    Man Questioned Over Toddler Death

    Police are questioning a man about the death of a 15-month-old girl injured in an alleged assault at a house in Northern Ireland.

    The girl was under intensive care at the Royal Victoria Hospital in Belfast after being hurt in Co Fermanagh.

    Police arrested a 30-year-old man as part of the investigation.

    Detectives from the Police Service of Northern Ireland's (PSNI) serious crime unit are involved and searched a house at Glebe Park in the Chanterhill area of Enniskillen.

    The child was first admitted to the Erne Hospital in Enniskillen last night and then transferred to Belfast.

    Western Health Trust staff are assisting police.

    Local nationalist SDLP Assembly member Tommy Gallagher said: "My thoughts go out to the family. There is a great sense of shock and anger about this. The whole thing is playing out very badly."

    Glebe Park is a residential area of the lakeside town on the road to Tempo. Forensics staff have been combing the area for clues.

    Dead baby 'victim of sex abuse'

    A man has been in court charged with the murder of 15-month-old Millie
    Martin in Enniskillen.
    Barry Michael McCarney, 30, who had been living at Glebe Park in Enniskillen, appeared at Omagh Magistrates Court on Tuesday.
    He is the partner of Millie's mother and the court heard he denied having anything to do with the girl's death.
    The court also heard that Millie may have been sexually assaulted sometime before she died.
    That allegation was made by medical staff at the Erne hospital in Enniskillen where Millie was taken on Thursday.
    Det Insp John Caldwell told the court that police had been contacted by staff at the hospital after Millie was admitted in "a lifeless condition".
    The court was also told that Millie's mother Rachel was not in the house when the child was injured as she had gone out to get takeaway food.
    Mr McCarney's solicitor said his client had given a "detailed account" to police during four days of questioning.
    During the 20-minute hearing, Det Insp Caldwell outlined to the court the events that had led up to Mr McCarney taking Millie to hospital.

    He said Rachel Martin had gone out around 2000 GMT leaving the accused to mind her daughter.
    She returned within half an hour to find that her partner had left for hospital with Millie.
    "The child was OK at 8pm and around 20 minutes later the child was taken to hospital in such a lifeless condition," said the police officer.
    There had been no-one else in the house during this period, he added.
    Det Insp Caldwell also said that Mr McCarney had been left to look after Millie the previous night.
    On that occasion, her mother had gone to a Chinese takeaway.
    On arrival she found it was closed and rang Mr McCarney to tell him, but he didn't answer.
    While he later told his partner he had been at the toilet when she called, under police interview he said he had been out collecting sticks for the fire.
    'Agitated'
    Det Insp Caldwell said the next morning - Thursday - Millie's mother noted that she was lethargic and that one of her eyes appeared to be closing over.

    Mr McCarney left to go to work but returned less than three hours later after complaining of feeling sick.
    The detective said colleagues who encountered him in the morning said he appeared agitated.
    Mr Caldwell said the defendant had volunteered to look after Millie again when her mother went to the chip shop that evening.
    "Despite being so unwell and unable to work he volunteered to look after a sick child," he told the magistrate.
    Mr McCarney's lawyer put it to the officer that police had no scientific evidence as to when the injuries that killed Millie were inflicted.
    Mr Caldwell agreed but added: "Further tests will be carried out to establish such dates."
    Mr McCarney was remanded in custody.

    Distressing details have begun to emerge about the final hours of Millie Martin, who died suffering from horrendous injuries including a broken back. As her grief-stricken family mourned the loss of a “beautiful and precious little girl”, police in Enniskillen questioned a 30-year-old man — understood to be Millie’s mother’s partner — over the harrowing death.

    Police arrested the suspect on Friday after he went with Millie and her distraught mother Rachael Martin (25) to the Royal Victoria Hospital in Belfast where she had been rushed from the Erne Hospital in a critical condition.

    Police and medical staff were said to have been “extremely shocked” by her condition.

