    Alexa Gonzalez, 12, Arrested For Doodling On Desk

    FOREST HILLS, N.Y. (WPIX) -
    A 12-year-old student was arrested and quickly branded a delinquent after she apparently doodled her name on a classroom desk.

    Alexa Gonzalez, a student at Junior High School 190 in Forest Hills, was led out of school Monday in handcuffs for simply writing "Lex was here. 2/1/10" accompanied with the classic smiley face. Gonzalez says she was trying to kill time while she waited for her Spanish teacher to pass out homework.

    Using an erasable lime-green magic marker, she also wrote "I love my friends Abby and Faith" on the desk.

    Gonzalez, who has a spotless attendance record, said she was shocked when she was handcuffed and taken into custody at the police precinct across the street from the school.

    According to the 12-year-old's mother, her daughter was questioned and released several hours after she was initially detained.

    Gonzalez appeared in family court Tuesday where she was assigned eight hours of community service, a book report and an essay on what she learned from her mistake.

    Nearly a week after the incident, Department of Education officials are now acknowledging that Gonzalez' arrest should have never happened.

    "The principal made a mistake and has lifted the suspension," a DOE spokesman told PIX News in a statement. "The child may return school. The principal is speaking to the parent today."

    Gonzalez' arrest comes just a day after a Staten Island student was nearly suspended from school for bringing in a 2-inch plastic lego gun.

    I did the same thing at her age. I got detention for a week and had to clean every desk in the room repeatedly. I didn't just write my name and a sentence. It was a full on landscape with a permanent marker.

    "I started crying, like, a lot," said Alexa. "I made two little doodles. ... It could be easily erased. To put handcuffs on me is unnecessary." Alexa, who had a stellar attendance record, hasn't been back to school since, adding, "I just thought I'd get a detention. I thought maybe I would have to clean [the desk]."

    "She's been throwing up," said her mom, Moraima Camacho, 49, an accountant, who lives with her daughter in Kew Gardens. "The whole situation has been a nightmare."

    City officials acknowledged Alexa's arrest was a mistake.

    "We're looking at the facts," said City Education Department spokesman David Cantor. "Based on what we've seen so far, this shouldn't have happened."

    "Even when we're asked to make an arrest, common sense should prevail, and discretion used in deciding whether an arrest or handcuffs are really necessary," said police spokesman Paul Browne.

    Alexa is the latest in a string of city students who have been cuffed for minor infractions. In 2007, 13-year-old Chelsea Fraser was placed under arrest for writing "okay" on her desk at Intermediate School 201. And in 2008, 5-year-old Dennis Rivera was cuffed and sent to a psych ward after throwing a fit in his kindergarten.

    A class action lawsuit was filed by the New York Civil Liberties Union last month against the city for using "excessive force" in middle school and high schools. A 12-year-old sixth-grader, identified in the lawsuit as M.M., was arrested in March 2009 for doodling on her desk at the Hunts Point School.

    Alexa is still suspended from her school, her mother said. She and her mom went to family court on Tuesday, where Alexa was assigned eight hours of community service, a book report and an essay on what she learned from the experience.

    "I definitely learned not to ever draw on a desk," said Alexa. "They told me with a pencil this could still happen."

    I can't see it. Seems to me to be a photo op that I'm sure will be run many more times.
    What happened was wrong yet it seems her family has zero problem with making noise about it (I'm sure for profit) that's why her name was released. A parent or guardian allowed it.
    No sense in pretending to be anonymous when your picture is everywhere.

    At that age I was practicing doodling OUT the face of my worst bully with a permanent marker!

    NEW YORK (AP) — A 12-year-old girl who was hauled out of her New York City school in handcuffs for doodling on her desk has started legal action against the city over her arrest.

    A lawyer for Alexa Gonzalez filed legal papers seeking $1 million in damages, saying the Queens girl was subjected to overly harsh treatment.

    While I agree it was a stupid move to do all that for a doodle, I would be EMBARRASSED to sue for a million dollars in damages. That kid does not belong in public if that little foray into the legal system caused her that much damage. I guess she could turn around and sue her parents for turning her into a media circus act, too.
