Juana Valencia denies she gave birth

A 19-year-old woman who was arrested on suspicion of dumping her newborn baby in a trash can after giving birth to her in a restaurant bathroom was identified today as an employee of the restaurant where the baby was born.

Juana Perez Valencia, of Anaheim, has been charged with one felony count of murder and faces a maximum sentence of 25 years to life in state prison if convicted.

Valencia was taken into custody last week after the newborn girl was found in a trash bin outside of Sombrero's, a Mexican restaurant at 7006 Katella Ave., authorities said. According to prosecutors, Valencia gave birth Wednesday to the girl inside the restaurant, where she was working as a food server at the time.

She was taken into custody by authorities last week, after she went to Anaheim Medical Center to be treated, said Jim Amormino, spokesman for the Orange County Sheriff's Department. Valencia appeared to have recently given birth, but doctors said she denied having been pregnant.

The baby girl was found in a trash can outside the restaurant, authorities said, wrapped in a plastic bag.

An autopsy revealed that the baby, who weighed 6.3 pounds and was 17 inches long, was alive when she was left in the trash bin.

you know what i don't understand. i was supposed to have a homebirth. midwives and chanting and the whole fucking nine yards...well after about say....46 hours of labor (back labor to be exact, babycrazy was sunny side up so it felt as though my spine was being ripped apart) and only 6 cm, and no water break, i said take me to the fucking hospital. and of course they treated us like shit, a bunch of harrylegged hippies and a crazy lady in labor. anyway. the fact that she gave birth at a restaurant restroom....(and nobody heard) and then she??? was off her shift? went back to work the next day? i have no clue, how do you enter a restroom preggers and exit not preggers (granted there is not a big difference, except for the trail of blood leaving your body) How the fuck did nobody notice this?

and yeah, you're supposed to go to the hospital after 24 but we lied. i really wanted a home birth. instead i got a shitty reception at the hospital...but in the end i got THE BEST BABYCRAZY!

I have had 1 hard labor and 2 damn difficult/impossible labors. I don't understand how she was in there as long as she would need to deliver and no one would notice. If it was her first pregnancy I can understand how it might not be "noticeable" and with the size of the baby I would say probably 34-36 weeks.

More over what I don't understand is how she can just continue to go about as though nothing happened (then again women in 3rd world countries deliver and then return to the field within minutes/hours).

She could have walked into any hospital, police station, fire station......fuck. I don't even care if she handed the baby over to someone at a GAS STATION!!! She had options. Her tiny baby did not.

And yes. How do you not notice that someone is giving birth in a bathroom? I was lucky enough to witness my friend giving birth at home and that was no small thing! Not to mention everything else that comes out with the baby. How could someone NOT notice??

Well remember the lesson from Michigan Safe Haven Law.... If you use it, then you can be prosecuted and lose your other children.... Never know if she heard about that case.

Is 2009 notorious for babies being discarded like garbage? I have counted 10 threads so far, here in the forums, just searching for baby and trash!! Is this generation of 16 to 25 year olds not being taught in High School about safe haven laws? Or are they just that callous, selfish and soulless?
I'm with you Optilyric!!(And the rest of ya) I am infuriated by the actions of these breeders that just toss out a human like they are nothing, how does one justify that in their own mind and heart?? How does a mother just block out an infants first cry or whimper?? I say just cut out their hearts, because obviously they don't need it!!

Still, it's about a moral decision, not just about the law and how it treats such things. Even with such possible consequences murder should never be the choice.

Yeah it seems that way, but they are instructed to only consider what evidence they are allowed to. It's the game of court law.
Even the worst get away with their crimes depending on how the case is presented.

An Orange County woman was convicted Friday of suffocating her infant daughter moments after giving birth in the restroom of the restaurant where she worked and then tossing the body into a dumpster.

A jury found Juana Perez Valencia, 21, guilty of one felony count of second-degree murder and one felony count of assault on a child with force likely to produce great bodily injury resulting in death, according to a statement from the Orange County district attorney's office.

Valencia, who lived in Anaheim, was previously tried in this case, but the initial jury was unable to reach a verdict.

Prosecutors said that on the evening of Dec. 22, 2009, Valencia gave birth to a girl in the restroom of Sobrero's, a Mexican restaurant in Stanton where she worked as a food server. The baby was born alive and at full term, 17 inches long and weighing 6 pounds, 3 ounces.

Prosecutors said Valencia -- who was a teenager at the time -- suffocated the baby immediately after giving birth.

The next day, prosecutors said Valenica went to an Anaheim hospital for treatment. She claimed that she was injured in a fall and denied having given birth, despite medical evidence to the contrary, according to prosecutors.

Hospital staff contacted authorities. Orange County sheriff's investigators found the newborn's body in a plastic bag in a trash bin behind the restaurant.

Valencia is scheduled to be sentenced Nov. 9. Prosecutors said she could face a maximum sentence of 25 years to life in prison.