    While postmortem results have not been released, the tot is understood to have suffered from horrific injuries. It is understood that detectives are investigating the possibility Millie had been raped.

    Neighbours spoke of a community deep in shock after it emerged that police are investigating claims the toddler had also been the victim of a serious sexual assault.

    Police were last night given a further 24 hours to question a man — who is not the child’s father — about the murder.

    My baby is 16 months. Makes me sick, the nasty fucking bastard. He voluntered to babysit while the mom went to get food. He had this planned.     Millie Martin murder accused refused bail

    A man accused of murdering a 15-month-old baby in Enniskillen last December, has again been refused bail.

    Millie Martin suffered fractured ribs and a blow to the stomach days before she died last December.

    Barry McCarney, 31, denies murdering the child.

    The third application on behalf of Mr McCarney was made in "substantially changed circumstances" as the baby's mother is now a suspect in the case.

    Delivering his decision, district judge Liam McNally said strenuous submissions had been made to the police during Mr McCarney's interviews that Rachael Martin should be treated as a defendant.

    Ms Martin appeared in court in September charged with wilfully neglecting a child in a manner likely to cause unnecessary suffering or injury.

    The prosecution objected to bail for Mr McCarney on grounds of interfering with witnesses, committing further offences in doing so and that he would not turn up for his trial.

    Judge McNally said he felt the first two objections could be dealt with by strict bail conditions but he had serious concerns that the accused would not turn up for his trial.

    He added that, having read the pathologist's reports, it appears the injury that caused baby Millie to lose consciousness occurred shortly before she was taken to hospital and that there was also evidence of sexual assault.

    He said there was a strong case against Mr McCarney and that this was one of the most serious cases he had had to deal with.

    In the months prior to her death, Millie had suffered a number of injuries, including broken ribs.

    The judge said there had been a previous breach of Mr McCarney's bail conditions and that the arguments against giving bail were stronger than the presumption of innocence. Therefore he refused the application.

    He said it was likely the preliminary enquiry would take place before Christmas.

    This baby suffered a 'number of injuries' in the MONTHS prior to her death, yet her mother still left her alone with this creature. Still allowed this creature to continue living in her home.

    The man accused of murdering toddler Millie Martin has told Enniskilllen Magistrates court he is innocent.

    Barry McCarney, 31, of Bridge street Trillick, said he did not lay a hand on Millie and "was sickened and saddened by her death".

    He faces four charges including murder, a serious sexual assault, unlawful death and grievous bodily harm.

    Fifteen-month-old Millie died after being brought to the Erne hospital in a lifeless condition in 2009.

    Mr McCarney, appeared in court along with his former partner and Millie's mother Rachel Martin.

    Ms Martin, 27, from Kesh, faces two charges of allowing the death of her daughter and wilful neglect.

    She is heavily pregnant and told the court she did not wish to say anything but her solicitor said she "absolutely denied" the offences.

    They will both appear at Omagh Crown Court on 22 March.

    Dungannon Crown Court also heard that the Enniskillen based doctor told police after the infant's death that he "did not see any bruising or injuries to Millie" in the week leading up to her death on December 11 2009.

    The baby's 27-year-old mother, from Main Street, Kesh, denies wilfullly neglecting and allowing her death.

    Her 33-year-old former partner Barry Michael McCarney, from Woodview Crescent, Trillick, is accused of murdering and sexually and physically abusing her. He denies the charges.

    Baby Millie's doctor said that up to her first birthday in September 2009 there was nothing "exceptional" about Millie and "how she was presented (to his surgery) and how her mother was looking after her".

    Dr Jentsch agreed with Martin's defence QC John McCrudden that the GP practice notes showed "a profoundly normal and unexceptional history".

    The GP notes "also indicated that the mother was at all time attentive".

    Witness have told the court seeing injuries on baby Millie, in particular a "blackened ear" and an "egg, or oval shaped bump" in the middle of the 15-month-old toddler's forehead.

