Orgal Opata arrested after 2 toddlers die in fire

The mother of two unsupervised toddlers killed in a west Charlotte house fire early Sunday was arrested and charged with murder and felony child abuse.

After a day of searching, Charlotte-Mecklenburg police arrested Orgal Paulette Opata, 26, after she left her four children alone at the home on Rowan Street, in the Thomasboro community. One-year-old Gabriel Hawthorne and his 2-year-old brother, Josiah Hawthorne, died in the fire that destroyed the home.

She was charged with two counts of murder, three counts of reckless/gross felony child abuse, exposing a child to fire and one count of burning resulting in serious injury to a firefighter.

Her two older children, a 4-year-old son and 7-year-old daughter, survived the fire after they were helped by a neighbor.

Charlotte Fire Department Capt. Mark Basnight said Sunday night that investigators ruled the fire accidental. "It started in a bedroom," Basnight said. "It was involving a kerosene heater."

Firefighters from station 13, two blocks away, said they responded quickly and took only 19 minutes to put out the blaze. When they arrived, neighbors told them about the children inside. They said they aggressively entered the home, but couldn't save the two toddlers.

One firefighter was burned, treated at a local hospital and released.

A neighbor, Elizabeth Lane, awoke early Sunday and said she heard screams: "Mommy! Mommy! Mommy!"

She looked out her apartment window and saw the house across Rowan Street in flames. Lane called 911, then quickly dressed and ran to the house.

At the front door, she found the two older children. The 7-year-old girl tugged at Lane, screaming her younger brothers, Josiah and Gabriel, were still in the back.

"I walked into the house and the flames shot up like someone had poured gasoline on them," Lane said. "I got the two older children out. By then, the firefighters were there and I took the children to my apartment."

In 2007, Opata was convicted in Greensboro of possessing cocaine, and sentenced to at least six months in jail. Six years earlier, she was convicted of embezzlement, also in Greensboro, and sentenced to six to eight months.

Last October, Opata was charged in Charlotte with contributing to the delinquency of a juvenile and was awaiting trial before Sunday's arrest.

William Smith, who lives next door, described Opata as "a good mother."

"If she had to go to work, I'd see her getting on the bus with the children to take them to day care," Smith said. "If they were outside, she was always on the porch keeping a watch on them. Or if she had to be away, a friend would come pick them up or stay with the kids until she got home."

Smith, who has five children, said he was awakened by his 13-year-old son. He looked out his bedroom window and saw flames.

"By the time I saw it, the fire department was already there," he said. "I just made sure my kids and house were OK."

Juanita Edwards, a next door neighbor, said her husband, David, woke her around 6 a.m. and reported the house was on fire. By the time she looked out the window, firefighters were battling the blaze.

"I ran over there, and the kids was right at the door, and the fire was blazing, and I pulled them two out," said Lane. (neighbor Elizabeth Lane)

The oldest, a 7-year-old girl, begged Lane to save her baby brothers. Lane said the flames were too high to go back.

"I got them two out and little girl kept saying, 'My brother!' and I kept saying, 'Honey, we have to go. I can't get your brothers,'" Lane said.

Another neighbor who tried to comfort the children is haunted by the oldest daughter's words.

"The little girl was saying, 'I begged my mommy not to leave,'" recalled the neighbor.

Police said the four children had been left alone. "She said, 'Mommy please don't leave us here,'" the neighbor said.

And no one but neighbors were there to pull them out.

I bet that little girl was more of a mom to those 3 boys than her own mom.

Poor kids that lived - there life is ruined. RIP the two babies.... I read the dad was real distraught and the mom had done this many times before- leave them all there. Was he trying to get custody or just bitching?
I was DAMNED disappointed to find out I had to pay $20.00 just to get a signature. -TMYS

leaving the kids alone seems to be a way of life for these folks...
Eyewitness News pulled court documents that reveal Opata had a case pending in court for leaving three of her children home alone in another instance.

Last October, police were called to a fire station near Opata's home after someone dropped off a 2- year-old boy there. According to an arrest affidavit, the boy was found in the street. The anonymous person who found the boy led police and firefighters to Opata's home, where they found a 4-year-old on the front porch and a 9-month-old face down on a bed wearing a wet diaper.

Opata arrived at the home and told police she went to Thomasboro Elementary to pick up her oldest daughter. She admitted to leaving the other three children home alone in a bedroom.
    [...]

Charlotte-Mecklenburg police have not said where Opata was during Sunday morning's fire.

    Even the dad...
The father of two children killed in a house fire had been cited for neglect in the past.

According to this police report, the children's father, Jerry Hawthorne, was cited in 2008 for leaving three children unattended at a home on Bradford Drive. Hawthorne didn't want to talk to us on Monday as he left a gift at the children's memorial.

Jennifer Gary is a teacher at the school, and has the eldest sibling in her class. She said the 7-year-old girl often talked about her younger brothers.

"She's always trying to take care of someone else, so my heart really goes out for her," Gary said.

CHARLOTTE – A funeral was held at the Chappel Memorial Baptist Church for 2-year-old Josiah Hawthorne and 1-year-old Gabriel Hawthorne. The brothers died in last Sunday's house fire while their 7-year-old sister and 4-year-old brother made it out alive.

Their mother, Orgal Opata, is facing charges in their death after leaving all four children home alone.

From jail, Opata wrote a letter to her two boys expressing her love for them and saying she would mourn their deaths for a long time. A family member read the letter on he behalf.

Prosecutors won't seek death penalty for mom
CHARLOTTE, N.C. -- Prosecutors have decided not to seek the death penalty against a mother charged with murder after her children died in a house fire.
The Charlotte Observer reports that 26-year-old Orgal Opata nodded when she heard the decision in court Thursday.
Authorities say Opata's 2-year-old and 1-year-old children died in a February fire after being left alone in a Charlotte home. Two other children, ages 4 and 7, escaped with a neighbor's help.
Opata is charged with murder as well as four counts of exposing children to fire and three counts of felony child abuse.

Why do I feel that her little girl will require years, and years of therapy to overcome this? She begged her mom not to leave them, and she just left them. Walked away, like they were nothing. Now two babies are dead, two kids left with out a parent, (well in this case they didn't really have one), and I bet this child will blame herself for not being able to get them out. I am getting more upset as I continue to write about this story. How could she be so callous and leave those small kids alone, how????

Mother sentenced to at least 10 years in kids' deaths

Orgal Opata was sentenced Thursday to at least 10 years in prison for killing her two sons, who died in a fire at their home in west Charlotte in February 2010.

Opata, who pleaded guilty to two counts of involuntary manslaughter, had left her children at home alone when a kerosene heater sparked the fire that killed Josiah and Gabriel Hawthorne. Josiah was 2 years old; Gabriel was 1.

Opata, 27, also pleaded guilty to three counts of felony child abuse and four counts of exposing children to fire.

Opata wept as she talked about the loss of her children.

"I made the biggest mistake of my life when I decided to leave my childre unattended...," she told the judge. "I am paying for that mistake each and every day.".

Superior Court Judge Bob Bell sentenced Opata to a minimum of 10 years and a maximum of 13 years and eight months in prison.
