Man accused of fathering child with 11-year-old

Shocking details are unfolding in a case where an 11-year-old child is now a mother. It's a disturbing sexual assault investigation that has police using DNA tests to find the man responsible.

The girl and her baby are both in the custody and care of Childrens Protective Services, living with other relatives. The story is disturbing considering the age of the girl, but even more so considering the result of those DNA tests.

We're not revealing his identity or photograph, because of his relationship to the victim. He is 27 years old, married and now accused of fathering a child with his 11-year-old stepdaughter. The suspect is being held in the Brazoria County Jail charged with aggravated sexual assault of a child.

According to the probable cause affidavit, "On September 24, 2009 it was learned a child was found to be six months pregnant. The pregnancy was discovered by Alvin ISD personnel when she began to show signs of pregnancy and was given a pregnancy test that tested positive. She gave birth on December 12 by C-section at the age of 11 years old. The child's caregiver says the victim told her (the suspect) has been having sex with her since she was six years old until September 2009 when she was removed by CPS. They would have sex sometimes two and three times a week.

It was a genetic test of the baby, investigators say, that identified the suspect as the biological father. He was said to have resisted giving a DNA sample.

"I obtained a search warrant and collected his DNA that way," said Detective Jeff Dandeneau of the Brazoria County Sheriff's Office.

Detective Dandeneau added that the suspect continues to deny that the baby is his.

CPS says the mother and the baby are both staying together with relatives elsewhere until this case is resolved

An 11-year-old mom was taken into the custody of Child Protective Services after the agency discovered the she was impregnated by a family member.

The 11-year-old, her baby and the preteen's sibling have been placed with relatives, CPS officials said.

Officials said the 11-year-old's mother allegedly knew of the sexual abuse but did nothing to stop it.
CPS won custody of all three children during a status hearing Thursday.

A 28-year-old Alvin man remained in jail Friday, charged with aggravated sexual assault of a child after officials said DNA tests confirmed he fathered a baby with his 11-year-old stepdaughter.

“In our office, there is a sense of deep sorrow,” said Lisa Jolly, executive director of the Brazoria County Alliance for Children, a nonprofit that provides a range of services to abused children. “To the general population, it is very shocking.”

The stepfather, whom the Houston Chronicle is not identifying because it indirectly could identify the victim, was arrested on Wednesday and remained in the Brazoria County Jail in lieu of $200,000 bail on Friday, the Brazoria County Sheriff's Office said.

If convicted of the first-degree felony child sex charge, the stepfather faces five to 99 years in prison. He works as a driver and does not have a criminal record, investigators said.

Sheriff's investigator Jeff Dandeneau said the man denied having sex with his stepdaughter and refused to provide a DNA sample.
Officials with Texas Child Protective Services said the 11-year-old and her 7-year-old sister were removed from the home in late November, about three weeks before she gave birth on Dec. 12. The girl's advanced pregnancy was noticed by teachers at her Alvin Independent School District elementary school in late September, and tests and medical examinations confirmed she was expecting.
“I can confirm we took her and her sibling into custody, and she is living with relatives,” said CPS spokeswoman Gwen Carter. “They're doing as best as can be expected. They're with some wonderful relatives who are protective and making sure they have everything they need.”

The young mother, her sister and the infant are living with an adult cousin, according to court papers.

Carter said the mother of the abused girl did not shield her daughter from the abuse, but she declined to elaborate.

“What I will tell you is, the child's mother was not protective, and that's why we went to court to take custody,” Carter said.

According to the probable cause affidavit filed with the charges, the 11-year-old told a relative that her stepfather had been having frequent sex with her since she was 6.

Dandeneau would not comment on whether the child's mother would face charges, saying any other charges would be decided by the district attorney's office.

Jolly said it would be very difficult to predict how the young mother will do in the future.

“It depends on the resiliency of the child, the support systems she has in place as far as someone encouraged her to obtain help,” Jolly said. “Our hope is she will receive all the support services she needs — legal, emotional and spiritual support from her family.”

Woman Sought after Young Daughter Gives Birth
ALVIN, Texas - It was a horrifying case. In early 2010, FOX 26 first learned about a Brazoria County man accused of raping his 11-year-old stepdaughter and impregnating her. New evidence has developed that has led to a grand jury indictment of the girl's own mother on the same charge -- aggravated sexual assault of a child.
A warrant has been issued for the mother's arrest, and investigators need help finding her.
Mirella Garcia Caple, 36, and her husband Stephen Caple, 28, lived in Alvin with the woman's children. In 2009, investigators uncovered what they call years of sexual abuse against one of Garcia Caple's daughters.
"Any situation where a child is hurt is horrible. Children trust their parents. They trust their stepparents," said Gwen Carter, spokeswoman for Child Protective Services.
Court documents reveal that Stephen Caple began raping his daughter when she was just six years old. In 2009, the girl got pregnant around her 11th birthday, and DNA tests confirmed that Caple fathered the child.
In December 2009, the girl she gave birth to a full-term baby.
"Based on that information, CPS went to court. We do have custody of the children. We placed them with relatives, and they're safe," said Carter.
But the case is not over. On Tuesday evening, FOX 26 News visited the home of Garcia Caple upon learning of her charge. Brazoria County investigators and the district attorney's office did not return calls from FOX 26 for comment about the case.
From the start, CPS caseworkers were suspicious of the mother's behavior.
"Anytime we're concerned a parent may know something or may have allowed abuse or neglect, there's a great concern," said Carter.

Investigators say Caple may be driving a burgundy Toyota Corolla. She frequently accepts work as a home-based health care contractor, takes part in Girl Scouts of America activities and works with special needs children.
Anyone with information on where Caple can be found is asked to contact Brazoria County Crime Stoppers at 1-800-460-2222. There may be a reward available for information that leads to Caple's arrest.
Mirella Garcia Caple's husband, Stephen Caple, was charged with aggravated sexual assault of a child and arrested in January. Investigators have issued a warrant for Mirella Garcia Caple on the same charge.
Stephen Caple remains in jail on $200,000 bond awaiting trial.