    "Was there any bruising or marks evident to you, on her face, ears or chest," asked Mr McCrudden.

    "Not that I can remember," the doctor replied.

    Later Dr Jentsch told both the lawyer and trial judge Mr Justice Stephens it was his "observation and impression" that "Rachael appeared quite sensible".

    Dr Jentsch agreed that baby Millie's mother had shown "no hesitation" when asked to remove the child's top and had "found Rachael always helpful where Millie was concerned".

    The last time he saw either mum or daughter was on 9 December, "the day before she effectively died", after a nurse had asked him to check on a burn to the child's right index finger.

    At that time, Dr Jentsch said "Millie was not shy; she came up to me herself and showed me her finger and let me examine and to touch it."

    However, "there was nothing in Millie's movements, in her person, in her demeanour or appearance that would have suggested ...that this child was visibly impaired or had effectively no sight".

    A leading Home Office pathologist has already told the court that Millie would have been blinded around the time she received a blow to the back of her head, which eventually lead to her death.

    Dr Jentsch told the court the last time he saw her she certainly "was not blind".

    Earlier, a doctor from the Erne Hospital who examined the burn to Millie's finger also agreed that she had not seen any other injuries to the youngster.

    Meanwhile, Rachael Martin's stepfather Noel Graham, told the court of the "nasty looking" bruise to baby Millie's ear, which was bluish in colour and looked swollen on the inside.

    Mr Graham said while he got no explanation for the injury he "had confidence in Rachael and Millie's grandmother".

    The grandfather later described how the infant, whom he admitted spoiling, made a face when he lifted her under the arms.

    "When you lifted Millie she did not make any noise, but put a little expression on her face" and agreed it looked as if she "was tensing up your face".

    Mr Graham said that the day prior to her being taken to hospital, the child happily danced away to the ring tone on her grandmother's mobile, so they repeatedly played it back.

    He said baby Millie "was enjoying it because she knew she was the centre of attention".

    However, the following day "Millie was very clingy" with her mother, and "could be best described as being full of the flu".

    On the evening the infant was rushed to the Erne Hospital by McCarney, Mr Graham said he was told nothing directly as to what had happened to the child.

    The next morning, it was he who formerly identified his granddaughter's body to the police.

    The trial continues on Monday.

    But the haunting footage, captured in Erne Hospital, in Northern Ireland, disguises the horrific reality of what has just happened.

    McCarney is no desperate father giving the kiss of life to his 15-month-old step-child. Instead, he is the perverted monster who abused Millie Martin so badly that she died of her injuries.

    McCarney, from County Tyrone, met Millie's mother Rachael Martin just three months before the little girl's death.

    He quickly eased his way into the family home in Enniskillen which allowed him access to Millie.

    During a ten-week trial, the court heard how he had physically and sexually abused the toddler until she was left with a number of fatal injuries, including the head wound that killed her.

    A pathologist found that Millie had suffered 21 cracked ribs, seven of which were old, while the rest had happened in the ten days before her death.

    Multiple bruises were also found on the youngster's body along with a clearly visible oval shaped bump on her forehead.

    During the post-mortem examination, the pathologist found injuries to her abdomen caused by punching or prodding which would also have been fatal.

    But in a case with no forensic evidence to suggest who inflicted Millie's injuries, the jury rejected McCarney's claims and accepted that Ms Martin had unwittingly let a monster into her home, taking just three hours to reach a unanimous verdict.

    He was found guilty of murder, sexual assault and causing grievous bodily harm.

    Ms Martin sobbed as she was cleared of allowing her daughter's death through willful neglect. She was heard to say that justice had been done for her daughter.

    McCarney's relatives shouted 'innocent' as they left the courtroom.

    Meanwhile Ms Martin's family issued a statement saying the family would now be able to grieve properly as a result of the verdict.

    They described the last three years as a 'waking nightmare' and described McCarney as a 'disgusting individual'.

    They also questioned why Ms Martin was ever prosecuted in the first place.

