mean he’s excused from that…I waited years to say my piece to him and he took that from me.”

    A hearing is scheduled for July to determine whether or not Orban will be sentenced.

    The victim should get her say. She had to wait long enough for the courts to know what his actions did to her. If his family doesn't like it then they should stay home. The pain he caused her goes beyond measure and she can't escape it so the fact that a sentencing hearing would be hurtful to his family doesn't sway me at all.
