A Kingston man who was released on bail after being charged with raping a 5-year-old girl this summer pleaded not guilty Monday to the weekend rape of a 3-year-old girl.
Twenty-six-year-old Joseph Gardner was arraigned Monday in Plymouth District Court on charges of rape of a child by force and intimidating a witness.

Prosecutors said the girl's mother told police that she had known Gardner since high school, and she, her daughter and son had slept at his house Friday night. The woman said her daughter told her Gardner attacked her in the bathroom, smashed her head against the sink, and threatened to kill her father if she told anybody.

Gardner was accused this summer of breaking into a home and raping a 5-year-old girl. He was released on $10,000 bail while awaiting trial on those charges.
Seriously, why the fuck should someone who rapes a child be given the option of bail?! And the mother should get a round smack on her head for being STUPID. Why on earth would bring children around a man charged with breaking into a house and raping one?
As for the bail... it says a lot when you get more for being caught with drugs than raping a child.

This is absolutely disgusting! Once again, another wonderful example of our judicial system! When are people going to realize that these child rapists cannot be rehabilitated and will only continue to create more victims when allowed! Christ, why didn't they just help him out a little more and drop him off at a daycare! I'm all for human rights, but when an adult decides to RAPE a child, I no longer look at them as being human and, therefore, are not entitled to those said rights! And, yes, the mother is a complete idiot who should be charged at the very least with 2 counts of child endangerment!

Plymouth District Attorney Timothy J. Cruz yesterday vowed to block any move to force a 3-year-old Pembroke girl to testify at a dangerousness hearing for the man accused of raping her - and he called on state lawmakers to change the statute.

“I will not allow babies in my county to be brought to court. . . three or four days after a traumatic event just to give the defense a leg up,” Cruz told the Herald.

Cruz’s office successfully petitioned Plymouth District Court Judge John Julian to quash subpoenas Joseph H. Gardner’s defense attorney had sent to the girl Gardner is accused of raping and her 8-year-old brother.

The 3-year-old, her brother and their mother were spending the night at Gardner’s apartment Friday when the boy allegedly saw Gardner take her into the bathroom, according to court records.

There, as his own 4-year-old slept in another room, Gardner allegedly raped her, slammed her head against the counter three times and threatened to kill her father if she told anyone what happened, records show.

The girl’s mother told police she heard her daughter crying that night but didn’t get up to check on her until about 11:30 a.m. Saturday, when she awoke to find the child without a diaper. Police said they later discovered a diaper and a pair of boxer shorts in the trash at the rear of the apartment.