    McCarney will be sentenced in the New Year.

    Neil Anderson, head of the NSPCC, said Millie will be remembered as the victim of 'one of the most horrific cases of child abuse Northern Ireland has ever seen'.

    He added: 'One clear message from this deeply disturbing case is the need for vigilance among healthcare professionals, family, friends, neighbours and the community as a whole.

    Killer of toddler must serve at least 25 years in prison after ‘sadistic sexual assault’

    A mother whose sex offender ex-boyfriend murdered her infant daughter has branded his 25-year prison term too lenient.

    Co Tyrone labourer Barry McCarney was today given the life sentence tariff in Belfast Crown Court for the murder of 15-month-old Millie Martin in Enniskillen, Co Fermanagh in 2009.

    The toddler's mother Rachael said her former partner deserved a harsher punishment.

    "I don't think it was long enough," Ms Martin said outside court.

    "Twenty five years isn't long enough."

    Her mother and Millie's grandmother Margaret Graham said 33-year-old McCarney, who was not the child's father, should never be freed.

    "It wasn't long enough - life should be life," she said.

    "He should never see the light of day again. We won't ever see Millie, her mummy won't ever see her wee daughter and life should mean life."

    In setting the minimum term McCarney must serve of his life sentence, Mr Justice Ben Stephens explained that the sentencing framework in Northern Ireland was very different to that in England and Wales, where a whole life term could be handed down.

    He said the offence was serious enough to use the upward starting point guide of 15 to 16 years.

    Explaining that aggravating features, among them the vulnerability and fragility of the victim, required him to make a "substantial upward adjustment", he told McCarney he would have to serve at least 25 years.

    The judge described him as a "deeply manipulative individual devoid of any regard for social norms".

    "You perceived Millie to be yours to abuse when opportunity presented," he said.

    Once the 25-year term is spent, McCarney can only be released, on licence, if parole commissioners deem he no longer presents a danger to the public.

    McCarney, clean shaven and dressed in a grey jumper, showed little emotion as the judge delivered his sentencing decisions.

    The judge said McCarney had duped Ms Martin into believing he cared for Millie and she was therefore willing to leave her daughter alone with him.

    "You gained the total trust of Rachael Martin, you appeared to her to be very good to Millie," he said.

    On the night the toddler sustained the fatal injuries, McCarney had persuaded his girlfriend to go out to a shop to buy him a chocolate bar.

    Justice Stephens said he was already on his way up the stairs with the intention of sexually abusing the young child in her bed as Ms Martin was reversing her car out of the driveway.

    The judge said McCarney had struck Millie's head on a hard surface in response to her cries as he inflicted a brutal sexual assault. That head injury would ultimately kill her.

    I don't know....I think the mother was clueless. Too trusting. It was less of letting him hurt her daughter and more of her just not seeing the signs. My opinion. And honestly, a child deserves a parent who can see it all but....well, sometimes we don't see it all.

    This story breaks my heart. I hate that his face was the last one she saw.

    25 years is a joke. The judge says he had to take into consideration the heinous nature of the crime and the fragility of the victim, but he hasn't done that at all. The grandmother is exactly right; his disgusting waste of a life should be taken for taking the life of that beautiful child. He is an absolute disgrace, as is his enabling father.

    I would have to research the laws there, but I think this was in the maximum range that he could have gotten. The judge is not allowed to just pick a number of years and assign them. The sentencing guidelines are statutorily designated to ensure consistency and "fairness" for people who commit similar offenses to get similar punishments or ranges of years.

    I personally think it was a shit sentence for what this creature did, but I don't think it was the intention of the judge to give a lenient sentence. Then again, I live in the U.S. where the rates of incarceration and number of prisons are higher than anywhere else in the world.

    I wish I did not see that footage. It leave me with awful feelings....

    Relatives on my husband's side, are full-blooded Irish, they are very traditional. They love their family. And they loathe baby rapists.......I'm sure that they will make sure McCarney don't get good sleep in prison.
